Statement # just facts#Randy AG*** never promised this lady any amount for her tools due to the fact that this an auction#looked up the tools we sold for her and they were nowhere near forty thousand dollars new.#The tools sold for this lady were not in clean functional condition, they were dirty, guards and pieces missing and had not been used in years (I have pictures of the tools).#We Sold 250+ individual items which have the paper work to prove and so does she#after the Sale of her items, only spoke to this lady two time, once on Monday May 2, to set a time to deliver check, and on May 3, when she called and ask if we were done Selling her items and thanked me, I have or can get my phone records to prove this.#this lady Signed a contract on her on free will without any promises from me or anybody else in front of me and my helper.#this lady cashed the check gave her which means she received payment and was satisfied.In closingsold this lady items the best manor possible, so she could get the most money out of themI even gathered up small items (bolts, hardware, screws, etc.) So I could make small box lots to get her more moneyAt no time written or verbal was any set amount promised that she would receive for her tools

The client called and ask if I would take a look at her items she had for sale, I did, she asked if they could bring 5,at auctionI told her that she would be lucky to get 3,less my commission at auction due to the fact tools were in rough shape, I was not sure if they worked or if
all parts were there, her exact words were some money is better than no money, need to catch my mortgage upMy crew and myself picked items up 04/15/16, sold half the tools on 04/21/16, then on 04/27/16customer call and wanted her check which informed she would not get a check until all items sold, she then cussed at me and hung up the phone on meOn 04/28/sold balance of itemsClient called me on 05/02/and once again cussed me and she needed her check by 05/03/16, so I told her would expedite her check and drop it off at her house, (so she could pay the mortgage) on 05/03/between 10:A.MTHROUGH 12:P.MSHE AGREEDOn 05/03/AT 11:was at clients house could hear people inside, So knocked on door five different times house got quiet and nobody would come to the door, I left check and paper work in her doorThen three hours later she called and ask if everything was Sold, Said yes and thanked her, her reply was thanks and goodbye, last time I heard from herI am not an auctioneer, I am an auction manager, been doing this for years, and never once promised anybody how items will bring due to the fact it is an auctionThe AUCTIONEER never once spoke to this ladyIn fact she offered to sell the tools to me out right for 3,and I refused offer due to fact was not Sure they would Sell for that muchThe only question I would like to know how or why she would agree sell 40,worth of tools for 5-6,000.00, how she came up with her price on the tools, why if she was So unhappy did she cash the check, and why it took her over a month to file a complaintIn Seven years of running an action house, picking items up and selling was there ever a problempersonally went above my responsibilities to make sure got the most for items buy cleaning, and making Sure what items workedThere are pages x items to a page sold for, showing pieced out everything that was and then some, most places would have sold in big lots due to the condition of itemsI hope this resolve this issueIn closing I did the best job for this client we could do and there is no more could have done for herShe agreed to sell her items with no reserves or without any promises or reservations on my behalf.Thank YouRandy AG***Auction manager

I am rejecting this response because: I have witnesses to the fact that Mr. G[redacted] assured me I could get at least $5,000 for my tools, he knows this was the only reason I allowed him to sell my tools and he never once informed me that my fully functioning tools were in rough shape.  These were tools I used to make wooden items I sold for profit.  These were tools I had been using several months before I had to decide whether or not I could earn enough from them by using them or selling them.  I cashed the check for the  same reason I sold the tools in the first place, because I was trying to keep my home.  I feel extremely violated and conned by this man and I can not believe the excuses he offered for his reason to lowball my perfectly usable items.
