January 14, Dear [redacted] and [redacted] ***: I write to advise that I represent MrHPeter H [redacted] , H.PHerring and Associates and [redacted] in connection with the above referenced matterMrHerring has asked me to respond to the complaints made against him and his business by [redacted] related to a garage that he constructed for her in Summer of MrHerring has been in the contracting business for thirty years and has an impeccable reputation for care, craftsmanship and fair dealingTo his knowledge [redacted] ***'s complaint is the first such complaint made against MrHerring in those thirty years.The work that MrHerring performed at [redacted] ***s residence was professional and of the highest qualityShe contends that the cement slab must be replaced more than one year after its installation, due to “dangerous crackingHis contention is utterly baseless and without merit, especially considering [redacted] and her family have been using the garage to park their three vehicles for that entire period of timeMrHerring agrees that there was some limited chalking/dusting of the concrete slab after it was pouredIn this region, in Summertime, concrete dusting/chalking is a common problem easily remedied by sealing of the concrete using a product called [redacted] [redacted] is the manufacturers suggested remedy to seal concrete in the event of chalking and dustingAfter [redacted] originally complained to MrHerring in 2014, by and through [redacted] ***'s father, MrHerring returned to the property, observed the condition of the concrete, and in October, 2014, offered to seal the concrete using [redacted] at no charge to [redacted] ***MrHerring also offered to guarantee and warranty the [redacted] sealant work for an additional two (2) yearsTo which [redacted] ***, by and through her father, refusedWe have enclosed MrHerrings letter to [redacted] advising of this proposed solutionThis instant complaint by [redacted] is frivolous and MrHerring and his company have no further obligation to [redacted] ***This is not a situation where a contractor negligently performed work and disappeared to avoid his obligationsMrHerring and his concrete contractor, [redacted] have listened to [redacted] ***s complaints, returned to her property and taken actions to try to alleviate [redacted] ***'s concerns all to try to make [redacted] happy and to preserve his good nameAs such, we would ask that you dismiss [redacted] ***s complaintsThank you for your attention and consideration of the foregoing and should you wish to discuss this matter, please contact the undersignedSincerely,

10/30/14Dear *** ***,This letter is in response to our recent observations of a surface dusting concern you have with your garage floor.After our site meeting on 10/13/with myself Peter H*** (HP Herring & Associates) and *** *** (*** *** *** ***) we did some
extensive research in regards to your problemWe consulted with the experts at *** *** *** (###-###-####) and they provided us with the following solution.*** *** *** informed us that dusting/chalking is simply a surface condition and does not cause permanent damage to the concrete floorConcrete dusting is caused by an "osmotic effect” of unhydrated concrete and can simply be repaired by coating your floor with *** is a penetrating surface hardener/conditioner (see attached product specification sheet) that chemically Cures, seals, hardens and dustproofs interior or exterior concrete surfaces*** *** *** has used this product on many occasions with great successThey also highly recommend *** on all concrete surfaces regardless of dusting conditionsThe above information is based on the concrete provider/manufactures recommendations therefore, propose the following solution to resolve the problem.HP Herring & Associates along with *** *** (*** *** *** ***) will purchase and Coat your floor with *** surface hardener at no costThe applied coating will be in Compliance with the manufactures specification(Attached) Once the sealer is allowed to cure (Cure time based on manufactures recommendations) we will warrant the floor for an additional two yearsWe are confident that this is a suitable solution and is in compliance with the contractual obligations of HP Herring & AssociatesPlease provide me available dates that you can have the floor cleared and we will schedule the floor coatingIf you have any questions, please don't hesitate to call.H Peter H.Owner
