Benita ***Trade Practice ConsultantAs I stated in my first letter to you I told you what had happened during that snow stormThe weather amounts are reported as to what falls at the AirPort on the far Southeast side of MilwaukeeAny one with common sense would know just because thats the amount that fell at the air port doesn't mean thats what fell in WauwatosaI have seen in my business experience that snow falls can differ from one mile away to one anotherThe reporting station also reports the snow based on a hour day periodFrom 12:AM - 12:PMAs I stated I know for a fact and have witness's that will tell you if needed that it had rained all though the earlier evening and was reported by the TV stations that the storm was SUPPOSE TO BE A MOSTLY ALL RAIN EVENTBut by 9:00AM on the 28th of December it started to change to a snow event at that timeIt continued to snow from that point onDuring the entire event it changed back and forth from freezing rain and sleet to snowThe entire city had snow including WauwatosaThe report snow fall event according to the Airport was on the 28th and on the 29th and on the 30th for a total of inches for the stormMrs** *** also doesn't report on that day the wind was reported at miles per hour and gusts up to miles per hour on the 28th of DecemberOn the 29th of December mph and gusts to mph and on the 30th it was mph and gusts to mphBut she doesn't report that to youThe invoice if she mailed you a copy states that it was charged to her $for snow blowing all areas and a $charge for SaltingThis was for the bag of salt and the labor and the cost of going and picking it up and bring it to the job siteI run a business for a profit just like her and her husband when they go to work and get paid, They don't work for nothing and either do IWhen a company comes out to remove snow from a person's property they don't charge for the removal of snow whats stated by the airport they charge for the work that needs to be done and the snow thats on the ground and actually has to be removedAs you can see the wind on all days was not just a breezeI should have charged them based on the fact there was times the depth of what the price was for the 1-inches of snow which was $and gone there times and not used COMMON SENSEAs I stated the snow that fell started at 9:AM on the 28th and never stopped until after 6:PM on the 29th and her snow was cleared on the early morning of the 30th of DecemberAnd just so she knows The city ordinance states that all snow has to be cleared no later then HOURS AFTER THE LAST SNOW FLAKE HAS FALLENWE STATED THAT THE AMOUNT OF SNOW THAT WAS ON THE WALKS AND DRIVE WERE AROUND INCHES WE DONT STICK A RULER ALL OVER THE PROPERTYShe also doesn't say anything about the COUPLE OF FEET that the city puts in her drive way from the city Plower that plow the snow down the street and all over the sidewalks and continue to do this till the streets are clearedWhen clearing snow you don't change the price every couple of feetIts based on time that you are at the job siteNot what God gives usAlso she is complaining that we charged her for salting, I made a call to her cell phone and made her aware we were salting because of the Wet and frozen side walksMaybe she would be happier if someone slipped on the walks and sued and then she would be yelling that we didn't leave the sidewalks safe while they were goneThen she would have wanted our insurance company to pay the bill or doctor bills. AGAIN AT NO TIME DID THEY CALL WHEN THEY GOT HOME TO TELL US OF THEIR DISSATISFACTION OR COMPLAINT OF NOT BEING HAPPYWhen I spoke to her husband ndays later and asked why they didn't call he stated that and I quote " You didn't do it right the first time so why should they call and not do it right the second time"As he screamed at me over the phone and raised his voice to me and I had to tell him to lower his voiceI had apologized to him for his dissatisfaction and he told me he didn't want my apology and wouldn't accept itSo I did all I could do. It took them days after the service was done to call meShe NEVER CALLED BEFORE THAT NOT ONCEDuring the conversation she said she could go buy salt for $which is a lieI buy salt all the time as needed and the cheapest we found was $9.00+tax at Home Depot which is just blocks from their homeThe husband told me I should have bought it at WOODMANS which is in Menomonee Falls miles away from their homeWhen the wife talked to me on the phone she told me she wouldn't be paying the late charge after we billed them for the second timeThat she was going to mail a check for the first bitAS OF TODAY THEY STILL HAVE NOT PAID THE BILL. AT THE END OF THE DAY: We cleared the snow and they don't want to pay for the work we didThey never called at no time to complain about the service before days later and the snow is GONEMaybe they should have hired a Large Snow removal company and just see how much a big company would have charged if they would take them on at allWe are not reducing the bill as I had guys out there and have to pay their wages and pay them weeks after they work not months later.. If they don't want to pay the bill then the next step would be small claims court and they can let a judge decide what should be paid and not paidThe costs of court are $for the summons, $for the sheriff to serve and my lawyer feesHe charges $per hour court time. I have done all I can to explain this for the second time, Common sense would dictate if there was a problem to call the service company and have them come out and correct what ever the problem was to satisfy the customer and keep both parties happyBUT THEY CHOOSE NOT TO DO THATTHEY CHOOSE TO COMPLAIN AND WRITE LETTERS AND YELL AT ME OVER THE PHONE AND I HAD TO TELL HER HUSBAND TO LOWER HIS VOICEThis all could have been settled by a simple phone call to have us come out and fix the area's they say were not done to their satisfaction.Sincerely Todd ***

Revdex.com:There are multiple false statements in Hybrid Landscaping's response.  First of all the initial quote was $45.00 for 1 to 4 inches and anything beyond 4 inches would be charged at an hourly rate prorated over the time needed to clear the snow, it wasn't $50.00....this is reflected in the invoice he provided given he charged $45.00 for the first 1 to 4 inches and then added another $45.00 for the additional snow fall.  As far as the actual amount of snow fall, the airport has on record 9 inches fell between the afternoon of Monday the 28th into the morning of the 29th.  Hybrid landscaping is indicated our property had 12 due to blowing and drifting.  I would argue that if 9 inches fell and there was blowing and drifting it may have caused some areas within the property to be 12 inches whiles other would be less than 9 inches.  This doesn't come down to going with the highest level of snow on the property and using that measurement for the whole job; the job should be billed based on the recorded snowfall, blowing and drifting is to be expected but it all evens out in the end.  His dates are also inaccurate around the billing.  He may have written the invoice on February 5th but did not mail it out until February 16th which is the date postmarked on the envelope.  I called and left a message prior to March 1st however Todd returned my call on March 1st and we discussed the discrepancies in the billing.  We then received another invoice dated March 5th with an envelope postmarked March 7th.  You can't access a $10.00 late charge when you haven't even given a full 30 days.  During the course of our conversation I at no time raised my voice, I remained calm during the duration of the call and on two separate occasions pointed out to Todd that he was being very aggressive with me and was raising his voice.  I indicated if he wasn't able to discuss this in a professional manner I would end the call.  After he became aggressive the 2nd time I indicated we needed to agree to disagree at this point and I would discuss the situation with my husband before paying the invoice as he may want to talk with Todd.  I did state I would never use his service nor would I ever recommend him again as I had recommended him to my neighbor and they utilized his service during the same snowfall.  At no point did I mention I would go onto nextdoor and attempt to ruin his company.   I do feel it's worth mentioning my neighbors are also very dissatisfied with the quality of the removal and feel the charges are exorbitant.  The biggest dispute is the salt charges.  We live on a corner lot and have a double car width driveway.  We have essentially 2/3 more sidewalk than my neighbor plus they have a single car driveway.  He charged both properties $35.00 for salt which to me demonstrates he simply puts a flat fee of $35.00 no matter how much time and material is actually required.At the end of the day I feel this can go back and forth continuously.  I strongly feel this comes down to Hybrid Landscaping waiting too long to arrive at our property to remove the snow.  Had they made it out on Tuesday several of these items would not have become problematic but given we were out of town as was our neighbor and we both enlisted Hybrid to do our snow he lumped us together and put us at the bottom of the list.  Given the snow was wet and heavy and was left for more than 24 hours after the snow stopped it froze over making it very difficult to remove.  Poor planning on Hybrid's part doesn't mean that we should get left with a hefty bill and extra charges.  We never discussed or agreed to salt prior to the work being completed.  The salt was necessary to help break down the ice that had formed from waiting too long.  While we didn't return home from holiday till a few days after the snowfall the quality of the work wasn't satisfactory.  We didn't call at that time as we felt it was better to simple clean up the missed areas and choke it up to a bad level of service and we wouldn't use his service again.  The bigger issue came when we received the bill 49 days after the date of service and the charges were drastically inflated to what we had agreed upon.  I did reach out at that stage to review the charges but was met with hostility.  We've never indicated we wouldn't pay the bill but we are asking for a reduction in charges.

I would like to start out by saying that I have been in business for over 30 years and by your records you can see that I have a spotless record with your company and have been given a " A+ " rating with your company. That is because I have done a great job with past, present, and future customers....

We provide a number of services that meet our customers needs. I have never had a complaint that was never solved to the satisfaction of the customer. Thats why I have been given the grade I have. Two years ago the Mrs. [redacted] contacted us for snow removal while they left the country on vacation, we gave them a price of $50.00 to snow blow the side walks and driveway for 1-4 inches of snow. The first year there was no snow during the time that they were gone. They called the following year and asked for the same service again and gave us the new dates of them leaving. We told them we would provide the service again at the same price. They said fine. On December 28th of 2015 the snow in question was predicted as a storm of mostly rain with a chance of 1-3 inches of snow possible. During the early mornings of the 28th it had rained all night. I was in a meeting at 8:00am on the 28th and during the meeting at 9:00 Am it changed over to freezing rain and then to all snow. Started snowing lightly and progressed through the day. The storm actually snowed through the whole day and into the evening and just continued to accumulate and at times turned into freezing rain and freezing pellets and then back to snow. The actually snow never stopped until the evening at 6:00 PM on the evening of the 29th of December. Snow accumulations that actually fell was 9.1 inches measured at the Air Port and differed from location to location because of the winds and drifting. The actually measurement at the [redacted]'s was around 12 inches. On the evening of the 29th of December the temperatures dropped down in to the low 20's and froze all that had fallen leaving us with many problems. The cities weather people said that they had made a mistake with their predictions and of course gave excuses as to what happened. The city plows had many problems with clearing street as they were not prepared for the type of storm and the amount of snow that had fallen. Mrs [redacted] stated in her complaint that the house was ignored for two days witch is false. It wasn't ignored but that the snow fell for over 18 hours straight. You sure can't snow blow side walks in the middle of the night with out the police being called for noise by the neighbors. The pet sitter never had a hard time getting into the house unless she was walking in the snow with high heels. All she needed was a pair of boots that common sense would tell you that you wear in the winter to walk in the snow. I think this is very over exaggerated, its winter not June. Common sense would tell you that this was a major storm and to dress accordingly. The doors on both front and side of the house were UNDER COVER OF PORCHES. We started clearing of the snow on the early morning of the 30th of December. It was a difficult time with the snow and areas were very frozen from the freezing rain and freezing pellets that had fallen and then the temperatures dropping down to the low 20's on the 29th. The snow was also packed down by the people who walked over it. I had 3 of us there clearing the snow for over 3 hours. We had to spread Salt over the areas to provide safety because of the ice from the first part of the storm and I called Mrs. [redacted] and left a message that what we had done to make sure the areas were safe as to make sure no one would fall and hurt themselves. The areas that she states were not done to her satisfaction was not something I was made aware of. In the picture they provided as to the cross walks not being done is false. You can see in the picture that the neighbor across the street has their sidewalks done right down to the concrete and look at their access to the street. Its cover completely because of the plow trucks that plow the street have plowed all those corners closed after we were there and done and left. The city plows do this all the time including driveways after people clean their drive ways and walks.We finished cleaning the snow there in the early after noon and came back on the 31 early morning and put down salt on the areas. We at NO TIME EVER HEARD FROM THE [redacted]'S NOT ON OUR CELL PHONE OR OFFICE PHONE AFTER THEY GOT HOME. They NEVER  contacted us to come and correct the problems OR THEIR DISSATISFACTION. If they would have called We would have gone over there and corrected any problems they felt was a problem. BUT we never heard from them at all. We mailed them out a bill on February dated February 5th 2016 and never got a phone call about the bill till MARCH 1 2016. 90 days after the service was done and 3 weeks later we sent her a invoke she called us from her job and started to complain about the service and her invoice charges. She started to tell me that she was angry we charged her $35.00 for salting and the service call and labor charge. We charged her for a 50#bag of salt and the labor and service call. I told her that the salt cost us $9.00 plus tax for the salt and we charge $13.50 for the salt and the rest is labor and service. She started going off about she could buy the same salt for $6.00 per bag and that what we should have charged her. MY COMPANY IS NOT A NON PROFIT ORGANIZATION. The state of Wisconsin say that a retailer has to have a minimum mark up law of 6%. I fall under that regulation. There is NO PLACE IN MILWAUKEE that sells salt for $6.00 for 50# of salt. She got aggeravated on the phone and then I guess I got the same thinking I'm not suppose to get paid for my service and NEVER once called melting me come out and fix what ever problems they had. At no time was she ever verbally  abused. What she was mad about was me charging her for our service. The price of snow blowing her property was $50.00 for snows of 1-4 inches for snow regardless if it fell from the sky or or the city plows plowed it there or if it drifted there because of the high winds that occurred. I NEVER told her it was just from what GOD gave us. Under the agreement I could have charged her $50.00 and went there 3 times for ever 4 inches of snow. But I didn't charge her like that. We charged her $90.00 for the snow removal and $35.00 for the salting, which I feel was more then fair for all the work and time that was there.When I told here that she threatened to never use me again and would not recommend  me to anyone else and said she was going tell everyone on on "Next-door.com and your Revdex.com of all the things I did wrong. She told me she would be mailing a check in for the payment that she was billed for and we hung up. Then on March 5th we had to mail her another bill out because we never received the payment. Our normal practice is to add a late charge when no payment is received and we add that I had intended to advise her of a lien if not paid. When I spoke to her husband and asked him WHY THEY NEVER CALLED WHEN THEY GOT HOME AND WERE NOT HAPPY WITH THE SERVICE .... HE TOLD ME THAT "WHY SHOULD WE HAVE CALLED YOU TO COME BACK OUT AND FIX THE PROBLEM WHEN YOU DIDNT DO IT RIGHT THE FIRST TIME... I told him that was very childish and made no common sense. They filled the complaint that day. In re-capping If they had a problem with the service why didn't they call and let us know about the problem before 90 days later after the snow so we could have come out and fix it. I had apologized for the problem and he told me that he didn't want my apology and he was not accepting it. All he did was YELL at me and scream on the phone and how the was going to tell everyone about my company and ruin me on Next-door.com and file the complaint with your company. Im sorry that they feel this way but if they would have called we would have come back out and corrected the problem, and all this wouldn't have happened.
