I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.The lease in which they are referring to, is a lease that was started in September of when we moved inThe lease states that after the year term of the lease, any renewal of lease would be at the month to month basisWe lived in that for years months(WE DID NOT BREAK A LEASE!).
They claim that we signed a "new" lease in our 3rd year hence violating our year lease termthis is a violation of THDA and many other lawsOnce we are in that tax credited apartment the lease cannot become NEW again, they can add an addendum to current lease but that is not the case nor is it within the guidelines set to protect residencesThey hope that low income people will be too ignorant, too incapable and otherwise unable to fight them in these malpracticesThe "damages" they refer to are, crumbs in Stove Bowls and ONLY the living room carpet that I didn't have Steam cleaned because I was told by leasing Regional Manager ***, no to do so, as they must have a professional company come in to do it anywayI have been back and verified that the carpets were cleaned and DID NOT have to be replacedSo there are NO additional charges they can charge me forAll else falls under wear and tear set by standard guidelines(see below)
I still HAVE NOT received ANY letter from this companyThey do have my new address on the sign out form I signed when they completed the final inspection(THEY CLAIM THEY CAN"T FIND IT NOW) The form, not the address???)
THDA IS currently investigating the Huff Management Coas they receive funding through tax credits and have violated several rules and regulations set by state and federal guidelinesThese are set to protect low income residences.

Curtains faded by the sun
Cigarette burns in curtains or carpets
Water-stained linoleum by shower
Broken tiles in bathroom
Minor marks on or nicks in wall
Large marks on or holes in wall
Dents in the wall where a door handle bumped it
Door off its hinges
Moderate dirt or spotting on carpet
Rips in carpet or urine stains from pets
A few small tack or nail holes in wall
Lots of picture holes or gouges in walls that require patching as well as repainting
A rug worn thin by use
Stains in rug caused by a leaking fish tank
Worn gaskets on refrigerator doors
Broken refrigerator shelf
Faded paint on bedroom wall
Water damage on wall from hanging plants
Dark patches of ingrained soil on hardwood floors that have lost their finish and have been worn down to bare wood
Water stains on wood floors and windowsills caused by windows being left open during rainstorms
Warped cabinet doors that won't close
Sticky cabinets and interiors
Stains on old porcelain fixtures that have lost their protective coating
Grime-coated bathtub and toilet
Moderately dirty mini-blinds
Missing mini-blinds
Bathroom mirror beginning to "de-silver" (black spots)
Mirrors caked with lipstick and makeup
Clothes dryer that delivers cold air because the thermostat has given out
Dryer that won't turn at all because it's been over-loaded
Toilet flushes inadequately because mineral deposits have clogged the jets
Toilet won't flush properly because it's stopped up with a diaper

We have investigated the complaint received for
Case#***Our response to the resident’s concerns is listed below

1.) We
strive to keep all of our apartments in working order and satisfactory for our
residents. This particular resident reported several issues including
moisture with her apartment. For each item she has reported we have
responded in a prompt fashion in order to investigate and repair the
matter.
2.) Repeated
visits to the tenant’s unit was necessary in order to investigate the cause of
the issue she was experiencingThe resident has not been and will not be
charged for any damage to her unit that she did not causeAll holes in the
wall have been repaired and were necessary to ensure all maintenance items were
resolved. We temporarily relocated the
resident and her family to a hotel of her choosing to run tests and to work on
repairs in order to minimize disruption to their daily lives. The tenant was also rebated one month’s rent
to help cover any meals and inconvenience.
3.) The
tenant has received lease violationsOne was for not keeping her electricity
on with the power company as required in her lease and the other was for not
following the procedures set out in the lease addendum(s) that she signed at
move-in
4.) The
resident does live in a handicap unitShe was shown the apartment prior to
signing a lease and accepted this apartment as is with the handicap
features. She was offered another non-handicap apartment that was
available at the time of mobut chose this apartment due to its location
We have made every effort to continually address the
tenant’s concerns including hiring third party contractors to make repairs and
have replaced her flooringDue to the residents continued unhappiness, we have
offered to release her from the lease contract. At this time, the tenant
has chosen to remain at the complex.
We will continue to address any maintenance issue as needed
in a prompt and effective fashion. At this time there are no outstanding
work orders and no current maintenance issues with the tenant’s unitPlease

Ms. [redacted] signed a lease that required her to complete
the full term of her lease agreement to be eligible for a refund of her
security deposit. She did not fulfill her lease term...

thereby forfeiting her
deposit. Additionally Ms. [redacted] owes additional funds due to unpaid rent and
damages. A letter has been sent within the time frame required to the forwarding
address she provided explaining these charges. Additionally, information
regarding this situation has also been provided to THDA and was acceptable to
the agency. Please let me know if you have questions or need any additional
information.

Acadiana Plaza participates in the USDA Rural Development program for affordable housing. Tenants are required to be income eligible. Further, the amount of rent paid by the tenant is dependent on income. The tenant had a significant change of income prior to annual income recertification resulting...

in a large rent increase. Tenant did not fulfill lease terms resulting in loss of security deposit. Unit damages were correct based on comparison of move-in inspections and move-out inspection. Multiple staff members discussed the issue with tenant and did so in a professional manner.
