Illinois Development, LLC developed the subdivision Hamilton Meadows a few years back and maintained all common ground including ponds up until we turned this responsibility over to the homeowners association on December 11,
At the
time we turned this over to the association we still had a pond that needed to be finishedThe work on the final pond was done this past spring by Ironclad and we hired Harlow Enterprises to seed and straw the pond
March 12, 2015, I received an email from Jon (Board Member) with a list that looked very much like the one *** sent to me this fall and that is why I posed the question of whether her list was a new list
Jon's email March informed me the last pond installed had yet to be seeded and had some erosion as well as grading and seeding where sidewalks had been pouredI told Jon I would get this work scheduledIronclad fixed the erosion on the pond and Harlow came in to seed but nothing happened with the sidewalksI never heard from Jon again so I assumed the work was completeI was unaware until I received an email from ***
After receiving the email from *** I informed her that we were going back to clean up all concrete and gravel left where sidewalks were startedWe were also going to grade where the sidewalks were poured to take care of the 6" drop off and at that time we would seed everythingWe were also sending someone out to clean up the pond to get rid of the weeds
The issue with the sump pump for lot #would cease once we cleaned up the concrete and gravel left where the sidewalks started (which we stated we were doing.) We also stated we were grading and seeding this areaThe email from the association states our drain is in the correct place and once the concrete is removed and lot re graded the homeowner can move his sump pump line where he wants it to be
Another concern was the association wanted trees in the common area replaced because some of the trees diedMatt in our office replaced or more trees roughly two years ago in Hamilton Meadows common areaPlease keep in mind when a developer turns a subdivision over to the homeowners association, their responsibility ceases at that point in maintaining common ground so dying trees should be handled by the associationThe same is true with all mowing and picking up trash that is left in the ponds or common areaPlease keep in mind it has been three years since we turned this association over

As I stated in my response, we will go out and clean up all gravel and concrete left behind lots 149, and We will grade and re seed this area as well as grade where the 6" drop off is along the concrete walking pathsAll of this will be reseeded when the weather permits
We will reroute the sump pump drain for Lot
I will take another look at the ponds and have someone in our office meet with one of the board members to discuss matters

We do not accept this response because there is not a plan in place to repair the Beal Brook pondsTalk is not enough, we need a plan that outlines how and when the work will be completedWe are requesting that the smaller of the Beal Brook ponds be moved south to ensure a mowable grade from the bike path to the pond banks and around the entire pondWe need a plan in place for the larger of the ponds to also ensure a movable grade from the bike path to the pond bankWe would also accept RipRap rock to be placed from the bike paths and surrounding areas of the ponds
As far as the trees go, we do not accept that it is our responsibility to replace all treesIf these trees were replaced there is no reason they should be deadWe believe there is either a problem with the soil or the way the trees were planted and we request that these trees be replaced and/or the soil be tested to determine why the trees are dying
We are happy to see that work has been done on the bike paths behind 148, 149, 150, etcWe would like a specific date by which the common areas will be seeded and would like assurance that any erosion of the work done over the winter will be corrected
Regarding the sump pump on lot 149, we need specifics regarding how it will drain, how it will be corrected, and how it will impact the neighbors at lot in which the drainage is currently pooling
In addition to all of these things, we would like a meeting with the Association Board to discuss acceptable resolutions to these issues

Matt in our office has been in contact with the association representative discussing treesHe reiterated that even after we turned the association over to them he replaced trees and at the time he replaced the trees everything was livingHe has talked to the association about how he is to fix the sump pump line behind lot Timing will be in the springGround temp needs to be degrees and it will need to be dry enough to get equipment on
We are working with our excavator and landscaper so the pond will have less maintenanceWe will be getting with association in the spring

The reason we are saying no is not because of their reply, but because there is still not a solid plan in place in regards to the workThe only thing Matt has discussed with us is regarding the treesThis is the first we have heard of any thing regarding the sump pump and pondsWe emailed Matt last week regarding information we received from the County Surveyors office and still have not heard backWe have once again requested an in person meeting and our requests have gone unmet
We would like to put this complaint on hold until spring to ensure that the work actually gets completed to our satisfaction and within a timely matter
