This is an unfortunate situation where the pool would not fit in his property to the township's regulations The incorrect plans/survey were supplied to us by [redacted] *** [redacted] alone was the applicant and it was his sole responsibility to obtain the variance He applied for the wrong size pool and as a result, Best fiberglass Pools advised that we cannot install the pool per the specs that he was granted [redacted] than told us to put the pool in anyway and he would "handle the township" We then had him sign the attached paper stating as such The pool could not go in as a result of his incorrect survey he provided us and incorrect measurements on the variance application Best Fiberglass Pools have never received any letters from a lawyer but have received his requests for a refund The back of the contract between Best Fiberglass Pools and [redacted] (attached) signed by [redacted] & [redacted] on 12/5/states in #'s & that we legally have the right to charge all expenses incurred by our company and to charge an additional 20% restocking fee on the pool should the contract be cancelled Best Fiberglass Pools has offered to refund $of his original 12,which is waiving the $5,restocking fee, only charging the $2,for the freight to bring in the pool and the $2,to have our excavation/installation crew on site the morning the pool was to be installed Lastly, the cost of the oversized load permit, to haul the pool to [redacted] ***'s property of $each for the state of Pennsylvania and New Jersey [redacted] has refused this amount insisting he is entitled to a full refund Best Fiberglass Pools was eventually able to resale his pool but at a large discount as it had some discoloration due to sitting dry in our stocking yard for several years as it is not a popular shape or color taking another loss on [redacted] ***'s contract that we are not charging him for As you can see, Best Fiberglass Pools is trying to resolve this situation in which we are at no fault, in what we feel is more than fair by offering more of a refund than [redacted] is legally entitled

Review: My vehicle was poorly repaired causing extensive damage to include my engine needing replacement. I talked with three separate and independent mechanics who all agree my vehicle was improperly fixed. The vehicle had water in the brake booster and engine causing the piston rod in cylander 6 to break and create a hole in the engine block. The mechanic said he got most of the water out and my vehicle would be fine. 40 miles later it wasn't. He now wants 4815.00 to put a used engine in and labor. What upset me the most is my son was in the car when this happened as we were driving on the highway. He now denies that there was anything wrong other than lower pressure in cylander 6. I had the car originally at a [redacted] in Cherry Hill but was referred to this guy. They know the problems too.Desired Settlement: I would like the mechanic shop to own up and pay for their mistake. They are responsible for the engine and the labor.

To my knowledge, we were the last of three shops to work on this car and the only one to locate the problem.The problem was water getting into the engine. One shop thought it was head gaskets and was ready to remove the cylinder heads, which would have been expensive and NOT fix the problem. One shop did a tune-up, which did nothing ti fix the problem.We found that the water was collecting in the drains below the windshield and filling the battery tray area high enough to enter the brake booster. From there, the water got into the vacuum hose to the engine.We drained all the water out of the body and brake booster, and cleaned the drains that caused the problem.Because so much water went through the engine, we decided to change the oil and filter. There was more than a quart of water that came out with the engine oil.The other shops and the owner drove the car with all this water in the oil. That by itself would be a more of a cause for the engine failure than the work we did.Our work consisted of finding and fixing the water problem, changing the oil and filter, changing one spark plug, and changing one fuel injector. None of those repairs could damage the connecting rod or rod bearings.

I am rejecting this response because:

My car was seen by only 1 other mechanic shop and that shop referred I Service imports. I talked with 3 independent [redacted] mechanics who agree that I service imports was at fault. Furthermore he is lying when he said he fully drained the water out. He told me and the other mechanic that he didn't get all the water out.
