Complaint: [redacted] I am rejecting this response because: Huddleston CPAs should have known in that an Iowa State Tax Return was required I am attaching evidence to verify this The evidence includes: a A statement from the firm in Iowa that arranged my work in Iowa with [redacted] b In the same file, a spreadsheet that was sent in that clearly indicates that I spent days in Iowa c My federal tax return for d The Iowa tax return for that was completed recently e The detail from Iowa regarding interest and penalties Interest and penalties were accrued due to the negligence of Huddleston Tax CPAs in preparing my return during and my having to file this year and pay penalties As to the communication in August 2014, Huddleston should have done the following: a Agreed that they made a mistake in not identifying the need for an Iowa Tax Return for b Prepared the tax return for no charge c Agreed to reimburse any penalties and interest associated with the return due to their oversight Instead, I was told that the tax amount was 'probably not enforceable' as Iowa would simply deny me license plates (which is irrelevant since I do not live there) Given that they did not agree to amend their original services and take care of this, I was hesitant to proceed In January 2015, I had wages garnished and it was only then that Huddleston did the return once I was backed into a corner and had no choice but to use them (since I needed a quick resolution and did not have time to take this to another accountant - plus expecting they would do this for no charge.) I have paid Huddleston for the Iowa return, which I should not have agreed to I have also paid Iowa all the fees plus back taxes I did not need Huddleston to call Iowa to discuss the fees - they should have done that AFTER agreeing to handle any penalties and interest that were due In all, there is clear evidence that Huddleston Tax CPAs was negligent in their duties to identify that I was required to file an Iowa State Tax Return in They were provided clear evidence that this was necessary and I am paying a CPA to do this because I believe they have the professional knowledge that I do not have about tax requirements in various jurisdictions I have also filed a grievance with the Board of Accountancy for the state of Washington and have provided the same documents to them Sincerely, [redacted] ***SUPPORTING DOCUMENTS REDACTED BY Revdex.com***

See attached Washington State ethics rule for CPAs on confidential client information. Our contract with our client clearly stated that...

we were only preparing his 2010 federal income tax return. Our client did not inquire as to whether an Iowa state return was required and we were unaware of the extent of his activities in Iowa. In August 2014, after . . . (redacted) ... , our client told us the full extent of his contacts with Iowa and inquired whether a return was required. We investigated Iowa law and told him that a return was required. We asked him if he wanted us to prepare the Iowa state return. He did not engage us to prepare the return at that time. Several months later, after ... (redacted) ... , he did engage us to prepare the return which we did. Unfortunately, it will be more difficult now to get the Iowa taxing authority to abate the penalties and interest because our client failed to act when he was first advised of the filing requirement. Still, we had offered to draft a letter to the Iowa taxing authority asking them to abate his penalties and interest, at no charge to him. He declined.

1.  Huddleston CPAs should have known in 2011 that an Iowa State Tax Return was required.  I am attaching evidence to verify this.  The evidence includes:
a.  A 1099 statement from the firm in Iowa that arranged my work in Iowa with [redacted]
b.  In the same file, a spreadsheet that was sent in 2011 that clearly indicates that I spent 197 days in Iowa
c.  My federal tax return for 2010
d.  The Iowa tax return for 2010 that was completed recently
e.  The detail from Iowa regarding interest and penalties
Interest and penalties were accrued due to the negligence of Huddleston Tax CPAs in preparing my 2010 return during 2011 and my having to file this year and pay penalties.
2. As to the communication in August 2014, Huddleston should have done the following:
a.  Agreed that they made a mistake in not identifying the need for an Iowa Tax Return for 2010
b.  Prepared the tax return for no charge
c.  Agreed to reimburse any penalties and interest associated with the return due to their oversight.
Instead, I was told that the tax amount was 'probably not enforceable' as Iowa would simply deny me license plates (which is irrelevant since I do not live there).  Given that they did not agree to amend their original services and take care of this, I was hesitant to proceed.  In January 2015, I had wages garnished and it was only then that Huddleston did the return once I was backed into a corner and had no choice but to use them (since I needed a quick resolution and did not have time to take this to another accountant - plus expecting they would do this for no charge.)
I have paid Huddleston for the Iowa return, which I should not have agreed to.  I have also paid Iowa all the fees plus back taxes.  I did not need Huddleston to call Iowa to discuss the fees - they should have done that AFTER agreeing to handle any penalties and interest that were due.
In all, there is clear evidence that Huddleston Tax CPAs was negligent in their duties to identify that I was required to file an Iowa State Tax Return in 2010.  They were provided clear evidence that this was necessary and I am paying a CPA to do this because I believe they have the professional knowledge that I do not have about tax requirements in various jurisdictions.
I have also filed a grievance with the Board of Accountancy for the state of Washington and have provided the same documents to them.
