This is complete lies and fabrications, I have the pictures to prove itI left that apt in better shape than when I moved inI took many many pics to prove itThey can't even tell the truth about the color of the wall, because one of the maintenance personnel of the property felt bad for me and gave me a bucket of paint for the wallsIt doesn't look exactly the same because I lived there for over a year and the apt wasn't painted before I moved in, so of course the walls wouldn't matchThey told me before I moved in they always repaint the walls when a tenant moves out which is a big lieI was tortured in that apt with scalding hot water and the list is a mile longI'm a very honest person and these people lie about everything because the contract is written so as a tenant has no recourseI don't know how these people sleep at night, I was miserable at this place and I left it perfect so not to have this issueGary L C***

Complaint: ***
I am rejecting this response because:I have had to complain about my neighbors for over months and this was finally the resolutionI was told that there would be no out of pocket expenses for me including utilities transfer fees. This was relayed to me by *** who said that they could take care of the electric transfer fee if there was one. She did say that they could not participate in optional services transfer fees such as cable, internet or in paying for my drivers license to be updated. Because of the lack of customer service I am requesting that they should in good faith pay for my moving expenses as wellI can lower the total request to $as I have been able to have *** *** company lower their transfer fees from originally $down to $The other $is the expense for my moving company

To whomever it may concern,It has been brought to our attention that a previous resident of our community, Gary C*** is under the belief that the charges taken from his security deposit were unwarranted.I wish to address the validity of the charges by providing photo evidence to the damages
left at move out, and providing background information leading up to move out.It is standard procedure for a pre-move out inspection to be conducted with office staff prior to the resident returning keysThis is done in order to make the resident aware of any items in the home that could result in charges at move out if not resolved before turning in keys.Per Indigo's lease agreement there are restrictions on alterations allowed to be made to the homeSection 31explicitly states that "resident agrees to refrain from making any alterations to the unit and premises; including but not limited to...paint in the unit."Several months prior to giving notice, Gary mentioned that the previous Business Manager, Sara Ferguson, authorized him to paint in the homeHe claimed that she also told him he would not incur any charges to have the unit painted back.On February 6, I reached out to Sara F* for clarification on the matterWhen asked if she had made said statements she informed me that she did allow for Gary to paint his home, but "he knew he was responsible for painting it back, or getting charged if he didn't."I contacted Gary via email the next day to let him know that "At move out, the cost incurred to have the home returned to its original color will be billed to you."On March 15, a pre-move out inspection was conducted by my-self in Gary's presence. In the kitchen, living room, and bathroom I observed and notated the blue accent walls the resident had paintedI again made the resident aware that the apartment would need to be professionally painted back to the original color, and that we would do so at move out.Gary asked for us to provide the paint for him which I declinedI did email him the name of the paint that could be picked up from Sherwin Williams in case he wanted to have the home professionally painted prior to move out.Upon inspection of the home on July 5, it was apparent that Gary had attempted to paint the accent walls back to their original colorThis inspection was completed after Gary returned keys to the office, and not in his presenceI did however document with photos the areas of concern. On multiple walls the touch up paint was slightly lighter in color than the original tan color on the wallsOn the walls where the blue accent paint had been, the blue was still visible through the newly applied paint. After contacting 24/Painting Remodeling and Repair, a full paint job was recommended to ensure a standard of quality for the new tenants scheduled to move inThe cost associated with having a full paint done to a one bedroom home is $Although not to our standard, a clear effort had been made by Gary to correct the damage done.Due to that effort, I felt it reasonable to only charge $rather than the full cost Indigo would incurThis cost in addition to $for an amenity key Gary failed to return, and $for the final utility bill were deducted from Gary's deposit.A statement of accounting detailing the following charges deducted was provided to our Customer CareDepartment on July 5, 2017.While I was not party to the conversation that occurred between their staff and Gary, a Yelp review posted online would indicate that one did take place, and that they provided Gary with the same photos taken by myself during the final walk of the home. The correspondence with Gary throughout his tenancy and after made him fully aware of why the charges are being assessedThe charges are valid, fair, and substantiated by correspondence and the attached photos

Thank you for taking the time to review this matter and we sincerely appreciate your mediation efforts to bring this matter to a close. We do pride ourselves on going above and beyond for our resident’s and strive to offer sincere customer service to all. The last thing we want is for people to disagree or be unaware of why they are being assessed charges. This is why we offer the ‘pre-move out inspection’ that was done with Gary; to offer clear directions and expectations for all involved. This is also one of the reasons our company created our Customer Care Department who also spoke with Gary; to ensure that nobody is being charged unnecessarily through the requirement of photo uploads by office staff for any charges made.  During his tenancy Gary was made well aware by two different managers that his blue accent wells would need to be professionally repainted. He was also made aware that due to the cost of paint, our office would not provide it to him. Should he agree to the release of his email correspondence with our staff, and the inspection paperwork completed in his presence, we can send those over for your review along with anything else you might find helpful.Due to only having charged Gary for half of the actual damage cost, and also because of the past conversations we’ve had with him, we are not reconsidering our position. We feel that doing so would be tantamount to preferential treatment, and we believe in treating everyone as equals. Especially when it comes to monetary concerns since we understand that money can play a large role in the lives of consumers. Frankly, we are very surprised at Gary’s allegations and that he remains so deeply unsatisfied.

This is complete lies and fabrications, I have the pictures to prove it. I left that apt in better shape than when I moved in. I took many many pics to prove it. They can't even tell the truth about the color of the wall, because one of the maintenance personnel of the property felt bad for me and gave me a bucket of paint for the walls. It doesn't look exactly the same because I lived there for over a year and the apt wasn't painted before I moved in, so of course the walls wouldn't match. They told me before I moved in they always repaint the walls when a tenant moves out which is a big lie. I was tortured in that apt with scalding hot water and the list is a mile long. I'm a very honest person and these people lie about everything because the contract is written so as a tenant has no recourse. I don't know how these people sleep at night, I was miserable at this place and I left it perfect so not to have this issue. Gary L C[redacted]

The fee was removed in order to continue to provide an enjoyable experience at Indigo. We were also able to waive the fees charged for cleaning....

The total amount that was removed in cleaning fees was $140 for an oven, kitchen sink, toilet, bathroom sink and bathtub clean that was needed in order to make the apartment ready for the next tenant. The total that was removed from the account was $583.25. Indigo prides itself on providing excellent customer service to our residents during their stay here and upon move out. Unfortunately, when dealing with lease takeovers we are unable to make the apartment ready to our standards and the apartment is given to the new residents in the condition that is was from the current residents. Our goal is to make the process a smooth and easy transition.  We have chosen to remove the fees that were charged due to the circumstances of a lease takeover where we were not able to make the apartment ready to [redacted] standards. To Whom It May Concern:We have been working with Mr[redacted] to come to a resolution for quite some time.  We have agreed to transfer him to an alternate apartment home within the Indigo Community.  In addition, we have offered to allow him to transfer without incurring any fees that the...

apartment community generally requires with on-site transfers.  [redacted] is a completely separate entity from Indigo Apartments, as is the moving company.  No member of the Indigo Team has offered to absorb the utility costs or the moving costs incurred for any resident who transfers apartments within the community.Regards,J[redacted], CAM |  Community Manager | Indigo ApartmentsGreystar | [redacted] | [redacted]. | Austin, TX  78717?Main 5[redacted] | Fax [redacted]
