First of all, when the digital signs on the freeway say that the road is closed to light and or high profile vehicles you should not break the law and drive on these roads The towing and RECOVERY rates for all towing companies participating in the Wyoming Highway Patrol rotation list are
posted, reviewed and approved by Highway patrol In the case in question, this was not a tow but a Recovery Because I am required to have a million dollars of insurance coverage to operate this towing company and due to the fact that this coverage is so expensive we are forced to charge as we do As for the company who decided to wreck their truck by driving illegally on a closed highway and for their lack of insurance to cover this type of accident I am not sure I can speak to that I also can't speak for Highway patrol and the fact that the company was not allowed to call a towing company of their own choosing As for the statement that we are stealing equipment; we would be more than happy to return all equipment as soon as we are paid for the service provided All too often companies will request the return of their equipment and as soon as they have it they dare us to to collect for services It is in the best interest for us to retain possession of the property in order to get paid for our work

First of all, when the digital signs on the freeway say that the road is closed to light and or high profile vehicles you should not break the law and drive on these roads.  The towing and RECOVERY rates for all towing companies participating in the Wyoming Highway Patrol rotation list are...

posted, reviewed and approved by Highway patrol.  In the case in question, this was not a tow but a Recovery.  Because I am required to have a million dollars of insurance coverage to operate this towing company and due to the fact that this coverage is so expensive we are forced to charge as we do.  As for the company who decided to wreck their truck by driving illegally on a closed highway and for their lack of insurance to cover this type of accident I am not sure I can speak to that.  I also can't speak for Highway patrol and the fact that the company was not allowed to call a towing company of their own choosing.  As for the statement that we are stealing equipment; we would be more than happy to return all equipment as soon as we are paid for the service provided.   All too often companies will request the return of their equipment and as soon as they have it they dare us to to collect for services.  It is in the best interest for us to retain possession of the property in order to get paid for our work.

On 7-31-12,called by petro truck stop, they had a '04 dodge P/U that had been abandoned on their property, and requested us to tow it away. On approx XX-X-XX Mr Kohpoy called and stated he would be here to pay and pick up his truck. At that time I agreed to lower storage rate from 65.00 a day to 15.00 a day since he said he would be here. He then called the next day and said he was in Casper WY and would be down and pay to recive his truck either that night or the following morning. Mr [redacted] did not show up nor call to inform me of his plans to recover his vehicle. On XX-XX-XX I retowed the vehilce to a more long term storage lot as I assumed vehicle was abandoned due to the owner stating he would come and pay and pick up his vehicle on or before 08-02-2012. Then on XX-XX-XXXX Mr [redacted] stopped by my Laramie location after business hours and started to rant and rave how he wanted his truck. I told him if he would settle his bill he could have his truck. He stated he was not going to pay and he said he would sue me if I did not give him his truck since I hade no right to tow it to begin with.

Review: On September 22, 2013 my trainer, Mindy, and I left a horse show in Parker, Colorado with my horse to return home to Idaho Falls, Idaho. We were traveling on I-80 just north of Laramie Wyoming about 9:00 p.m. when our truck lost power and lights. We were able to steer the truck and horse trailer off to the side of the Interstate.

I contacted my insurance company for towing service and they were able to GPS our location and contacted a towing service.

The tow truck was at our location within an hour. The towing service was I-80 Towing and Service located at 1209 South 3rd Street, Laramie, WY. 82070 (also known as QVO Repair and Service P.O. Box 2512, Laramie, WY. 82073)

The tow truck driver was very courteous and hooked up the truck with the horse trailer and towed us back to Laramie. He graciously stopped at a local veterinarian’s office in order to drop of my horse for overnight stabling. The vet’s office was on the way to the repair and towing location.

The next morning I went to see what was wrong with my truck which was at I-80 Towing and Service. The mechanic said the battery was dead. The repair shop claimed they tried to charge the battery but it did not take a charge (the battery was purchased new in February of 2013). They then put a new battery in my truck, which cost $244.00. I then asked them to put the old battery they took out of my truck and place it in the bed of my pick-up truck so I could take it home (per request of my husband). I also stated to the repair shop mechanic and manager that my friend, plus our husbands all suspected the issue was a bad alternator, but the mechanic assured us it was not.

I drove my pickup truck back to the vet’s office and hooked up my horse trailer and my friend and I put my horse into the horse trailer and started again on our way home to Idaho Falls, Idaho. (470 miles).

We drove approximately 40 miles from Laramie on I-80 when all the warning lights came back on, including the battery light. We then turned around and I called the repair shop to have an alternator ready, and drove back to Laramie.

When we arrived the mechanic (the one who diagnosed and insisted that the battery was dead) was extremely rude and used very abusive language. He said the truck did not need an alternator, yet my friend who is very knowledgeable about car repair said it was. The mechanic became even more angry. The manager told the mechanic to leave and go out on a tow and they assigned another mechanic to repair the truck.

2 A repair that should take maybe 15 to 30 minutes took almost 2 hours. In the meantime my horse stood in the horse trailer that was attached to the pickup truck. We had no safe place to put my horse.

The repair shop mechanic had suggested that we put my horse inside the repair garage, but we said we were not going to take my horse out of the trailer into an unsafe location. The garage was not a safe place for a horse and he is too valuable to be put in that hazardous location. Besides the repair could be done outside and as stated previously “the repair should only have taken 15 to 30 minutes”.

Finally they replaced the alternator and charged me another $170.00 and we started back to Idaho Falls.

We did get home safely. But because of the loss of time in Laramie with the repair shop, we arrived home very late, about 11:00 p.m.

My husband was able to recharge the original battery that was in the truck that we had purchased February 2013 from Sears. He took the battery to Sears and had it tested and

they stated that it was fine.

10 days after we returned home from Laramie, my husband was driving the truck in Idaho Falls and the warning lights came back on and he drove it directly to our mechanic.

When our mechanic looked at it the next day he said it was a faulty alternator and that the I-80 Repair shop also put a battery in the truck that was undersized. They put in a MTP 65

instead of a MTP 875. My repair shop in Idaho Falls replaced the faulty alternator.

I contacted my insurance company about the faulty repairs and they said they would file a complaint with I-80/QVO repair and Service and they would not be on their call list for

repairs. It was then that I was told by the insurance representative that the I-80 Tow Truck Driver was initially instructed to take us to LTS Automotive Service and Repair in Laramie the night he towed us to Laramie. I was totally unaware that he was instructed by the insurance company to take the pickup truck to LTS Automotive Service and Repair in Laramie.

On October 12, I called I-80 Towing and Repair in Laramie and asked to speak to the manager. On October 15, after no return call, I again contacted I-80 Towing/QVO Service

and Repair. When I told the manager that I was very dissatisfied with their service on my pickup truck and I felt that he should refund the money that I had given him for the faulty repairs, he was abusive and said “no way” that he would refund any money to me and hung up the phone. I then tried to call him back and his secretary would not connect me to his office phone so I could talk with him. I then told her to tell him that my insurance company did not authorize them to repair my truck. I told her that the truck was supposed to be taken to LTS Service and Repair and she told me “there was no such place in Laramie” and hung up.

I called LTS Automotive and talked to a service man at that location, who confirmed they were in fact in Laramie. Again, I received another false statement and was lied to by staff at I-80 Towing/QVO Service and Repair.

In conclusion, I strongly feel I-80/QVO Repair and Service located at 1209 South 3rd Street, Laramie, WY. 82070 took advantage of me by towing my truck to their service facility 3 contrary to the instructions given to them by my automobile insurance provider who told them to take my truck to LTS Service and Repair in Laramie.

We were a captive female audience, trusting that we were at a facility that was directed and approved by my insurance company. As noted above, I was not informed of this order until I spoke with the insurance company several days later.

I strongly feel I-80 Towing /QVO Service and Repair should refund in full the repair and service fees for the battery and the alternator. I also should be refunded the extra mileage and fuel to return to their facility to repair “Their Repair”.

I-80 Towing/QVO Repair and Service were totally inconsiderate, rude and took advantage of us, for which I demand an apology and a refund.

Sincerely,

[redacted] Desired Settlement: I strongly feel I-80 Towing /QVO Service and Repair should refund in full the repair and service fees for the battery and the alternator. I also should be refunded the extra mileage

and fuel to return to their facility to repair “Their Repair”.

Response:

Dear Sir,

The I-80 Towing/QVO response was grammatically difficult to understand. The respondent (I-80 Towing and QVO Repair) stated that I was lying, however, it is he who is lying. The battery that they replaced was not dead as claimed. My husband was able to charge it when we arrived home and he took it to Sears where we had purchased it in February of 2013 and it was tested and was certified to be fine.

Secondly we were not screaming but very frustrated that they would not replace the alternator after returning to their shop. We stated the warning lights had come back on after we had traveled 60 miles out of Laramie and had to return, hence driving 120 miles that we should not have had to drive. Both my friend and I called our husbands and asked what we should do. Both our husbands agreed that the alternator should be replaced.

The repairman was the one who was shouting and verbally abusive. As stated by I-80 Towing/QVO Repair response:, “ He (the repairman) was in a bad mood”. I was appalled and worried about getting home safely. We had my very expensive Dressage horse in the trailer and they wanted us to put him their garage!

My husband and I bought the Ford F250 truck new and there have been no modifications. The fact is I-80 Towing/QVO Repair replaced the battery in my truck with one that was inadequate. They installed a MTP 65 instead of a MTP 875. In addition, the alternator they installed was faulty and had to be replaced by my mechanic in Idaho Falls, again at our cost.

I called I-80 /QVO Repair shop and talked with the manager. I told him about the battery and the alternator and asked for a refund. He shouted on the phone “no way” would he give me a refund for the faulty and defective parts. He then very abruptly hung up on me. When I called him back his secretary said he would not talk with me. He wanted me to send the battery and the alternator to him. Why should I pay to return items that he installed that were inadequate and would be costly to return via a common carrier?

Safeco, my insurance company, confirmed that I-80 Towing, was in fact instructed to take my truck to LTS Automotive, their approved repair shop. (It appears there is some collusion between I-80 Towing and QVO Repair). I was unaware of those instructions until I returned home and filed a claim with Safeco against I-80 Towing and QVO Repair.

I too, am a breast cancer survivor of 2 years and empathize with the respondent for his mother’s illness and wish her speedy recovery. However, this is not a reason for his incompetence and the extremely rude behavior by him and his staff.

I still demand refunds for both the alternator $170.00 and the battery $244.00, totaling $414.00 (excessive) to compensate for the incompetent repairs that I-80 Towing/QVO Repair attempted on my truck. In fact, I had to have the truck repaired again when I returned to Idaho Falls from Laramie. If $414.00 is not refunded, I will be forced to file a claim in small claims court and demand all expenses and court costs also be paid by I-80 Towing and QVO Repair.

I trust this correspondence provides enough information to pursue this claim in my favor.

Thank you,

Sincerely,

Business

I represent I-80 Towing, LLC, QVO, LLC and Thomas Mullan. I am in receipt of your correspondence electronically delivered to my client on November 18, 2013, 10:50am. Please let this serve as my client’s response to the Complainant’s most recent Complaint. My client previously offered to resolve the alleged dispute which was apparently rejected by the Complainant. My client disputes with her recitation of the facts and allegations. My client attempted to help Ms. [redacted] on a Sunday when all other auto repair mechanics and businesses were closed. My client did not need to offer this service to Ms. [redacted] but chose to do so in an extraordinary effort to be helpful due to her predicament. My client vehemently disputes the allegations Ms. [redacted] has now made again after her first complaint was closed by your office. Because the Complainant has threatened litigation in this matter, my client can no longer substantively comment as to the events which transpired. My client will seek all attorneys’ fees and costs be awarded and ordered against the Complainant for this frivolous complaint should she chose to pursue this matter in litigation. If you have further questions, please do not hesitate to contact me.
