I apologize that this response is later than the days requested for a responseOn 5/20/my helper and I came to your home to install a microwave and a couple of cabinets During that time you wrote that you would like me to look at your bathroom shower/tub combination as you needed the valve replaced as it was leaking I looked at it and told you that in addition to replacing the valve; the tile was in such bad shape that we should just do the entire shower I explained that we could do this work (we have another company that provides custom bathroom remodel) and that I would give you a bid to do not only the shower/bathtub combo but include the microwave and cabinet installation as well The bid would be inclusive of all labor, material and trash removal You agreed to the written bid and signed off on it (please see attached bid) You wrote that you would tile the shower walls We did the microwave and cabinet installation and then went to purchase all the material to do the shower/tub area We demoed the shower area cutting out only the sections of wall where the tile was, thus, leaving existing drywall on the sides We removed the old tub and valve We started the reconstruction of the shower/tub area by installing a new shower/tub valve (faucet) along with a new shower head stem Then we installed a new tub (60” standard size) When we installed the tub, we discovered that the framing of the walls around the tub left an opening of 61” or 1” too big The opening should have been 60” so that the tub would fit snuggly into the opening In this situation, we center the tub, leaving an equal amount of ½” on either side of the tub The DensShield sheets were then installed on top of the tub lip as they should be In the piece of DensShield that we installed on the wall with the plumbing (faucet and shower head stem) we cut two holes so that after the tile was installed by you, you could put the trim kit on and the shower head Those items would cover both of the holes One of these holes was the one you referred to as “the size of a fist” The other one was about ½” in diameter They were cut with a hole saw, and not randomly punched into the DensShield In addition to screwing the DensShield sheets into the wall studs, we caulked all the seams and then applied RedGard to the entire area to make sure that there would be no water penetration This is the “red paint stuff” you refer to It was put on the entire new backer and overlapped the drywall slightly in preparation for the tile which should be installed slightly past the backer The “marble” that you refer to in the window was removed and backer installed, again in preparation for tile that would be wrapped inside the window When installing the tile, which you said you would do, the tile should be set on the tub surface therefore covering the gap that you say was ½” When we finished the job on 5/21/16, you were home You looked at the finished work and said you thought it looked good; you were happy with it and gave me approval for final payment You also gave me a vase with flowers in it for my wife The vase was subsequently returned to you at a later dateOn 6/1/16, you called our office via TTY and demanded that someone come out to look at the microwave door and shower/tub work That was the only call we received between the time we finished the work on 5/21/and when you called via TTY on 6/1/ I only have one person in the office and she answers all calls and picks up all messages from missed calls There were no messages from you During the 6/1/call, [redacted] scheduled me to look at your projects at my first available opportunity which was 6/6/On 6/6/16, I came to your home and looked at the microwave I told you at that time that I had made a mistake and would fix it I called our office and [redacted] booked you for 6/8/for the repair, which I came and did at no charge of course as it was my mistake Also during the 6/6/apptI looked at the shower/tub I tried to explain to you what we had done, which you had already looked at and approved I then asked you to get me a piece of the tile that you planned to install so that I could physically show you how it would work You then brought me a sheet of mosaic At no time prior to this did you indicate that you were thinking of using mosaic Mosaic would not work in this application which I told you and that’s when you got agitated, stormed off to another room and started crying At that point, I didn’t have many options You were not willing to discuss the matter and told me to have a nice life.Three months after we started the project, on 8/25/16, [redacted] said that you called the office She could not understand what you were saying and was getting ready to leave for an appt., so she said she would call you back via TTY when she returned to the office later that day When she got back, there was a message via TTY from you again saying that you had tried to reach us many times to schedule the Bagster pick-up Again, no messages or calls were taken prior to that day [redacted] scheduled piright away and when [redacted] came to pithe Bagster there were paint cans in it [redacted] does not pick up hazardous material [redacted] called both your cell and home numbers (both of which do not allow for a message to be left) and you did not answer either one [redacted] then went to your home and a young man answered the door and said that [redacted] had told them that they had to take the paint cans out She returned your vase at that time During her visit to your home, she looked in the Bagster and all she saw was the material, tub etcthat we had originally removed (plus the paint cans of course of which there must have been a dozen or so) If you removed all of the DensShield that we installed and started from scratch, then I would expect that that material would have been in the BagsterWe do not feel that any money is owed you as we did the job we said we would do; did it to a level that exceeds the [redacted] ’s standards and you approved and said you were happy with the work I would question why you decided to hire us in the first place if you had a bid for $for the microwave and cabinets [redacted] very specifically told you it would take (2) techs 2-hours to do this work at $per hour Our price potentially would be higher than the other bid We would request pictures of the work we did prior to you tearing it out so that we can speedily rectify this situation I would assume since you are asking for restitution, that you would have taken pictures to justify it [redacted] ***

I am rejecting this response because:his time table is incorrect and the work was not done correctly My neighbor was there when he came back to see his mess he left me withThere was no way to tile it and my neighbor agreedAnd yes I have pictures Alot of picturesAnd that board you used , it was in the bagster, under the tubYour account of what happened is far from the truthBut I would not expect you to be truthful How about you tell the people about how you threatened to leave when I asked you to listen to meYou asked me to post on public media about the job you didI don't think you want me posting pictures of that mess, but I would be more than happy to do that for you!
