I purchased aids from Ideal in August of 2017. Great customer service and was caring about my hearing needs. Good people to work with.

I purchased a pair of hearing aids from David at Ideal Hearing Aids on 8/23/2017. The hearing aids arrived at an audiologists office on 9/5/2017, where I was supposed to have them fitted. Ideal Hearing Aids sent incorrect attachments on the aids and did not provide this audiologist with the correct software to properly tune my hearing aids. Thus I left the office with new aids, but they did not fit, were uncomfortable and poorly tuned to my hearing abilities. Ideal Hearing Aids then contacted me saying that I owed them more money after they'd billed my insurance nearly double the amount that they had quoted me for my hearing aids and my insurance company only covered a portion of that amount. I had already paid over $1200 out of pocket and Ideal Hearing Aids was asking for an additional $400. They listed my pair of hearing aids at $3300 on their website, but charged my insurance $6000.

At this point, on 10/4/2017 I chose to return these hearing aids for a better-fitting, more financially feasible pair. I shipped them inside a hard case (provided to me by Ideal Hearing Aids), in good condition. On 10/10/2017 I received an email from Ideal Hearing Aids with pictures of the aids, completely mangled. The shipping box was in good condition when they received it, just the aids were damaged. They said that they would not be giving me a refund, but for an additional $1000 ($400 not covered by insurance, plus $300/aid), they would give me new aids. I have not paid them additional money.

I filed for dispute resolution with my ***, but Ideal Hearing Aids insists it was the UPS carrier and not them.

We are happy to provide refunds to our customers but the merchandise has to be returned to us in an undamaged condition. As you can see from the pictures that we have attached, we received the hearing aids in a severely damaged condition. Therefore, they are not eligible for a refund.
We received the package from UPS with what looked like the original label that was reattached to a new box with blue tape and the damaged hearing aids inside.
We believe that the hearing aids may have been damaged by UPS, so this issue should be brought up with UPS and not us.

Ideal Hearing Aids did not provide full written terms of their 45-day warranty stipulating the conditions of the devices during return.

I signed a contract stating that

" While CHOICE'S standard insurance billing rates may vary, I will at no time be responsible for any
amount higher than my agreed purchase price of $3598 and I will be entitled to a full refund of the cost of
the hearing aids if I decide to return the devices within the 45 day trial period. "

Federal law (Magnusson-Moss Warranty Act of 1975) requires that warranties be available for you to read before you buy even when you're shopping by catalog or on the Internet.

" As a warrantor, you must designate, or title, your written warranty as either "full" or "limited."
As a warrantor, you must state certain specified information about the coverage of your warranty in a single, clear, and easy-to-read document.
As a warrantor or a seller, you must ensure that warranties are available where your warranted consumer products are sold so that consumers can read them before buying. "

I have searched through Ideal Hearing Aid's for documentation of this claimed 'full warranty' and have not found anything either online or provided to me beyond these above listed terms. Furthermore, Ideal Hearing Aids advertises their warranty in repeated language as a 'full' warranty. Without further documentation provided, the default assumption rests that they are offering a full warranty.

A full warranty, according to this same act, should meet minimum federal standards, including:

" - You do not limit the duration of implied warranties.
- You provide warranty service to anyone who owns the product during the warranty period; that is, you do not limit coverage to first purchasers.
- You provide warranty service free of charge, including such costs as returning the product or removing and reinstalling the product when necessary.
- You provide, at the consumer's choice, either a replacement or a full refund if, after a reasonable number of tries, you are unable to repair the product.
- You do not require consumers to perform any duty as a precondition for receiving service, except notifying you that service is needed, unless you can demonstrate that the duty is reasonable. "

Because Ideal Hearing Aids is unwilling to provide either a full refund (preferred) or a repair free of charge, this is an incomplete sale. In the case of incomplete sales, there is precedence that responsibility for damaged items lies with the seller and not the buyer. Should Ideal Hearing Aids want to seek action with UPS, it is their responsibility, not mine. At this time, however, they also have a contract and responsibility to me as well.

In an effort to provide a solution, I have reached out to UPS and I they have put in a damaged report. A representative from UPS came to the office today to look at the package which we received from Heather *** He will make a determination. I was told that UPS should be contacting me within 5 business days.

I understand that UPS is to be making a determination. Ideal Hearing Aids returned the now-damaged aids, listed that they "refused and did not order the package", PRIOR to alerting myself or Revdex.com regarding the determination of UPS' claim. This is counter to what they said they would do and incredibly inappropriate.
