Review: My 2001 Toyota 4runner (father is registered owner) was towed from [redacted] by H&R Towing on 12/18/2015. The tow company and the private property owner violated CVC 22658 and 22953.

For one, the tow authorization does not state the time that my vehicle was first spotted, which shows violation of CVC 22658 because the tow company did not make a good faith inquiry regarding the duration that my vehicle was parked. CVC 22953 states that a vehicle cannot be towed before one-hour unless it is parking a fire hydrant/lane, handicap parking stall, or ingress/egress to a business. I stated multiple times that I was not there for more than 30-40 minutes and have text messages as proof. The tow company continues to take the side of the private property manager who had my vehicle towed. They claim that there is video evidence of my vehicle being parked for over an hour, but cannot provide proof of the said claim.

According to my timeline and what the tow driver is stating (it took him 20 minutes to get there), the property owner called for my vehicle to be towed after approximately 10 minutes or less.

During my initial phone contact with the tow driver, [redacted], after the tow occurred, he stated that he was able to tow my vehicle immediately, no questions asked. The proceeding phone calls, [redacted] stated that my vehicle was parked there for half an hour, as I claimed, therefore he could tow it. Finally, during a subsequent phone call, he stated that I was parked there for more than an hour.

They have tried to make up various claims of how the CVCs listed above are invalid and that it is a waste of my time pursuing the matter. Finally after giving a deadline of 12/23/15, the tow company, H&R Towing, has sent me a receipt showing refund to my credit card ending in 8221 on 12/23/2015, but I have not seen any pending credits to my account. In addition, a statement is attached where they are stating that it is noted that my vehicle was parked for more than an hour.Desired Settlement: The tow company, H&R Towing, has sent me a receipt showing refund to my credit card ending in 8221 on 12/23/2015, but I have not seen any pending credits to my account. Resolution: provide proof of me being there for an hour. Otherwise, retract their statement of me being there for an hour or I will pursue the violations of the CVC by both parties
