My dog was attacked by two dogs at this dog daycare/boarding location. Owner refuses to give me a copy of my signed contract or pay vet costs.I received a phone call from the owner of this business on Friday October 17th at 10:24am to let me know that two dogs waiting for food had attacked my dog when he went to play with them during daycare. He informed me that my dog had a 'slight mark' above his eye. When I picked up my dog 30 minutes later, the owner had strapped a hand gun to his hip, making me uncomfortable enough to not ask him questions, "play nice" and leave with my pet.I took my dog straight to the vet, where we discovered his injuries were significant. He had a gash above his left eye that went to the muscle, and when he moved his eye we could see the muscle contracting. In addition, his right ear had been partially torn from his head. He received 4 sutures above his eye, and 3 sutures to reattach his ear. He has since had to return to the vet multiple times for infection issues. The total vet costs to date are $657.18.I contacted the owner of the business via the contact us form on their website on Monday evening, October 20th, requesting a copy of the contract/waiver that I signed, and footage of the incident. He has refused to send me the signed copy of the contract, and instead has referred me to the liability waiver posted on his website. In addition, he now says that my dog was the aggressor, and not the other way around as he initially stated on the phone on Friday, October 17th.The liability waiver on his website includes clauses that waive liability for negligence and also requires the complainant to pay for the company's legal defense.I believe the actions of the owner of this company, HydroConcepts, DBA 'The K9 Kabana', are negligent, and that the business is at least partially responsible for the costs incurred due to injuries my dog received while under their care on Friday, October 17th.Desired SettlementRefund of daycare costs incurred for services not completed on Friday, October 17th - $20.00Veterinary bills to date - $657.18.Income lost due to taking leave on Friday, October 17th to care for my pet - $221.42Total settlement sought - $898.60Business Response The owner was called as soon as it happened. Her dog was standing outside of what we call the food and our volunteer was inside the food room getting something from her purse. When another dog walked within a couple feet of her dog(who was standing right outside of the food room) he attacked the other dog and the other dog defends itself. Her dog got a very small cut above the left eye approximately an eighth of an inch to a quarter of an inch. I called mom and left her a message immediately after it happened, she called me back a few minutes later and said she was coming to pick him up. When she got there I told her what happened and since she had paid for a full day of daycare told her right off the bat she has a half day credit with us. He had no issues or damages to his ear we looked over him repeatedly to check him when the fight happened and when she left she was fine. 2 or 3 days later I got an angry email from her stating that his ear had to be reattached and his eye damage and that she had to pay $700 to the vet. She immediately started slamming us and said in the email that I only offered her $10 for the damages to her dog and that she wanted camera footage so she could sue us for negligence. I emailed her back again telling her what happened with him in his aggression , and her response was to go on to [redacted] and [redacted] and slam us. She has to know that her dog is food aggressive or she has no idea what her animal is like. Her sister went on to our [redacted] page and also slammed us even though she doesn't have a dog I believe just simply has been here a couple times to pick him up. She right off the bat started accusing us of negligence and repeatedly stated that she is going to sue us. If you want I'll forward you her emails. Consumer Response The owners interpretation of my dog's personality, while it differs significantly from my own, is his own opinion which he is entitled to. My dog is a beagle, and as is known for their breed, they love food. However, my dog has not ever attacked another dog for or around food in the four years I have had him, he just loves to eat. In fact, we feed him side by side with a 17 year old senior beagle twice a day every day without incident. If he was aggressive with food, he would let his 17 year old senior 'sister' know.Regardless of how I interpret my dogs personality, the owners remarks actually reiterate my every concern with the establishment. If the owner feels my dog is food aggressive, and is blaming my dog for the incident, why did he allow my dog to pass the temperament testing and frequent the establishment on many occasions? Why does he allow 'food aggressive' dogs in such close proximity to his so-called 'food room'? In addition, my dog has passed temperament testing at no fewer than four separate locations in the area with no incident whatsoever. This is the only establishment that he has visited with any issues.In addition, I have also been cautioned in the lobby of the establishment when I approached another dog, as that dog was known to bite people. My dog has also been attacked in the parking lot of this establishment. My pets injuries were not insignificant. The cut hove his eye was so deep that we could see the muscle contracting when he moved his eye. When I picked my dog up from the business I was 'fine', as the owner mentioned, because the owner had a gun, and I was not going to argue with him when he was openly intimidating me in such a manner. I did send an angry email and did leave negative reviews for the business, as is my right as a consumer and the purpose of review websites. I am completely open to sharing this information with the Revdex.com and anyone else who needs the written documents, including the owners attorneys and my own, along with photos of my dogs injuries and copies of the veterinary bills.I did not get my sister to write a negative review, once again, the owner is mistaken. My family is in [redacted]; he knows this; and I have no immediate family here that frequents his business. The person whom I know who wrote the negative review is my 'dog babysitter', who did drop my dog off and pick him up from the business on a number of occasions, making her a legitimate patron of the business, with a valid opinion, and she should be treated as such. The owner also fails to mention the number of friends he got to write positive reviews to 'dilute' my negative review after I wrote it.I have not in fact ever threatened to sue the business. I have requested on a number of occasions for a copy of the contract that I signed, and footage of the incident, so that I could make a decision about whether or not negligence may have been a contributing factor to the incident. To this date, the owner has not given me a copy of the contract as requested, and has not given me any video footage of the incident. He continues to refuse to provide me the legal documents I am entitled to have access to. The owner needs to consider the unconscionable nature of his liability waiver, and how he interacts with paying customers. My desired resolution remains as it was in my original complaint:Refund of daycare costs incurred for services not completed on Friday, October 17th - $20.00Veterinary bills to date - $657.18. (Which has increased since my initial complaint, but I am willing to cover the difference).Income lost due to taking leave on Friday, October 17th to care for my pet - $221.42Total settlement sought - $898.60
