Ideal Legal and Owner/President Matthew Lyman failed to file court documents for hearing and have caused a financial loss to me in the amount of $6470.00 I am requesting Ideal Legal and Owner/President Matthew Lyman to pay me $6470.00, the amount I have lost due to their failure to provide services paid for.
I had purchased services with Ideal legal and Owner/President Matthew Lyman on November 24, 2019. These services were for filing of court hearing. Ideal Legal and Owner/President Matthew Lyman did previously serve notice to my tenants for a 60 day notice to vacate and two notices of rent due. The payment for services on November 24, 2019 was for the filing of hearing to address these notices. Ideal Legal and Owner/President Matthew Lyman assured me everything was in order and they would contact me with a court date. I was eventually informed by Ideal Legal and Owner/President Matthew Lyman of a court date of December 11, 2019 at 6pm at Niskayuna Town Court.
I did show for court to meet with the attorney assigned to my case and provide any additional information that might be needed during the hearing. I waited several minutes and allowed for court to take course with all participants there for traffic tickets and other matters. When the judge asked for traffic court participants to move to one side of court room I was allowed to approach the judge and ask about my matter. At that time the attorney assigned to my case via Ideal Legal was still not present. The judge explained to me there were no hearings scheduled for eviction for that evening. There was some questioning with the court clerk and it was relayed the attorney’s office assigned to my case did inquire earlier that day if a hearing was scheduled. The attorney’s office was informed by Niskayuna Town Court there was not a hearing scheduled for eviction. This explained why the attorney assigned to my case by Ideal Legal and Owner/President Matthew Lyman was not present. I was publicly humiliated by Ideal Legal and Owner/President Matthew Lyman so I left the court room.
That evening, December 11, 2019, after returning home I phoned and emailed Ideal Legal and Owner/President Matthew Lyman to inform them of their failure and to not take any additional action with my tenants until we could speak and determine our next steps. Ideal Legal and Owner/President Matthew Lyman did not return my emails or phone calls over the next few days. I eventually was able to confirm from the secretary that Ideal Legal and Owner/President Matthew Lyman failed to file for the court hearing and they apologized. I explained I had also requested a refund of my payment and they agreed they would do so and had also received notice from the bank. They have also agreed to send to me copies of the initial work done so I could address with the court but still have not sent to me. As of this date, January 4, 2020, I have not received any refund or the copies of the paperwork. I have also requested Owner/President Matthew to return my calls but he has not returned calls or emails.
Due to the failure of Ideal Legal and Owner/President Matthew Lyman to properly file for court hearing and refusing to provide me with copies of the notices I have been financially impacted by the amount of $6,470.00 and request this amount from Ideal Legal and Owner/President Matthew Lyman. I am now bringing this to the attention of the Revdex.com to get the attention of Ideal Legal and Owner/President Matthew Lyman. I would like to avoid any future negative reviews or legal pursuit for the failure of Ideal Legal and Owner/President Matthew Lyman to file for the services I paid for and have not received.

Ideal Legal Support Services Response • Feb 13, 2020

Greetings, We are in receipt of the complaint from Mr. *** regarding the eviction of his tenants. Mr. did hire our office to facilitate the eviction of his non paying tenants. We served all the appropriate documents on the tenants as we were able to acquire the Court date for appearance without needing to file any paperwork with the Court prior to serving documents. Our office inadvertently had the original documents accidentally paper clipped to another file therefore the documents were not filed with the Court. When this was brought to our attention by Mr. we apologized and offered to redo the work at no cost with a refund of the original amount he paid. He informed us to do nothing at the moment and that he would get back to us. After some time, he called us back and informed us not to proceed. We offered him a remedy that would have the case heard in Court approximately two (2) weeks later. His hesitation delayed the remedy that was offered and would have seen this case heard before a Judge. We refunded the amount he paid back to his credit card on December 13, 2019. We also attempted to fax him all the documents he was seeking from our office numerous times but to no avail, it would not go through. Our experience of close to thirty years has garnered us knowledge of how the Courts operate and what decisions are handed down when it comes to evictions. Mr. was seeking late fees in the amount of $250.00 per month. Although we inform the Landlords that Courts do NOT give late fees, the Landlords still insist on putting those amounts on the eviction documents. Mr. would not have been awarded late fees in this case. Also, Mr. is under the assumption that that Court would fully grant him one hundred percent of the relief he was seeking. Mr. has the opportunity to sue these tenants in a small claims action for the rent and only the rent he was seeking from them in the eviction proceeding. It is our contention that he did not allow us to remedy this situation by having the case heard in Court two weeks later. He also has not filed Small Claims Paperwork against the tenants to recover his lost rent. Many times also Landlords do acquire a judgment for the back rent against the tenants but never recover those rents. Our office has over $4,000,000.00 in judgments that Landlords have not been able to recover from. If Mr. had allowed us to take actions to remedy this, we would not be sending this email to you. Thank you for your time, Matthew Lyman
