December 22, Re: Complaint ID Number [redacted] To whom it may concern: Mr [redacted] moved out of [redacted] Apartments on November 03, The Final Account Statement was mailed on November 21, to his last known address of [redacted] ***, San Antonio, Texas *** On or about December 02, 2014, Mrs [redacted] called to the Corporate Office to dispute the charges on her FASWithin the last two weeks Mrs [redacted] called the corporate office three times, she spoke to Mrs [redacted] ***, Mrs [redacted] and Mrs [redacted] Mrs [redacted] advised me of Mrs [redacted] concerns regarding her move out chargesOn December 15, 2014, Mrs [redacted] called the corporate office and spoke to Mrs [redacted] , Mrs [redacted] was placed on hold, and Mrs [redacted] asked me ill had a response for Mrs***I picked up the telephone and immediately apologi*ed to Mrs [redacted] for the delay in getting back to herAt that point, I informed Mrs [redacted] that I had requested pictures of the condition of the unit and that I would forward the pictures to support the damages on the FASMrs [redacted] then notified me that a verbal agreement was made between her and the Community Director, [redacted] that it was not necessary for Mrs [redacted] to clean the carpet because the carpet was going to be replaced, which Mrs [redacted] disputesMrs [redacted] began using profanity, tasked her to please refrain herself from using profane language as I was conducting myself in a professional manner and that I would expect the same from herMrs [redacted] then hung up the phone on meI immediately called back and asked her for the name of her employer, she proceeded to say that I had no business contacting her employer as these were two separate issuesI informed her that her employer had all the right to know how she was conducting herself and using profane language, perhaps in front of the residents and co-workers in the work place, which is a place of business and where she was calling fromBy this point, Mrs [redacted] was out of control and would not allow me to speak so I ended the callMrs [redacted] immediately called back and requested to speak to Mrs [redacted] , President of Implicity Management who was not available at the timeThe very next day, Mrs [redacted] filed the complaint with the Revdex.comThe FAS was revised to remove the Accelerated Rent Charges due to Company Policy and ProcedureAll other charges will stand as isAt this time, there is no refund due to Mrs***, her current balance is $If Mrs [redacted] is able to provide a written statement or a move out Inventory and Condition Form with her signature and the Community Directors signature regarding the carpet, the charges will be removed, until then no additional charges will be removedAttached is a copy of the original FAS, revised FAS, Move in Inventory and Condition Form and photos to support the carpet damages As a CPM Candidate, lam held to higher standardsThe written statement that Mrs [redacted] provided is not accurateIf you have any questions or concerns, I may be reached at ###-###-#### [redacted] Implicity Management Company

Complaint: [redacted] I am rejecting this response because: I ma rejecting this because I left my forwarding address as well as when I spoke to the people in the main office they did tell me the forwarding address that I left on my move out letter which was the [redacted] addressBut now apparently I didn't leave one? I no longer would like to talk to this regional from [redacted] I need to speak to someone higher because I know what was said as well as I called her from my personal number [redacted] and that's the same number she called me back atI've left Nemours messages with the front desk lady to have the president call me back because this run around isn't professional of this so called regional as well as her calling me back asking for my employer when I was on my personal time on lunch not even in my office so speaking was not rightI will make sure this issue gets resolved with someone higherThe Fas never got to the [redacted] address either so right there I know for a fact nothing was sent out due to I was dealing with corporate so how was it sent out if it was under investigationI will be reaching out the Apartment Association Regards, [redacted] ***

This email is in response to the complaint submitted on 05/18/17 regarding Timber Ridge Apartments.  We are grateful for the opportunity to respond and explain the our side of this case.  We first want to sincerely apologize for this internet interruption.  Our goal is rectify this...

case and have internet restored and functioning as it should.  Unfortunately, the Timber Ridge staff is not trained in this field and is at the mercy of Spectrum Cable since it is their equipment.  Only Spectrum can update and modify the wiring necessary for it to work like it should. As soon as this complaint was received, I contacted [redacted] an Account Executive with Spectrum Community Solutions, on 5/23 via email and by text.  On 5/24 she texted back that she spoke to the Technical Operations team and this issue was already escalated to the maintenance team.  All contact information was provided for the resident.  The Spectrum team did reach out and sent a supervisor out to access the issue on 5/25.  Due to the long weekend, an update of this case from Spectrum was not available until today, Tuesday, May 30th.  [redacted], a Texas Area Manager, notified management that they will need to run wiring on the outside of the unit.  Management has given them permission to proceed with necessary repairs with the supervision of the Lead Maintenance at Timber Ridge.  This work will be completed by the end of this week or June 2nd.  [redacted], the Property Manager of Timber Ridge, is being copied and will be updated on the service repair to this unit.  Please let me know if I can be of further assistance.

I have concluded that there is apparent miscommunication and perhaps a perceived unprofessionalism and would like to apologi*e for any misunderstanding. Due to the forwarding address discrepancy and Ms. [redacted]’s statement of not receiving the original FAS (Final Account Statement) all additional charges have been removed.  Moving forward the FAS reflects only the balance that was left on the original ledger in the amount of $316.21 reflecting Electric charges, Gas charges, Water charges, Rent charges, and a Month to Month Charge of $5.00. The received security deposit offset $300.00 of the balance leaving the FAS to only reflect a delinquency of $16.21. Implicity Management would like to apologi*e to Ms. [redacted] for the difficulties she faced in reconciling this issue. Attached are both email correspondence with the resident.  This occurrence was on Thursday the 14th.  When she called numerous times to theanswering service, this type of call, though unique, was not on their list of reasons to notify neither maintenance nor management. ...

This is why the Manager did not respond.  The Manager had no idea that there was an issue in the middle of the night until the following morning.  Therefore, the Manager did not purposely disregard her complaint or concern as the resident assumed.Management explained to the resident that we will let her out of her lease with a 30-day written notice and she will not be charge penalties for breaking the lease.  To this date, we have not received her writtennotice to vacate.  The resident will be charged rent through her 30-day notice.The day of the incident, the resident came into the office and apologized to the manager for her tone and frustration.  The Manager also apologized to the resident for this occurrence and how it was handled.  They both shook hands and as they both understood each other’s prospective.  Management did offer to show the answering service call log to the resident, but the resident refused to look at it and said that it was okay and not necessary.At this point, the apartment hole was repaired and bids were obtained and approved to rectify the rodent issue.

<[redacted]>; [redacted] <[redacted]>; [redacted] <[redacted]>Subject: ID [redacted] regarding complaint submitted on 04/10/17Importance: HighTo whom this may concern:  This email is in response to the complaint submitted on 04/10/2017 regarding The Lodge at Perrin Creek Apartments.    We are grateful for the opportunity to respond and explain the other side of this of this case.  We first want to sincerely apologize for any miscommunication and misunderstanding when Mr. and Mrs. [redacted] were moving out.  Our goal is to treat all resident fairly, equally and impartial.  Additionally, we want to provide a clean and as new as possible apartment when a resident move in.  The complaint states that [redacted] assisted with the move out notice and suggested renting a shampoo machine to clean the carpet.  What may have not been disclosed or discussed with [redacted] was that the resident had a puppy in the apartment.  So renting a shampoo machine is futile for this situation as a professional is required to shampoo the carpet when a pet owning resident moves out.  At the time of their move in, this carpet was brand new.  As you can see by the attached photos, there are pet urine stains on the carpet, pad and the concrete floor.  These stain can be found in the dining room and bedroom area.  It is too soon to get a copy of an invoice from the vendor.  We would be happy to disclose the amount once completed.  Implicity does not pad or gain income from damages and will only charge for the fees management was charged to shampoo and treat the concrete, carpet and padding.Attached the portion of this resident’s Pet Addendum – reference # 19 Move-Out:  it states: when you move out, you’ll pay for de-fleaing, deodorizing, and shampooing to protect future residents from possible health hazards, regardless of how long the animal was there. We- not you – will arrange for these services. It’s in her lease that she signed and agreed to.The estimated amount quoted was between $50 and $100, which is not an unreasonable amount for a Pet Treatment.  This is charged for the protection of the new resident who may be allergic to dander or who may have a pet that may want to mark their territory after detecting prior pet urine.  Additionally, the pet deposit of $250 was waived upon move in since they unfortunately gave notice soon after moving in.  The $100 pet fee she was charged (in lieu of a normally $200 non-refundable fee) is a fee and should not have been considered a deposit which would be applied to damages in this case.  This non-refundable fee is ancillary income. We will have this account finalized by the end of April and will provide Mrs. [redacted] a Financial Account Statement with a balance or refund for unit # [redacted].Please let me know if I can be of further assistanceSincerely,[redacted]Regional Property ManagerImplicity Management Company[redacted]
