Re: [redacted] Mr. Rooter Plumbing of Greater Syracuse  Complaint No.: [redacted]  Our Matter No.: [redacted] To Whom It May Concern  Please be advised that [redacted], P .L.L.C., has been retained by [redacted] with respect to the above-referenced matter. Please allow this letter to serve as a rebuttal to Mr.Rooter's response to Ms. [redacted]'s Complaint. Mr. Rooter states that it was working with Ms. [redacted] to resolve the matter, but Ms. [redacted] stopped communicating with them regarding same. See Mr. Rooter's Response. Ms. [redacted] does not dispute that she contracted with Mr. Rooter with respect to the restoration of her sewer services. Nor does she dispute that Mr. Rooter began to perform thework. However, what Ms. [redacted] contends--and what Mr. Rooter completely failed to address in its response is that Mr. Rooter could not actually finish the work pursuant to the terms of the contract.Rather, as evidenced by the "log of events," the Village of Minoa was forced to intervene and finish the work on the project due to Mr. Rooter's failure to complete the work in a good and  workman like manner.  More specifically, when the Village of Minoa inspected the worksite, it found that Mr. Rooter was engaging in dangerous working conditions that the village officers believed were going to get someone "hurt or even killed." Enclosed herewith for your convenience is a copy of Village of Minoa's log of events previously provided by Ms. [redacted] (hereinafter "Village's log of events"). The Village immediately shut down the worksite. The sewer line was not operational at the time that the Village stopped Mr. Rooter's work on the project, due to the accumulation of sand in the pipe, caused by Mr. Rooter's poor workmanship. See Village's log of events. In fact, the problem was so severe, that the Chief of Operations at the sewer plant was called in from vacation to oversee the rest of the project. See Village's log of events. As indicated in the Village's log of events, although the Village is not responsible for the maintenance of sewer lines on private property, the Village thought that it had "no choice but tostep in and take over" due to the malfeasance of Mr. Rooter, which it determined to be a "major threat" to the entire Village sewage system. See Village's log of events. In short, Mr. Rooter did not complete the work per the terms of its contract with Ms. [redacted] and the work that it did perform was so poor that the Village of Minoa was forced to intervene to save the entire Village's sewer system from damage.Thank you for your time and consideration with this matter. We have been in contact with Mrs. [redacted] and were in the middle of resolving the issue when she abruptly stopped talking to us.  We had agreed that Mr. Rooter Plumbing would take care of the landscaping as a result of our excavation work.  The job turned into a bigger job because the...

soil had been compromised  because her existing pipe was so deteriorated that the sewage was seeping into her yard making it very unstable.  Mrs. [redacted] had her credit card reversed for $17,852.00 but we have received the money back after she disputed the bill with the credit card company.  As far as we are concerned we will honor the landscaping agreement if Mrs. [redacted] so desires.   If you need any further information please don't hesitate to give me a call at ###-###-####.   Sincerely,  Kathy S[redacted]  Mr. Rooter Plumbing of Greater Syracuse
