Review: The day I was to pick up the vehicle, the dealer called me and said we had a problem, the check engine light came on and that they wouldnt be able to sell me the car, but they would look into it. Their mechanic did something to the vehicle and the light came off, so they said it was good to go. Before taking the car, I told the dealership that I hope it wasn't a temporary fix. The check engine light came back on the next day. I called the dealership and advised them and they said sorry I took the car as is. I looked into the lemon law but it didn't apply to my situation. I should of tried to sue them back then. Now I can't get my car registered because it wont pass inspection. Now I have no vehicle.Desired Settlement: I would want 2/3 of my money back so I can look for another vehicle, and they can have that one back.

Response:

[redacted] purchased a 1996 Lexus ES 300 April *,2012 the mileage on the vehicle was 151,222 miles. NYS Law does not require dealers to warranty vehicles with over 100,000 miles, however we have been in business since 1929 and our reputation is very important to us regardless of what the circumstances are or how much the vehicle costs, in this case $3200.00 plus tax and plates. We did proper repairs to vehicle before selling the car and made sure that the car was safe, roadworthy and capable of passing NYS inspection properly. The customer was told clearly that they were buying a vehicle without a warranty. What is interesting about her claim is that we are hearing about it in October of 2013 which means that the car was up for inspection April 2013 as a prior customer had she called us and told us what problem she was having we would have made an appointment with her in our shop and tried our best to bring the car up to NYS inspection standar ds. However at this point far to much time has gone by, anything could have happened to her vehicle between April *, 2012 and now, and in all fairness she purchased a 1996 automobile. Having said that, we would still be happy to look into her car mechanically see what the problem is and try to help her out, because she is a CUSTOMER and we care about our customers. Perhaps we could even trade the vehicle for her for another if she is not happy with this one.

Response:

The fact that a check engine light came on a 1996 vehicle(17 year old car)does not mean that it is a bad car or a vehicle that is not road worthy. The customer was advised properly when they purchased vehicle what the terms of the purchase were. Again if [redacted] is not happy with the vehicle, we have a shop at our dealership and would be happy to try and repair the vehicle for her as economically as possible. Had [redacted] communicated her dissatisfaction earlier, not 1 year and 6 months after purchase of a vehicle that was sold without a warranty we would have been more flexible in our efforts. We feel it is unreasnoble of a consumer to approach us 1 year and 6 months after a sale of a $3200.00 car that was sold with no warranty. But again we care about our customers and if [redacted] contacts us we will try and repair whatever is nescessary at the most affordable price possible.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Yes, the car is old, and it runs but the engine light should not be on. You called me and stated that you couldn't sell me the car with the engine light on. You eventually got the engine light to go off (temporarily), so you sold me the car. When the engine light came back on the very next day and I told you. You should have taken the car back and offered an exchange then. I know there was no warranty but in this circumstance it shouldnt apply. As far as the length of time that has gone by, it wasn't till October 2013 when the registration was up and I had to re-register the vehicle but couldn't because I needed a current inspection which I couldn't get because of the engine light being on.
