To Whom It May Concern:
I am responding to the
complaint you received assigned the ID number of ***. The complainant
is correct I (Conrad E***) entered into a verbal agreement with ***
*** the complainantThe agreement was he commissioned me to do
some
wheels first and the price was $a wheel they were completed and he came to
pick them up and began to request information about some cars we had in our
shopHe expressed how impressed he was by the work we turned outHe asked
what the cost was to blast and powder coat the jeep I advised him I had to go
look at it and I would give him a bidHe advised me he had two Harley Davidsons
one being a sportster and the second a fat boy he wanted to trade to repair his
Jeep I advised him I currently have four Harley’s myself, and I was not interested
in the sportsterHe continued to tell me he felt his fat boy was worth 7k and
his sportster was worth about 3kI told him I would entertain the proposal
after looking at themI delivered the
wheels and looked at the jeep in questionI advised him there was visible rust
and the probability of more is great after blasting it we would communicate the
final costI told him to try and sell the sportster and he would be better off
as I was not interested in itHe asked if he could pay for the wheels when the
jeep was done as he was ordering parts and was going to have to dip into his
401k to order the rest of the partsI was giving him cost estimates for the
disassembly and he stated he would disassemble and remove the glassI verbally
left with him understanding the cost was going to be in the 10k* 12k rangeI
also advised him to try and sell both the bikes if he truly thought he could
get that much out of themHe agreedHe advised me he would be pulling the
engine and tranny and refurbishing them himselfHe was going to have to go to
silver city to borrow a motor hoist as he did not own oneSo it would be a
couple of days for him to do so*** called and advised he was unable to get
the engine pulled and would have to wait a little longerI received several
calls and text from *** advising me advising me he was unable to complete the
disassembly and he was opting for my shop to do it I sent one of my employees
to retrieve the jeep the following weekUpon arriving to my shop we began the
disassembly and working on the jeepAfter blasting I advised there was several
other areas that were going to require patch pansHe drove down and saw the
extent and advised us to go ahead and continueI asked if he wanted to
purchase the patch pans or us to fabricate themHe chose us to fabricate them
I again advised it would be an additional costHe brought some lights and I
advised him not to leave them as we would not be doing the assembly because he
could not afford it after ordering the parts he was running out of money and
unable to sell the sportster he wanted to include it in the trade I advised him
I preferred not to trade that as I was not interested if he could get that much
for it he would be better doing that*** brought in a sketch of a paint scheme
he wanted painted or decaled on the jeep I advised of the price he stated he
could not afford thatHe ordered several parts that had to be sent back as
they were ordered wrong, mainly the springs as we could not reassemble the
rolling chassis to begin the next phase being the body work and paint as it
required the chassisAfter receiving the chassis back from powder coating we
attempted to install the leaf springs and they were clearly the wrong ones he
came and picked them up along with the shocks and ordered some new ones***
could provide the receipts so the date of the re order could be established***
then advised he would like the axles to be painted as wellI advised him of
the cost and he did not have a problem with itWe finally got the correct parts
and installed them called and advised we would be delivering the jeep the
following dayI advised the cost would be added to the *** for the engine
installation and he agreedHe continually was adding work to the project and
acknowledged there were going to be additional charges and now is unable to pay
for the work doneWe received a work order from one of the local hospitals the
burst disks on the oxygen bottles were rupturing due to the heat and it was
prioritized in front of the jeep due to the nature of the importanceI received
several late night texts from *** and the next day would receive apologies***
and his wife came by and wanted to know about the jeep I advised them I would
be a day late gave them the *** and asked how they wanted to settle it before
the jeep was deliveredThey did not seem to have any problem the jeep was
loaded and was going to be delivered at this point it went from bad too worse
At this point due to the work load I did not want to debate this and advised I
would be forwarding the case to our attorney *** ***At this point we received
a call from the attorney general’s office and I reiterated the actions taken by
my shop to collect on the work completedHe thanked me for talking to him and
stated I was with in my rights to do what I was doingI also advised him a
storage fee was going to be added daily for the space the jeep is taking and he
stated that was also understandableI have received several calls from *** and
his wife and a lady that was representing them I advised her I would not be
discussing the case with her if she is not their attorney or had written
approval from them for me to do soI contacted *** one last time and advised them
we could settle for the two bikes and I would give them in cash***
stated he sold the bike and could not afford to pay for the rest of the ***I
advised him they would be paying storage for the vehicle till it is paid for in
fullWe do have two signs that state anything left over thirty days would be
sold for the cost of the remaining ***At this point I will not be trading
anything I just want to be paid for the work done I just want to be made whole
and no longer be inconveniencedI have recorded all conversations when this
began to go southIf you need a copy of them I can forward them to you
I was plasma cutting some
aluminum on the cnc on August and ***s wife walked in the rear door I
startled her when she saw me began to be confrontational and I advised her to
leave the premises and she was no longer welcome on my propertyIf she had any
questions she could contact my attorney
