Initial Business Response / [redacted] (1000, 7, 2016/01/14) */ Contact Name and Title: [redacted] Contact Phone: [redacted] Contact Email: ***@imagesagency.com Ms [redacted] came in with her daughter on Nov for her initial interviewIn her interview process she expressed that she really wanted her daughter to do this The director talked to her by phone on Nov about what to do about registering with the agencyIn that conversation the director talked about some workshops and photos Nov 19th she came in to register her daughterMs [redacted] was short on funds and the director worked with her by making paymentsThe contract that she signed dated 11/19/states that she is getting Tiny Tot classes, hour eachThe director did talk to her about photos and discussed trying to keep the costs down...they decided to make payments and talk about photos after she completed a couple of classes Dec her daughter went to a one hour classDec Ms [redacted] called the director and said she couldn't afford this and wanted a refundThe director went through the refund policy with Ms [redacted] The director asked her to consider putting this on hold so she wouldn't loose the money since she already took a hour workshopShe asked her to think about it and call her back Dec 28, Ms [redacted] called back stating that she decided to withdraw from the agencyThe director told her to send a certified letter stating that she is requesting a refundOnce accounting receives the letter a refund will be issued Her certified letter is dated Dec 30, The accounting department received the letter on Jan 4, and a refund was issued on Jan 5, Her check cleared my bank on Jan 12, Ms [redacted] was informed about everything and continued with the services we offered I understand if you change your mind, the refund policy is described in the contract that she signed and was executed with a refund to her

Complaint: [redacted] I am rejecting this response because: They couldn't get a hold of me because I was busy trying to help my mom with my dad He's nearly died twice with trips to er two of which he was in ICU and I can get medical records to verify that So excuse us for not thinking of the stupid modeling agency They give every person that walks in that door some kind of discount the fact that it was for enrolling two kids shouldn't even count to begin with that in itself is bullcrap; and yes until now I've not bothered with it because I've been to scared that my dads going to die and doing all I can to help my mom through such an emotional and physically draining time Also I sent three emails about my refund before I received ONE saying to look at the contract and that she'd notify the financial department I then replied saying I read the contract and would be sending a Certified Letter post haste which I did I have the emails to back ok this up including the first three before I even heard back and I got the tracking number on my post office receipt about the letter Also I recieved again ONE letter stating I couldn't get a refund due to a bogus discount Even though it's bull crap I would take which is 20% taken from the for whatever bull they'd say they're taking it for and go on with my life I have contacted kidscasting which is where I heard about Images Agency and they agreed it was a scam and they took them and blocked them from their website; and they'll be sharing the information as will I I'm also going to be speaking with a lawyer to see what I can do legally and what process I need to take to sue them which once I'm done they'll be paying my lawyers fees plus whatever my lawyer thinks they should be for the additional emotional distress since I'm literally watching my dad die because you can add emotional damage plus what the person owes you I use to work for a lawyer I know what the end result will be and I will end up with my money I'm also going to print out flyers about the scam this agency is and post them all through out the city I have kept every email and I can prove EVERYTHING I've said So I decline Images Agency response due to it being a bunch of bull pulled out their butts kind of answer Thank you Sincerely, [redacted]

I just received Ms***'s email stating that she didn't want to follow the contract dated 4/4/17. As stated in her email on 6/3/17, she acknowledges that Images has been trying to get a hold of her since 4/15/ On one of the phone calls *** talked with her mom explained the
situation to our Director but made no mention of refunding or wanting out of the contract On 6/4/17, I received an email from her stating that she was going to send a certified letter cancelling the contract and *** was going to forward her emails to the accounting department As of 6/6/@ 7:23pm, I wrote another email to Ms*** stating I had not received her notification but I wanted to follow up on her request of a refund I stated in the 6/6/email, per the contract, *** gave a discount therefore it was non-refundable The discount was given because she enrolled children in the same family and both children wanted to get involved in this industry Ms*** had hours from signing to get a full refund, but waited weeks to email us that she wanted a refund She acknowledged in 6/4/email, that she re-read the refund provisions and will be sending a notification to get out of her contractThe part of the refund stating it is non-refundable was even initialed that she understood it was totally non-refundable after hours. Both signed contracts attachedContracts are to protect the consumer and the business It is sad when the contract is not respected and it is only a one way street To resolve her complaint, I will refund $

I am rejecting this response because:

Dec 12 her daughter went to a one hour class. Dec 19 Ms. [redacted] called the director and said she couldn't afford this and wanted a refund. The director went through the refund policy with Ms. [redacted] The director asked her to consider putting this on hold so she wouldn't loose the money since she already took a 1 hour workshop. She asked her to think about it and call her back.
Dec 28, Ms. [redacted] called back stating that she decided to withdraw from the agency. The director told her to send a certified letter stating that she is requesting a refund. Once accounting receives the letter a refund will be issued.
Her certified letter is dated Dec 30, 2015. The accounting department received the letter on Jan 4, 2016 and a refund was issued on Jan 5, 2016. Her check cleared my bank on Jan 12, 2016.
Ms. [redacted] was informed about everything and continued with the services we offered.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. Hey I have a complaint I filed regarding Images Agency from St. Louis Missouri. It's marked I declined their response; but I accept. They didn't give me a whole refund and did take more than they should of; but I accept it. As long as the check clears I'm good. I still don't recommend them and say they're lying scammers. However, they did give partial refund.
