Review: Bought a new phone on Dec 1 2012 - only to find out from Corporate Spring the phone was not new but refurbished.

On 12-01-12 I bought a EVO 4G LTE (BLACK) "new" and later found out from Corporate Sprint the phone was not a new phone but a refurbished phone. My receipt states new phone.

This is FRAUD - they sold me something, it which it wasn't.Desired Settlement: I would like to be refund for the phone - since it was sold under false pretenses.

After reviewing the complain, I immediately checked our shipping and receiving history of this device, and it was only activated on one line and that was for ms. [redacted]. Thereafter I called Sprint Dealer Support Line, and requested to know if this was correct, and they verified that the first time this device was activated was on 12/01/2012 Ms. [redacted] account; thereafter this phone has been activated on different other accounts, but this is out of our control.miss [redacted], had the following ESN#

Also Ms. [redacted] was the very next day of this purchase in our store, and bought another EVO LTE in white. All customers have 14 days to return devices for any reason (other than physical damage), therefore we will not accept a claim from 10 months ago, specially after this device is no longer in her hands.

The sprint representative [redacted] agent ID # DEXXXXX verified that all this information is correct, and at the time of activation, this was indeed a brand new device.
