The manufacturer’s guideline for stone for that size pool is 75 ton, but due to the yard conditions extra stone was required (an additional 104.28 ton).Reference #3 of Contract... “in the event that construction materials other than those specified in the Contract or those that exceed manufacturer’s specifications (gravel, drainage material, jackhammer or blasting, etc.) are needed to complete the construction the Homeowner will be billed accordingly”. In order to resolve this matter and in the interest of good customer relations we have offered the [redacted]’s an $850 discount on the additional materials and labor. Once payment is received we stand ready to complete the project.

I am rejecting this response because: at no point during the purchase of the pool did we assure anyone at Aqua Leisure that the pad was level. My wife was the one who submitted the order for the pool. When asked by the salesperson, Tom, about the area where the pool would be placed, he asked her if the pad was level and she responded she believed it was but wasn't certain. In fact I forwarded a picture to her via text of the pad and the salesperson, Tom, indicated that it would be fine.

[redacted] purchased an above ground swimming pool and requested we install it on a concrete pad. This is not an issue as long as the concrete pad is level. [redacted] assured us it was level. When we arrived at the yard the pad was out of level approx 5". The pool could not be installed at the...

location and [redacted] selected another location. Unfortunately that location needed a considerable amount of excavation and as per his contract there is an additional charge.
