I agree with more or less everything stated in the complaint- the difference being that after alleged failed attempts to splice irrigation, we replaced the entire drip system. It should also be noted that the existing drip system already had multiple issues prior to our arrival, , including leaks...

and cracks due to aging. In regards to the plants- I do carry a 1 year warranty on everything we install. However, I am not liable for acts of Mother Nature (such as temperature extremes), b/c I have no control over them.  As an act of good faith, I still replaced most of the plants.After receiving the final call from homeowner, I consulted my irrigation contractor and we decided to meet one last time to correct any remaining issues. I issued a call to homeowner, but it was never returned. I never heard anything until several months later, which was this complaint.

It is untrue that the business replaced the entire drip irrigation system.  They did send out a repairman, but he only spliced the system.  I had to have the entire system replaced and was shown the ole pieces, with multiple splices noted.  The owner  just kept sending out his repairman who added more splices.  The owner never mentioned to me that the system was old or needed replacing.  The system was seven years in the ground when they tore it up removing bushes.  The owner replaced some bushes but not all.  They came out to install new bushes/trees on an extremely cold day; temperatures in the teens.  The bushes had to wait on the open trailer most of the day while old bushes were removed.  The bushes died before they ever hit the ground.  The owner may not be able to control the weather, but he can control how he handles bushes/trees before they are placed into the ground.  The error was in judgement with allowing the plants to remain in the cold temperatures, unprotected, for most of the day.

 The company failed to fix the damage they did to my existing sprinkler system.  The company was called by me several times, asking for this system to be fixed.  Each time the company sent out a repairman who spliced the existing line.  Small sections of this line may have been replaced, but the line was never replaced.  Each time the repairman left, the system was leaking again within a few days.  The owner once again was going to send out the same repairman to complete more splices.  I informed the owner by phone that this was not acceptable to me, but he left me yet another message informing me of the plan to splice again. The person I hired to fix the damage did replace the entire line, and showed me where the existing line was spliced and continuing to leak.  I chose to deal with another person to handle this repair, and am not asking for reimbursement for this cost.  However, in the process of this repair and replacement of the dead bushes, the existing mulch was destroyed. I think it reasonable for the company to replace the mulch due to the failure on their part to repair the sprinkler system prior to original placement of the mulch.The palmetto palm would have lived and thrived  if it hadn't been allowed to freeze on the truck prior to planting.  This is the Palmetto state; many of my neighbors have these trees growing healthily in their yards. The palm died for the same reason the other bushes died, negligence on the part of the company's employees.  Replacing the bushes and the palm due to the company's negligence is reasonable.  I gave the owner ample time to do what was right: permanently fix the damage to the sprinkler system and replace the dead bushes and palm. The company replaced part of the bushes, omitting three bushes and a palm.   The owner promised to replace the three bushes, but never called back to communicate a new plan on replacement of the final three bushes.  The customer questions why the owner waited on her to contact him, again, instead of making an effort to fix their error in a timely manner. For these reasons, I believe my requests are reasonable: replace the three bushes and the palmetto palm, and replace the mulch.
