Review: A Jeep Grand Cherokee was identified on Luther Hudson's website, negotiations were conducted via internet and phone communications, a purchase price was agreed upon by both parties. An engine block and trailer hitch were requested to be installed on the vehicle. A $1,000 deposit was provided to the dealership to secure the parts; at no time were we told the deposit was non-refundable. Upon arrival at the dealership, the condition of the vehicle was not as described online or by sales personnel. The undercarriage wiring harness had been cut, permanent stains were observed on the backseat, the push button start was missing and the parking assist system was malfunctioning.

The agreement was to return to the dealership the following day and all the above items would be repaired. The next day the dealership called and explained there were more issues with the backup camera and safety system which needed parts not currently available.

At this point we decided not to take possession of the Jeep and that is when the sales manager became hostile and stated the $1,000 deposit was nonrefundable. We have requested the deposit be returned and Luther has not accepted.

We explained to the dealership and played multiple messages from the dealership stating a deposit was required but not was it ever referenced to be nonrefundable. We would not make such a large purchase sight on seen.

Fast forward to the current date we are out $1,000. The dealership increased the price of the Jeep and sold it to another party with the parts included.Desired Settlement: The $1000 deposit refund has been refused by the dealership. The vehicle has since been sold to another party. We request a full refund of the $1,000 deposit.

Response:

Mr [redacted] was informed multiple times that the $1,000.00 was a

nonrefunable. This was the price to put on : trailer hitch, tow hooks, engine block

heater, wire harness. These are items Mr. [redacted] wanted added to the vehicle

as part of his purchase.

Never once did Mr. [redacted] express any concerns about a seat being dirty or

push button start. In fact we offered to deliver the vehicle to them free of charge.

Mr [redacted] has twice tried to have American Express reverse the charges but

to no avail. Both times American Express has sided with Hudson Chrysler. In fact

American Express after looking at the signed contract has said we were entitled

to even more money than the $1,000.00. The price of the vehicle $35096.45 X

.05= $1754.82

We feel the sale of this vehicle since has no relevance to this dispute. If it is

helpful to you, we sold this vehicle to another dealership in our dealer group for

$33286.00.
