We are responding to Mr. [redacted] ’s complaints. Her complaints are the same that have been filed with the state Attorney General. Attached are the answer’s we filed under that complaint. We regret that Ms. [redacted] has not had a pleasant living experience with us. However, we... believe we have answered all of her maintenance request timely. Her lease ends in mid-December. There was a period of transition that was taking place the first couple of months as the management of your building changed from Zender to CRF dba Indy Flats. There were several staffing changes during this period as well and as a result I believe there was some communication that got lost in
translation. I am the property manager and started with the company in Mid-August. I too am working to get up to speed with everything that has taken place since July first. In looking at your ledger today I do see that all payments have been posted to your account and you currently have a zero balance until rent becomes due again in November. I certainly understand how frustrated you must have been and sincerely apologize for everything you have had to endure as we experience this transition. My hope is that you won’t face any other negative experiences with our office and give us the opportunity to continue making improvements. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
For Indy Flats & Tom M[redacted] to admit that this complaint has been filed with multiple State offices, shows that I take the business agreements that I enter into seriously. In the attempts to assassinate my character, it should be known that Indy Flats has records that I've never once been late paying any rents agreed to in the lease, nor have I contributed to a negative professional relationship with them, due to ensuring high standards of my livelihood & credit rating. All the while, working with Indy Flats by reporting issues that assist in the maintaining of their own high property value, which I thought any land owner would appreciate. It is disheartening to see that Indy Flats refuses to uphold their end of our lease agreement & the law (Indiana Code 2017 32-31-8-5 "Landlord Obligations), whilst continuing to expect me to pay rent on time, every time, viewing me as though I'm a second-class citizen that shouldn't expect them to accept accountability for their unsanitary & poorly-maintained properties, and dishonest business practices & Staff members. It further proves that even if Indy Flats does not adhere to the same lease that they draft for you to sign, the tenant is still responsible for satisfying the agreement NO MATTER WHAT. Or, maybe it seems to be just me, unwarranted. Many unfortunate tenants (before and) after me will enter into agreements with this dishonest & unprofessional company, and deal with the same issues, unless this stance by me jolts them to improve their standards, which is sad. The fact that their tenants' money means more to them than their tenants' general welfare is a prime example of why their turnover rate is so high. Concessions were offered to me by phone on 8/31/17 at approximately 3pm by Dana T[redacted], the regional manager, negotiating the termination of my lease. Because I did not accept their terms, which to me admits some level of accountability of their behalf, they are refusing to terminate my lease entirely. I suppose continuously dealing with cockroaches & another tenant violating my privacy & welfare by having a key that unlocks my apartment door is not enough for a mutual rescinding of my lease. Maybe it would have taken someone's life to have been lost to their negligence in order for it to be an important issue to them.FILE 17-CP-57633
