The property manager makes the residents pay for three months rent if you don't sign another years lease!

At around about 21:hours on April 2, I *** arrived at Independence Park Apartments, ***My business there was visiting my goddaughter and assisting her in moving in new bedroom furniture assembly and set upI parked My New silver Nissan Altima with a day tag on the left side of the building parking lot where there were about four visitor parking spacesMy vehicle was parked on the same side where there were visitor parking in line with other vehiclesThere were no signs posted of any warning parking violation where my vehicle was parked and my vehicle was parked straight between the white lines, not in any violationsThe only sign of information at and where my vehicle was parked was white paint on the parking area stating visitor parking
At 01:29, April 3, hours my goddaughter mother and I came outside to leave and found that my vehicle was not on the lotI called and request for a ***

I have been a tenant of Independence Park Apartment for 3 years now. I have always had a problem with the apartment and now that I am trying to leave the property, they are trying to take unnecessary money out of me using made up rules and regulations. In February, I received a letter from the new property management stating my lease was going to expire May 3, 2015 and gave me various options on what would happen if my lease was renewed. Based on the letter received (copy available), I assumed I had two months to have my belongings packed. I spoke to the leasing agent and she did tell me my lease was up in May and if I renew before the end of the week, I could take advantage of the special. After taking the time to review the special, I felt as though the opportunity was not worth me staying in the property. They were going up on the rent and the cable which I found to be too costly in a complex that cant even properly fix my air conditioning or answer the office phone. I called the property and left a message letting them know I was not going to be renewing. As always (and stated before), no one called back or took the time to listen to my message. When I dropped off my rent for the month of March, I included a copy of my lease termination letter, stating that I was not going to renew the lease and I would have my stuff out and keys turned in by May 3, 2015. After receiving my letter, the leasing agent called me stating she has prepared the lease and asked why I changed my mind. I told her that the apartment was too expensive for what they were offering and I can be out by May 3, 2015. She then said Oh no, Ms. [redacted] your lease is not up until June 3, and I told her my letter said May 3. She said yes it said May 3 because she had to do a lot of renewal letters and she just used the same date. I told her I had already planned to be out May 9th but I would not break my lease and continue to pay. Upon receiving the letter that my lease was up May 3, 2015, I went ahead and took care of an emergency that I had and was not expecting to still have to pay rent after April. The final day to pay May rent was May 5 and since the 1st of the month I tried several times to reach out to the apartment about my May rent. I was trying to reach them to let them know I had an emergency and would take care of the rent and late fee by May 14, 2015. For 10 days I kept trying to call over and over and also left several messages on the office phone. During this time, not a single person answered the phone, nor did I receive a single call back Today May 13, 2015, I called the office around their opening time and once again no one answered and I left a message for them. I received a call from the office around 10PM thinking that someone finally returned my call. The leasing agent on the phone said she was not returning call; instead, she was calling me because she wanted to know when they would receive my rent. I told her I had been trying to reach the office and that I would have it to them before they open the office the next day on the 14th. The agent then told me that she is going to court by 12PM and if she does not get the money by then the issue would be left to the courts. I told her that I am asking for her to wait until tomorrowbefore she even opens the office, the money order would be waiting for her. She became disrespectful and at the time I asked for the corporate office information. She then told me the corporate office was called 42 and their phone number is ([redacted]. After getting off the phone, I called the cooperate office and told them what was going on, the lady on the phone said she would call me back. I waited all day for a return call, and around 12PM, I still hadnt heard from them so I called again and left a message. I still did not hear from them and then I called back around 3pm and still left another message.Around 4PM, the district manager called me and after examining the situation to her, she said the process was to go to court. She then told me they called the tenant, and if tenant does not pay they will continue with court processing. I told her that did not make sensethe leasing agent told me she was going to court at 12PM and if I paid the rent and late fee before 12PM, the court fee would not be charged. She said no she had already gone to court but was calling to confirm I was paying. I told her I could not pay until tonight and once again they never called me again for the remainder of the day and by then, it was too late to find money to pay them. During the conversation we had around 4PM, the district manager also told me that she talked to the leasing agent and if I can pay the rent, late fee, and court fee they would stop all processings. I told her I was only prepared to pa the rent for May and the late feecourt costs are not in my budget because I do not have the means to pay for them. I told her I would have to appear in court myself and let the judge know what was going on. My complaint is that the apartment seems to be taking illegal measures to get more money out of the tenants. I figured I would start with the Revdex.com and then go as far as I can with letting any tenant or future tenant fall in the trap of these people. They sent me a letter telling me my lease is up May 3, but on the phone told me it was actually up in June (because, as I have previously mentioned in the text, the leasing agent told me she didnt feel sending the exact date individual leases were up, so she only made on letter and sent it out).The agent then tells me that court papers will be filed and we have filed it. The new property management did not give up information on rental payment and late fees, and now they are lying to get money out of tenants. I will be paying what I owe, which is $803 and includes the rent and late fee. I am not going to pay an imaginary court cost just because the apartment feels as though they can find random fees to charge methey are under capacity and broke anProduct_Or_Service: Apartment LeaseAccount_Number: [redacted]Desired SettlementI would like to pay my past due balance and the late fee, without paying an imaginary court cost. I would also like for my statement to be displayed for the public so that any perspective tenants can be warned ebfore signing any new lease.Business Response All residents of Independence Park Apartment Homes sign a lease agreement indicating agreement to the community terms and conditions. Rental payment terms stipulate that residents are required to pay rent on the 1st of each month and are charged a late fee of 5% of the rental amount the day of the 6th.Legal action may be taken against any persons in default of the lease agreement as stipulated in the agreement signed by the complainant on 12/11/13. Legal remedies are outlined on pages 9 and 10 for the failure to pay rent, up to an including the filing of eviction. Further stipulated in paragraph 38, F-1, the resident shall pay late fees, court costs, attorney's fees, and any other monetary damages or costs arising under the terms of the agreement. The fees the complainant is refusing to pay are the legal fees incurred by the management company to file legal proceedings due to failure of the complainant to pay rent according to the lease agreement. The complainant's case is now pending with the courts and a judge will decide the appropriate course of action.
