Thank you - I actually attempted to respond a couple weeks ago but the Revdex.com system did not offer an option to do so :-)
As far as we are concerned this matter is closedTo review:
1) An item on our shelves was incorrectly priced "$5..00" instead of "$55.00"
2) The customer discovered the item with the incorrect price tag, and was under the assumption that we were legally obligated to sell the item to him for $(despite the fact that the tag was not actually correctly formatted to $5.00)This is, of course, incorrect
3) We refused to sell the item to the customer at that price.
4) After a discussion that culminated in the customer asking what his next steps were, the staffer on duty suggested the customer contact the Revdex.com to lodge a complaintWhich he did
We are confident in our position that we were not obligated to sell the mislabeled item at the mislabeled price (again, not even a correctly formatted label)We are sorry that the customer disagrees, but are firm in this position.

">I am writing on behalf of the complaint you received numbered: *** My name is *** *** and I was the employee on staff at the time of this incident (7/27/14) I wanted to submit a supplementary comment alongside my manager, Mr***'s, response I am in full agreement with the comments made by Mr***.I agree with the facts as submitted by the complainant for the most part, but would like to take this opportunity to offer some clarification I was nothing but polite in my communications with the complainant When first presented with the product in question I looked at the price and offered a joke, saying, "that doesn't seem right, does it?" He responded, "No, that's why I'm curious about it." I told him that the item in question was, in fact, $ The complainant then asked "if [I knew] that Wisconsin Law requires [me] to sell it to [him] for $5.00." I told him that I disagreed The complainant never purchased the item for his suggested price of $or otherwise I never rang up the item for purchase I then explained that If he wanted the item, I would sell it to him for $at a 20% discount, as is our policy for all Games Workshop products The complainant was not satisfied with my response and believed that the law required me to sell the item at a price of $ I explained that I was a Wisconsin licensed attorney and it was my belief that the law does not require me to sell items It was my belief in this regard that the law instead requires me to compensate someone for a discrepancy in price after an item has been sold I suggested that he could file a complaint with the Revdex.com if he was still unsatisfied The complainant then left the store I want to emphasize that at no point did I ask the complainant to leave the store The complainant left of his own accord, and never acted in a manner that would have required his expulsion from the store
The complainant treated me in a civil manner and I believe that I responded to him in kind I did not ask him to leave, and to the contrary, he was more than welcome to browse the store and initiate a transaction for his originally selected item or any other item The complainant never offered to engage in a transaction that I accepted or authorized and as such, I never initiated a transaction within the point of sale system
It was not my intent to intimidate or be impolite with the complainant It is perhaps uncommon that a retail clerk would have an opinion on the law but I believe that I was polite and proper in stating my opinion on his question of law, supporting my opinion with my licensure, and offering him a possible method for resolution that he could pursue if he was still unsatisfied
The complainant has included a section of WisStatchapter I feel that it is appropriate to indicate that if the complainant wishes to pursue a legal remedy under this statute the proper forum would be a court of law As such, I am offering this comment merely within the context of the complaint within your agency and my comments in no way reflect an assertion of any legal argument which I reserve instead for the proper forum

I'm Bryan ***, owner of I'm BoardThe employee mentioned, ***, contacted me immediately after his encounter with Mr***, (yesterday, 7/27/14, at around noon) and had the good sense to snap a picture of the price tag in questionThat picture is attached, and can also be viewed here:

The correct retail price of the item in question is $50.00, and you can see from the picture that this item was very clearly mislabeled as "$5..00" with two periods - technically not even a correct $priceThe "." and the "0" are right next to one another in our price labelersThe item was correctly priced in our point of sale systemItems from this manufacturer are always 20% off at our store, which is way the final price quoted to Mr*** was $plus tax, or $
According to ***, Mr*** was not argumentative, nor did he "cause a scene," but he did immediately bring up legal claims as soon as we stated the final priceMy *** insisted that we must sell the item to him at that price, at which point *** explained that the item was mislabeledMr*** did not accept that answer, and *** refused to sell the item to Mr***The item in question never left our possessionThe conversation culminated with *** suggesting Mr*** contact the Revdex.com if he would like to submit a complaint, which Mr*** has done
Mr*** attempted to purchase a book that is well-known to have a $price, sitting among several other books from the same manufacturer that all cost between $40-$(and we've confirmed were all priced accordingly)Here is the manufacturer's web page for the item in question:

Further, any fan of the game for which this book is associated will very likely know the true cost of these books
According to our records, Mr*** has never purchased anything at I'm BoardHis first attempt to purchase an item was clearly mistakenly marked, and immediately claimed legal rights when the correct price in our POS system was presentedHe also never took the time to contact me about the matter
As far as Mr***'s accusation of attempted intimidation by ***, he is mistaken*** is indeed a Wisconsin-licensed attorney (State Bar #1092419) and responded to Mr***'s legal claims with true legal facts*** was letting Mr*** know that his claims were incorrect, and qualified his response

I was never told to contact ***, the owner, as I was told by *** if I had any issues I should take it up with the Revdex.comIf he has asked me to talk to *** about the issue I would have contacted himEven if *** had explained it was a mistake and ask me to understand I would have been willing toThe only reason I escalated to the Revdex.com is because *** told me that was my only option.
This was my first time in the store and knew that a new edition of 40k had come outI sold all my 40k a long time ago and am not currently up to date with the gameI assumed that the old Codexes were being phased out and that the old books were marked for discountThe only reason I brought up the legal reason for selling the item was due to ***'s handling on the manner.
I feel like that the fact this is my first purchase shouldn't matter in this situationI went to a local game store someone had told me about and this is how I was treatedI've been here before, liked you on FB, written positive reviews on Yelp, and other such thingsI don't plan on changing my reviews because of thisI just feel like *** handled this poorly and I'm following up the only way he told me I could
I understand mistakes occur but when I saw the item which had been priced that way since JanI assumed that was the price and what I could buy it for.
