On March 12, 2018, via text messaging to the owner/operator of the tattoo company, I had inquired if it was still possible to use the remainder of a gift certificate for a tattoo. He had replied that I could and I assumed he had booked me in for the soonest opening, which was June 8. In the ensuing text conversation, he asked what I wanted to get done and proceeded to insult my idea. When I stated that he could refund the balance if he didn't want to do it. He said he would check with his accountant to see if that would be possible. ***. A month passed, I texted him again to see if he had spoken with his accountant. His reply was 'Yes.... I can etransfer if you give me your email address', which I did. The next day, I still hadn't received anything and when I let him know I hadn't, he said he was too busy. Another week goes by, and still nothing. When I texted him again to inquire, he had another excuse *** - and reneged on the refund, said I could book a date as 'I do not give refunds'.

Desired Outcome

Refund I would like the balance of the gift certificate ($100) refunded as he originally stated he would.

I do not disagree with the statement made by the complaintant, ***. January 8 of this year my commercial building was destroyed by fire and my personal losses were upwards of $480000. I also lost the ability to earn income for a brief period and was forced to borrow money to stay afloat. By March 2018 my personal health issues were compounded by enormous levels of stress that forced a change in my business model. It was a very difficult period of time when the customer made contact. My job is creative, people often seek out the creative and honest approach I take to my career. I forge relationships with customers, friendships... this is the type of relationship I thought I had with the customer. I gave her my honest opinion off her tattoo idea and hoped that it would start a conversation as to how we could improve on it... this is often how it goes in this business. The customer then proceeded to joke with me by calling me a chicken. I believed this to be confirmation of the light hearted nature of our relationship and the situation. When I reiterated the issue that I would have with the design as presented she began to ask for a refund. My policy on gift certificates and deposits has always been that I do not refund, and considering the gift certificate was from 2015 or 2016 I needed to ask my bookkeeper about the situation. I would like to make clear that my position on this was that her tattoo idea was so bad that I would rather give her the money back than take on the tattoo. After the way she began to react, my consideration was to refund simply to not have to deal with the customer any further as her tone went instantly from playful joking to disgruntled and offended. ***. As I stated I had intended to make exception to my policy and refund the remaining balance of the 3 year old gift certificate but as reality set in I was simply unable to afford to make such an exception. The next correspondence I had with the customer I explained the situation *** In fact, when I told her that I was going to have to stick to my initial no refund policy I gave her the soonest possible available date to use the certificate and have the tattoo any way she wanted it, her response was that she wanted the tattoo done before her chemotherapy. I was unable to accommodate her timeline and she began to demand the refund....I reiterated my refund policy...at which point she continued to harass me for a refund and every time I responded with the next available date I would be able to have her come and redeem her certificate... finally I asked her to stop contacting me, she continued for weeks, ***. My resolution to this situation will be to honor the remainder of the certificate. The certificate is transferrable and I made the customer aware of that, I have had customers gift their certificates to loved ones or sell them for a cash value on a garage sale sites, I also made the customer aware of that as well... I gave her a few options but none of them were what she wanted ***.

There was never an "initial no refund policy". The gift certificate states nothing of the sort, and no mention was made of such policy until I suggested that I'd accept payments, at which time (Apr. 25, 2018, 6 1/2 weeks after initial contact and 2 weeks after stating he would refund) he stated "as I do not give refunds. ***. I reiterated my email address for him to send the etransfer in a text message one week after he asked me to stop texting. No emails were ever sent.
