We Entered into a buy back contract with Hunters Development that needs to be Upheld. Hunters needs to abide buy what they agreed to. March 2013 we bought a home from Hunters Development Corporation. One of the reasons we purchased this home was due to the Buy Back Program Hunters had in place. The terms were that if you purchased your home using their preferred lender ([redacted] Mortgage) you would have a contract where if within 3 years you chose to Hunters Development would Assume your mortgage. This is a huge bonus for us as we are military and can be sent anywhere at any time. Fast forward to April of 2015 I emailed [redacted] to inquire about the program and figure out how we need to start the process where I was first told we didn't qualify for it and that they would not be able to buy it back. Confused I inquired more and she was mistaken. She then informed me that the banks have changed and no longer allow corporations to assume VA loans. Instead they have since started finding individuals to assume the loans. We were told to start the process we would need a house inspection and a copy of our mortgage statement. We sent this June 25th and the inspection was on July 7th and everything would be reviewed by Mr. [redacted]. After checking in multiple times with updates It took until the end of September to get in contact with Mr. [redacted]. In the emails he went over how exactly the assumption process was going to work. He asked that we put the house on the market for 90 days and if it did not sell as a loan assumption he would start the process to buy it. We would be responsible for 3000.00 in closing costs and Hunters would cover anything over that. I asked for clarification multiple times to be sure everything was correct and I was understanding everything correctly. He assured me that this is how all his buy backs work and to get started we would need to sign the new contract stating that we would be responsible for the 3000.00 portion. This was sent to us end October. We consulted as we were unsure about these new terms and how everything was going to work as it was not what we originally agreed to upon buying the home. He got us in contact with his realtor who we met with and went over our options. We signed the contract end December and our home went on the market in February. The first day the realtor had an investor she was working with who was assuming another property at the same time who decided to put an offer in on our home and we accepter. After over 80 days into the process he did not get approved for the loan. Since it was so close to the 90 days on the market previously discussed I contacted [redacted] and Mr. [redacted] to figure out the next step and how to start to process with Hunters. It took over a week to get into contact with him after many calls, texts and emails. He basically informed me he had no intention of buying the home and instead offered to help us get it rented and keep it on the market and MAYBE in a year he could re-visit purchasing. We contacted our Attorney who advised us to find a mutual agreement on how we could proceed before taking civil action against Hunters. In doing so we thought a fair compromise would be for hunters to purchase to property instead of assume it. Banks may not allow an assumption but he can get a loan from any company he wishes and purchase the home for what we owe. The only difference between buying and assuming is that he would not be getting the interest rate that we currently have. This seems very reasonable and fair given the situation. He did not agree to this. I have been trying to talk with him and he takes quite a few days to respond. We have told him we will be taking civil action if this isn't resolved and that it is now a time sensitive situation (considering we have been dealing with this for over a year). We would just like this made right by Hunters Development. There needs to be a remedy to this situation immediately and hunters needs to be held accountable for the situation. Desired SettlementHunters needs to follow through on what our contract/agreements state. If He is not going to follow through on our contract and agreement that 90 days on the market then starting the process themselves as discussed. As stated in my complaint we would like Hunters to purchase to property instead of assume it. Consumer Response We have still not reached an agreement with Hunters Development. We have new information from our mortgage company that is very concerning. There is obvious deceptive practices coming from this company and they need to be held accoutable. We have been told story after story just to be dragged along further. We have tried numerous times to work this out on our own with Hunters development aND the owner and it does not seem they take aNY of this seriously in hopen we will drop it. We are in talks with an attourney and will be handling it with them.

Not only does HDC ignore your request for repairs, they also do not want to fix their own mistakes and are willing to wait until your warranty is overWe have purchased our home September 2013 in [redacted], NC. We instantly fell in love with our home. When the builder came out for the final inspection he advised us there were a few things that needed to be fixed, granted he made that promise and it was done. Now while we are STILL in our warranty, we had MAJOR issues. We have wetlands behind our home, which extends out to our property line. Behind our fence, is a drainage ditch which was completely clogged and caused flooding not only in my backyard but in others as well. The flooding was half way up my yard and it took WEEKS for them to come out to a conclusion and decided to just drain the water into the pond that is behind the wetlands. Now my grass is completely dead and I have noticed my fence is deteriorating from the water that was just sitting at a stand still spot for ALMOST 3 weeks. When I called [redacted], [redacted] assistant, I sent her pictures. A week later she called and practically said she wasn't sure what was going to happen. What upsets me the most is the fact that my NEIGHBORS whom aren't effected in anyway and not in the front of the subdivision like I am, knew what was going to happen before I found out myself. The communication between them and clients are DISGUSTING, let alone the companies they hire to fix your home as well. My other issues is my nail pops in my home, as I have addressed that to [redacted] as well and they still haven't come out to fix it - My master bathroom door has a huge CUT on the top of the door way. It's not noticeable, until you stand on the tub or on a latter and see that whomever has cut the door for it to "properly" fit completely mis-measured and didn't have the decency to fix it in the meantime. I just had my floorings replaced YET again in my foyer because of the siding nail (outside) punctured into the pipe to the spigot that caused my floors to completely deteriorate, smell and de-laminate. Again, HDC who hires horrible contractors do NOT know what they are doing with their jobs. My flooring is replaced, but my TRIM in my foyer is completely chipped and ruined. This business again has poor communication and they do not want to help you out with anything, no matter how many times you call or email them, let alone they are rude!! I understand that everyone wants to make their profit, but WE are still under our warranty in our home and in my perspective I feel as they want to wait until my warranty is over with to tell me "i should've done this or that" when I have ALL documentation and phone call logged contacting them. This is getting to the point where this is becoming a hassle and If I have to throw out a lawsuit because they feel as if they have done nothing wrong then so be it - But I am a pretty respectful civil person and I would rather it not go that far. All I am asking is for them to come out and replace my grass and my fence due to POOR planning with the drainage ditches which caused my yard to flood, for them to fix my nail pops that I have complained about, my door and now my trim. im not sure how hard they think it is to communicate and to get this done. I am a reasonable person and with my husband deployed he wouldn't be as nice as I am with this. I would like a solution for all of those repairs SOLVED BEFORE September. Business Response I.We have been in business 40 years, and built thousands of houses. All callbacks and work requests to our knowledge have been addressed.2. Homeowner's property backs up to wetlands areas, which they were aware of at purchase. The buyer's yard flooded because retention pond outlets (required) were clogged by an act of God...weather.3. The fence is treated material and will not be replaced. It is not necessary.4. A copy of all work requested and addressed is available for viewing by your office. To our knowledge, all legitimate requests have been repaired.

Water drainage pipe install not correct, sink hole formed. water drainage pipe separated causing sink hole. In July 2011 the sink hole that is located right beyond my property line started coming underMy privacy fence. After having the water company come out and department of transportation and several phone calls ( without response) to Hunters development corporation, the [redacted] called them and ordered them to fix. They showed up three days later and dumped 300 lbs of concrete in the hole to fix. In 2014 Dec, the sink hole returned. My youngest son has fallen intoThe hole and is now again coming under my privacy fence. The Hunters development corporation refuses to return my calls leaving me with no choice but to take them to court. The [redacted] states it is their responsibility to fix.Desired SettlementI want the water pipe dug upThis timeAnd fixed the correct way! Not the cheap, save money, way. It is very unsafe!Business Response Hunter Development looked in to this problem at [redacted] Place, [redacted] NC XXXXX. While we hate to see anyone dealing with sink holes and drain issues, this is no longer an area in which we are responsible to maintain. Hunter Development talked with [redacted] officials on 7/29/16 and they also confirmed that the area in question is not our responsibility. Consumer Response I was out at the sink hole today with the [redacted] Mr.[redacted] (XXX)XXX-XXXX and he stated the [redacted] is NOT responsible for the fix due to the sink hole being off the [redacted] right away. He stated the builder was responsible. I am curious as to who the builder talked to as they stated in their response? I want this fixed before my children are hurt or it effects my property.

We have signed contract that within 3 years, Hunter Development would buyback our house if we wanted. They refuse to do so now.In December of 2012, My husband [redacted] and I,[redacted], purchased a townhome. They told us about their buy back program, in which 3 years you could give back the house to the builders. We signed a contract on that. *See attached*In June 2014, I started emailing the company, Hunter Development, on how to start this process. I spoke to [redacted] over the phone, in which he told me he is not interested in buying back my home because I have pets. I stated that this was not in the contract, and he told me that he did not expect to have a lot of people wanting to sell back their house to them, and that he is not interested. After arguing with him about how is breaching his contract, he sent someone to my house to inspect. In July 2014, someone came to house and was in and out within 3 minutes. I was told I would hear from [redacted] on the results that day. I asked this inspector for a copy of what he found, and he said there was nothing to have paper work for. After a month, I heard from [redacted] by mail. I got a letter, *see attached* stating that there was floor damage that will cost $4,000. This was a big shock to me because my floors have no damage anywhere. I called that day, August 12, 2014 and everyday till August 20, 2014, and asked to speak to [redacted] about this. He was never there. Nor would he return any of my calls. I also asked for a copy of the inspection report, and they refused to give it to me. No where in the contract does it say you cannot have pets. He is using my dogs, a medium sized lab, and a small pug, to not buy back our house. There is no reason for this, and he needs to abide by his contract. I do not believe that the "inspector" that came to my house was truly an inspector. I have had an inspector come to my old properties and they spent at least an hour checking out everything. This gentleman spent 3 minutes or less. I live in a two story house, 3 bedrooms, 3 bath.Desired SettlementThey need to abide by their contract, and buyback our house. By them not, they are breaching their contract. Business Response The Federal government changed guidelines which do not allow corportions to assume financial responsibility of a VA loan. With that bneing said, if they want [redacted] tobuy back the house, it mut be in good condition . Even with the buyback provision, there has to be a new contract and things must be agreed on..... Funding fee must be paid by the buyer and she has two large dogs, so I want the carpet replaced. Those are my conditions. Or I can get personally involved to get the house rnted, and based on the low interest rate, it will be a break even or better. Those are the options available. Just as Hunter Development Corp paid closing costs and many other things when they bought the house, I - in turn- expect some of the same things when they sell.Consumer Response Builder has YET to abide by his contract. He is a scammer and has been lying to us for over a year saying every month we are going to close, and then we do not because of some new excuse. He is trying to by time and takes advantage of his customer. I have over 100 emails of him saying he is buying it back or we are just waiting on paperwork to close, yet nothing has happened. He has tried to bribe us by asking to take $10,000 for him to get out of the contract. We of course said no, yet nothing has been done.

When we purchased the home we addressed issues that needed to be corrected. The issues have not been taken care of, and we are still within 365 days.We addressed multiple issues upon purchase to be corrected. Some of the issues have been fixed others have not. More issues continue to occur due to poor quality in the building of this home. These issues that are happening have nothing to do with wear and tear, thus are unpreventable as the homeowner. Essentially, we are formally notifying Revdex.com of this complaint that HDG has yet to fix the on-going issues with the home after making contact with the company time and time again, and for the course of 11 months. We are going to seek legal action in regards to the home and our concerns that have been disregarded since purchase. We have all corresponding e-mails between them and each issue that was formally addressed and not fixed.Desired SettlementWe will let the attorney who will represent us and the issues decide what the best resolution is. We have tried multiple times to get the issues resolved with HDG, however these attempts have failed over and over. Business Response Homeowner was contacted and we believe all adjustments/corrections have been completed to the satisfaction of all concerned.

We have signed a contract with hunter's development that if within 3 years we no longer want the house that they would buy it back. Now they refuse.We have purchased a home from Hunter Development Corp. with a contract that states that within 3 years of purchase if we do not want it any longer then they will buy it back. The listing price was at $117,900, we purchased it on March 27, 2013. We purchased it with a VA loan because I am currently serving in the Marine Corps. The main reason we purchased the home was because of the buy back. We've contacted the company frequently about the buyback but they would avoid us. When we finally got information from them about the buy back they were extremely rude and unprofessional in their replies. We have contacted them all throughout August and September now and it is currently ongoing. The townhouse buyback program terms where as follows: three years from date of the original closing, buyer must be entered into contract with seller. Unit does NOT have to be closed, only under contract. House must be in good condition as approved by a third party house inspection and the items are not binding on either party, they can be negotiated. Seller will assume loan of buyer at loan balance. Seller will then assume financial responsibility of loan thereby relieving buyer if any responsibility. Va Entitlement used on Townhouse will not be available to Veteran until the home is sold or refinanced. Mortgage must originate from the preferred lender; [redacted]. This Addendum must accompany original contract when purchasing the townhouse. Desired SettlementThey need to abide by their contract, and buy back the townhouse. By them not, they are breaching the contract. We would like to get answers from them and not be pushed aside. I expect to be treated with respect, and be answered to in a timely fashion.Business Response We are sending a letter to buyer today. The buy back policy is for property in good condition.The work required to get this house in good condition will be prohibitive for buyer or Hunter Dev. We will be glad to direct buyer in renting out the property until it can be sold, and put her in touch with a property management company.Consumer Response There was never a third party who came to look at the home. [redacted] had one of his workers[redacted] come to our home for no longer then five minutes to check the home for damages. He then sent me an email that he'd come himself to check the home. A few weeks later after that statement he sent[redacted] to the home unannounced to check the home again. Being that he just came to our home without an notification or warning I did not allow him inside. I don't understand how someone who was in my home for no longer then five minutes can come to that conclusion that the home is in poor condition. I also asked [redacted] for the list of things need to be done and he simply said I would not be able to afford it. On that note, I don't understand how he knows what we can afford and what we cant. It says in the requirements for the buy back that a third party needs to look at the home and if the items are not binding on either party, they can be negotiated. Final Business Response Hunter Development has stated its position and sees no benefit to either party in repeating it. A copy of the correspondence to the consumer has been forwarded to our attorney.

Ignores repeated requests for repairs through the warranty. Calls go unanswered, emails go without response for two months. My husband and I purchased our home in February 2015. Since then, I have been in contact with this company several times about warranty issues. When purchasing, we were guaranteed a turnaround time of a couple days on work order request. Our fastest turnaround time, however, has been two weeks. I submitted or last request two months ago and the lady who is supposed to handle them apparently "forgot" to do her job and process it. I called again a week and a half ago, and she said she would handle it that day. I still have received no correspondence from any contractors or vendors, or from Hunter development Corporation directly. I am so frustrated with this company, I wish we had purchased a house from a company with a bit more integrity. They have managed to sour our first home-buying experience and should be ashamed of how their employees handle the business. Desired Settlement I would like all of the problems that I have mentioned to the company to be resolved. They all fall under the warranty coverage, and they need to hold up their end of the deal. I am convinced that they keep shoving my complaints aside so our warranty can expire and they can continue to do nothing for their consumers. Business Response We try really hard to satisfy all our homeowners. We have been called to her home many times for complaints that were actually home maintenance, not warranty. For instance, burned out light bulb in the master bath room, picked up debris from her yard multiple times,was very angy when we declined to repair damage to her walls done by her movers,etc. Three months after taking possession, she discovered that an opening was cut slightly too large for the shower head....that is the only thing we have right now in our system. And that is the service order that was misplaced in our office. She called our Service Rep today and they have made arrangements for that problem to be resolved Monday. Our warranty service allows the contractors 15 days to handle any service that is not emergency, and the drywall contractor has had this call only 7 days. Our service rep has not made excuses for this oversight, and has apologized to her several times.Consumer Response I was never upset that damage done by the movers wouldn't be covered by the warranty. That's an absolute joke. As soon as I found out that it wasn't, I got the contact info for the person who you'd suggest and he handled the job through me. I've had to call the vendors myself for a lot of what was handled. As for the debris in my yard, is it standard for your company and subcontractors to leave 50+ cigarette butts, scraps of metal, nails and siding at job sites, or were you just sloppy at my house? Also, no arrangements have been made by your service rep. Someone was supposed to call me yesterday, but, of course, that never happened. If I had realized upon initial the initial walkthrough how cheaply made these houses were, we never would have wasted our time and money on it.
