Review: We had timber cut on our property last year by Independent Timber. The contract we signed with Independent Timber assured us that they would compensate us for any damages, and we were personally told that any vehicles or items we had in the area they were working would not be damaged. They destroyed numerous automobile body parts and other items. They also damaged a porch on a cabin by striking it with a tree and left trees on the roof on one of our barns. We took pictures and gave a list and cash value of the damaged items to David Hill of Independent Timber almost a year ago and have not even received an offer of compensation. This is our last effort to avoid filing suit in court.Desired Settlement: A cash settlement compensating us for the property damaged and destroyed.

We are responding to your letter of November 25, 2013, regarding a complaint.

Independent Timber entered into a contract with the complainant to purchase standing timber and oversee the logging of the timber.

Independent Timber did not actually harvest the timber but hired an independent logging contractor that was well known to us and had cut several other tracts for us satisfactorily. This contractor carries all the workmen's compensation, general liability, auto insurance, etc., that we require.

The automobile parts that were supposedly damaged were sold by the owner before we were able to inspect them. However, pictures provided by the owner to us were shown to a local auto parts/scrap dealer in Danville, who told us they would be worth +/- $300.00.

Also, we inspected the cabin porch the owner claimed were damaged and could not find any supporting posts, roof, etc. that appeared to have been damaged by the logging crew.

As for trees/branches left on a barn roof, we do not recall seeing these.

We personally supervised the logging job which we felt was done properly. We would have no reason to say otherwise since the logging contractor would actually be held responsible for any damages.

We plan to contact the landowner and discuss a settlement that will be fair to all parties.
