should not have paid the claimant 100% of their damagesWe have reviewed our processes internally and will do the necessary training so that our adjusters will be more mindful of comparative negligence issuesThat said, we do not believe that Ms*** was fault free in this accident which involved two vehicles backing up in a parking lot. The other party on the check has a lien interest in the vehicle likely due to a loanThey are listed on the policy as a loss payeeThis means that we have a contractual obligation to protect their interests whenever we pay a claim for damage to the automobileWe would encourage the complainant to contact their lien holder to discuss how the funds may be made available to repair her carIn our experience this is frequently done, though we have no knowledge of the terms of whatever agreement is in place between the complainant and her lien holder
