We have received your letter of April 5, in regard to the above matterAfter a review of our
records we would offer the following comments:
The letter from Revdex.com of April 5, is
addressed to Huth Westwood Builders of Copley, Oh
Huth Westwood Builders neither owns nor operates a self-storage rental business, and is not a
party to a rental agreement for self-storage units
Usually, when someone makes a claim for damages which they believe were caused by another
party, they would present to that other party an itemized list with an estimated value equaling
the total amount of restitution desiredApart from a general verbal comment about the
condition of belongings, no formal request with documentation was ever providedTo then ask
a 3rd party to step in and intercede without first making a direct request is neither common
practice in seeking redress nor is it courteousFurther, the items mentioned in the Revdex.com Letter of
April 5, do not add up to the total resolution value
Self-Storage rental units, located at SCleveland-Massillon Road in Copley, Oh., are not
advertised as either temperature or humidity controlled, nor is this stated in our rental
agreement The fact that we did not state that the units are not sealed against moisture would
not constitute the basis of a claimSelf-Storage units in the immediate area with temperature
and humidity control rent at considerably higher costs
In claimant's rental agreement, "Household Goods" is the only category of items listedNo
special requirements for storage were noted by claimant at the time of original rental
Claimant's rental agreement states that, "Tenant, at Tenant's expense, shall maintain a policy
of...insurance for actual cash value of stored property..." Claimant's rental agreement also states that, "...Tenant acknowledges that it has the right to obtain insurance..."
Claimant's rental agreement includes landlord indemnification and release of liability
Claimant entered into a rental agreement on November 19, In that this was in the month
of November, ambient weather conditions and any implications for either temperature or
humidity control should have been observed by claimant
Claimant's signature to rental agreement document was on November 19, 2012, indicating
agreement to all terms and conditions
We do not, routinely, inspect customer's belongings on-site prior to storage and, therefore,
have no way of knowing if the condition described subsequent to removal actually existed prior
to storage
It was only after the storage rental unit was cleared out by family members of claimant and
after the contents were no longer on the premises, that the verbal complaint about the
condition of household goods was receivedAfter a customer's household goods have been
removed and are no longer on the premises, there is no way of knowing what may have
happened to affect the condition of these goods
Reports of statements attributed to "maintenance man" are hearsay as complainant was not
present at the time of removal of possessions and no reliance can be given to hearsay
This complaint, with claim for damages, is without merit
