I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below

On May 26, 2015, Global Key LLC concluded a deal to purchase
seven (7) units of Used Siemens Servo Ventilators from I Global Services,
which were described in an *** listing (Listing Attached) as guaranteed
workingThe seller stated that all (7) units had been removed from a working
environment and were tested to perform as per manufacturer’s specifications
We
contend that the units supplied are not functioning as described in the
listing and per the seller’s days return policy (see Listing); we are
well within our rights to return the items without any contention from the
sellersWe informed the sellers to authorize us to return the items, well
within the days period (emails attached).Seller’s
invoice (copy attached), clearly states that the items being purchased are
units of “Siemens Servo Ventilator Heart Lung Adult Pediatric
Neonatal + SUN + Stand.” We have only received the parts of the unit
and not the complete ventilator as described in the invoice or the ***
listing
The listing mentioned that the Unit had
accessories, namely:
1. Siemens-Elema AB
SUN Module
2. Detachable
Arm
3. Rolling
Cart Base Stand
4. Detachable
Cord
The items mentioned in the
accessories list are those that are optional accessoriesThese do not aid or affect
the functioning of the Siemens Servo ventilatorThese are mere adjectives
used to describe the aesthetic condition and additional accessories that come
with the units
We have
obtained the opinion of a neutral third party biomedical engineering
company on the seller’s listing and the fact that functioning of the units
is not possible if the integral parts are missingThey have clearly
stated that the listing has been created to mislead the prospective buyers
into believing that the units are functional as intended and that they
have been professionally tested for functionality
We are
willing to invite the seller’s engineer to visit the storage location get
the equipment to function as per the description in the ***.com listing
We now bring your attention to the emails exchanged between
our representative & that of I Global
We received the items on June 19, via Road Runner, a
national transport company as evidenced in their tracking report (attached)
The following business day, (June 2015) we informed I
Global over the phone about the missing itemsUpon their request, we sent them
photographs of the units as they were receivedPer their emails, upon
realizing their error, I Global offered to grant a further discount and asked for
a fair solutionWe requested them for accepting return of merchandise and a
full refundThis request was declined despite the fact that the ***.com
listing (copy attached) their representative referred to clearly stated that
the items could be returned within days of purchase
On June 2015, we sent an email specifically requesting
that we be authorized to return the merchandise
Since we did not receive a Return Authorization form from I Global we initiated
a chargeback via Paypal only to have our charge declined
We then initiated via *** *** and were advised by them
to return the merchandise to I GlobalThe items were sent out on July
for return to Global Asset Management and upon arrival, the consignment was
refused acceptance by *** (I Global Representative) and the remark was noted
by the driver (Bill of Lading attached)
The items were then transferred to a third party warehouse
at Gardena CA for storage until the case is resolved and the seller accepts return
of the merchandise

The sale occurred and the buyer had received the goods and was dissatisfied that more accessorieswere not IncludedThe buyer acknowledged that they had received everything as described in our listing.The buyer had then filed a claim with *** weeks after the purchase.On June 24..,, the buyer
had filed a claim with *** for an item not being as describedThe casenumber for *** is: #•••••••The buyers only complaint about the sale is this (be advised this is a direct quote):"The use medical equiments that I receive are missing cabels, air and oxyengen gas moduleThemachine was suppose to come in working condition but it is not working because it's missingthese important parts."The buyer is mentioning that things were not received by himI will address these on a line by line basis1) "Missing cables" -There is NO mention of cables included in the description as well as nopictures of cables in any pictures.2) "Oxygen Module"- The part the buyer is referring to is an LMVOxygen Module which again isclearly not anywhere in our listing nor our pictures.3) "Gas Module" -The part the buyer is referring to is an SGT -Gas Module and again is clearlydescribed as Not includedIt is evident that the only module that we mentioned and included in the sale was the SUN Moduleand the only cable that was included was the power cordThe buyer confirmed he had received both oftheseThis is all confirmed by the multiple, very clear pictures of the Item in our listing.After *** had the chance to review the buyer's complaint and the information provided, *** hadfound that this was a case of "Buyer's Remorse" and that we (the seller) had upheld our end of the dealby supplying the buyer with what he intended on purchasing.In summary, the buyer was made fully aware by website, photos, emails and phones calls as to whatwould be included in the saleThere was no ambiguity In regards to what would be included and thebuyer acknowledged he has received what we advertisedThis claim was then cemented by *** bydenying the buyers claim stating that we, as the seller, did a more than adequate job of describing theproduct.Finally, the buyer attempted to file a credit card chargebackAfter the credit card company hadreviewed the evidence put forth by *** and by us as the seller, they determined this sale was NOTeligible for a chargebackThe buyer had not made any attempt to return the items prior to opening upa case and filing a chargeback.Thank you for your time and consideration.-*** ***Chief Financial Officer
