The contract was signed in August of 2019 to complete essentially a remodel on my home. The second most current contract which included a higher total amount of how much the job would be, was signed in October of 2019, for what should have been 60 days. My home is still uninhabitable, I am 8 months pregnant (high risk), and myself and my children have been displaced the entire time. Insurance stopped covering our hotel stay, as of October 2019.

hello *** attached or my photos and estimate for courtenay justice after reading her complaint I would like to add that ms. justice had a prior agreement with *** before I was asked by them to if I would use my license just for the purpose of them claiming the funds need to do her project from the mortgage company, *** had completed about 50% of the work at ms. justice property before I was asked to help the claim monies to resume her project, I have been totally in the dark as to anything that was happening on the job until I contacted ms. justice 2 weeks ago. from our conversation the relationship between her and *** has declined and it seems nearly impossible for them to work toghther to resolve this issue and complete project, I tried to talk with ms. justice and I do understand her frustration, and I spoke with *** to get him to complete the project which he has been doing slowly because of depleted funds. so here's were I am today mortgage company was called out 2-3weeks ago to do a 90% inspection so that remaining funds can be disbursed to move forward with completing the job, ms. justice is dealing with them and we are totally in the dark to the situation. she has well over the amount to finish her project. but there is little communication between her and ***. accourding to my estimate the job is 90% completed and I just want to resolve since im the person in the middle.

I am rejecting this response because:

In response to Howlout General Contractors, ***, and ***'s response to my complaint the company, and those associated it with it (***, ***, Howlout General Contractors), are continuing to perpetuate fraud and deceit.

My initial agreement was with ***. ***, was reccomend to me by his daughter (***). *** was just moving back in her home when I met her, and had just gotten out of a similar situation where her home had water damage. She showed me the work that her Father, and "Uncles," completed in her home, and it was beautiful. She told me that they would be able to start, understanding that Insurance hadn't issued the check yet, but knowing that it was on the way. I met with ***, who presented his self as license, bonded, and insured on more than one occasion. At that time I didnt ask, for proof, I took him at his word. The contract was signed that stated the work would be done in no more than 60 days.

***, I, and my Homeowners Insurance was very clear from the beginning, that the initial check of around $21,000.00 dollars, was a starter check. That check was deposited into my account, and issued incrementally to ***. In the event that we needed more funds, a new scope of work was to be drawn up with explanations as to why more funds would be needed. We knew off top that more funds would be needed, because initial estimates were all in the price range of $30,000.00-$47,000.00 with at the time only one bathroom demo, from at least two other license, bonded, and insured contractors.

Once the new scope of work was presented, Homesite Insurance (Homeowners Insurance), then requested proof of license, etc. I asked why they were requiring paperwork at this point (out of curiosity)? They replied because anything over $50,000.00 dollars required a different process. Including verifying documents, and inspections (midway through, and upon completion), in order to recieve the check.

At this point is when another contract was signed by ***. I Was told by ***, that we needed to sign another contract, because it needed to include the new total amount of the job. I had never up until this point had a conversation with ***, and I just assumed that *** worked for ***.

Around Thanksgiving of 2019, I met *** and *** at a check cashing establishment, inside of Food 4 Less in Moreno Valley., off Allesandro & Indian, and the second draw was issued for around $17,000.00+ dollars. *** and I endorsed the check. *** and *** left with the cash, and promises of getting the job complete now that they had the majority of the funds.

When *** says that *** and I asked to use his license in order to recieve the funds from the mortgage company, this is categorically false. I met him for the first time at the Food 4 Less, recognized his name from the second contract *** presented, with ***'s info on it. I always assumed *** was legit, and when the paperwork came back for ***, again, I just assumed *** was his boss.

Most recently I had several conversations with ***. He called to apologize, and stated that this should have typically taken no more than 45 days. Once I asked for proof of Insurance I was told they don't have any, and can not get any. I have asked *** how long its going to be before my home, which has been uninhabitable since June of 2019 (the initial contract was signed with *** at the end of August 2019), would be completed, and *** told me it'll be completed when he gets the rest of the money. So when *** states that the project has been going slow because of depleted funds, I'm very confused. Its customary to give Contractors 10%-20% of a job, and the final payment after invoice has been submitted and the job completed, neither of which have occurred.

*** states that *** has 90% of the job complete, when the contracted inspectors came for the morgatge company, they stated that it was 60% complete. There is absolutely no reason that the job shouldn't be 100% complete after over 6 months of having this contract. *** did call me this week and offer me $2,500.00 dollars out of the insurance money for my "trouble," that's not even two months worth of my morgatge, let alone the extra expenses I've been burdened with because I'm not in my house. The stress caused me to be placed off of work, and I went into Pre-Term labor on 2/2/2020, and my son ended up in NICU. Yes I was pregnant throught this entire ordeal, and displaced with four other children.

Because I am in this situation, (I'm a first time homeowner, I've only owned my home for now two years, and have now been out of it a total of 9 months), I was forced to see who I could reach out to for assistance. In doing so I came across the Revdex.com, and California State Licensing for Contractors. In doing so it appears not only is *** operating in an unlicensed capacity, *** is as well. *** again, with his lies tried to act as if the insurance lapsed for Howlout, during the job...according to the State of California's website Howlout states that they are not operating, their license expired in 2018, and they haven't been insured since 2017.

All parties involved, ***, and ***, Howlout General Contractors, purposely misled me, and continue to be dishonest. All *** continues to say is he needs to make a profit, with no regard for the state of I'll repair my home and life is in at this point.
