They were able to help me through a difficult financial time and were very pleasant to deal with. I would highly recommend them to anyone looking for a Trustee to file a bankruptcy or consumer proposal.

Hi Melanie. Thank you for the kind words. We are so happy we were able to help and wish you all the best in your new financial future! The team at Hoyes, Michalos.

I filed bankruptcy with ***. He was good at the beginning.
There was an issue with my name being on a property owner by myself and my ex.

After a while *** stopped answering any of my emails or questions. I have no idea what happened to the bankruptcy . everything is showing up on my credit report as owing.

My name was never removed from the property like it was supposed to be.

*** will not return any emails to let me know what's going on or why it is not done.

Also he was supposed to file my taxes for the year and only filed half of them. So I jave not received any gst or trillium benefit because my taxes werent filed properly.

He has ignored me for MONTHS now. I tried emailing the website for the company and never got a reply from them either. Please look into this.

Desired Outcome

I want to know if my bankruptcy is complete. Why my name isn't off the house. I'd also like my taxes filed properly.

Thank you for taking the time to let us know that you aren't satisfied with the way we handled your case. I took the weekend to review your file and to speak with the local office that handled your bankruptcy to see what the issues were so I can properly address your concerns.

First, you were discharged from bankruptcy on May 18, 2017. That is the date you were told you would be discharged when you filed August 17, 2016 - 9 months and 1 day later. I see that we sent you your Discharge papers that day and you sent us an e-mail saying "thank you". So, as far as you are concerned, you are no longer responsible for any of the debts that were included/listed in your bankruptcy. The bankruptcy itself is still "open" because two items remain outstanding, but this has nothing to do with you. As far as you are concerned, you have done what you were required to do and your debts are gone.

Second, you name is no longer on title for the house - it was removed quite a few months ago as part of the bankruptcy process. The confusion may be that now instead of your name, it says the "Bankrupt Estate of your name". It probably doesn't help that your ex's family is still trying to settle with you for the house when by law they are required to settle with your bankruptcy. The house is one of the two reasons your bankruptcy remains open even though you have been discharged (released).

Third, you asked to have your taxes filed properly. They have been. I have to point out that we asked you for the information to file your taxes in February and again in March. As you know, taxes must be filed by April 30 every year in order not to interrupt any of your government benefits. You gave us the information to file your taxes May 5 and we filed them on your behalf May 8. Now we have to wait for the tax department to process your return - to date they have not done so and there is nothing we can do to force them to move any quicker. Believe me, if we could we would as we have to keep your bankruptcy open until the tax return has been processed.

I hope that answers your concerns. I note that in your complaint you state that you haven't heard from us in months and yet I see you and *** were exchanging e-mails at 9:15 and 9:24 on the day you filed your complaint, Sept 21.

I also see that *** did not charge you a fee for filing bankruptcy. The normal cost is $1800 and he waived that do to your dire financial circumstances.

In closing, allow me to apologize that you were dissatisfied with how your bankruptcy was handled. I hope I have addressed your concerns, but if you'd like to discuss this further please feel free to contact me directly by phone or e-mail to discuss this further.

Our goal is to help people resolve their financial problems and give them a clean financial start. I hope things go well for you in the future...
