In response to the customer complaints when we 1st sent the form it was returned and after that my associate [redacted] informed me he resent it I was never aware he haven’t so we resent the form today so you should have it in the next couple of days

I am rejecting this response because:i have never once received any contact from your so called companyThe only time I have ever been in contact with any one of you, is one of the numerous times I calledAnd the address you have for me has always been the correct one, either on the paperwork you have for selling me the car or the text message I sent the guy that sold me the car, and yes I do still have all messages sent to prove you are lyingThe address on the sales papers match the address I texted, and you never once called me, I always called you, happy to show call and text logSo try again or just send me the damn paperwork your crappy little “company” is required to

In regards to Mr [redacted] complaint we did mail out the statements of facts letter however it was return because the address was incorrect Once we got the letter back we contacted Mr [redacted] and resent it to the correct address.Tell us why here

The seller’s claims, like his claims when he initially sold me the vehicle, are and a fraudFirstly, the seller told me that the car was in good working order, and not in need of any major repairsHe misrepresented the condition of the vehicle, both in his advertisement, and in personBefore making such claims, he had the obligation to perform due diligence and ensure that these claims were trueThere is no way that he could have had the vehicle checked out by his mechanic, as he claimed he did, and not know that the transmission was shot.Secondly, the check engine light did not come on during the test drive because the check engine light had been disabledThat is the only explanationMy mechanic told me that there is no way that the check engine light could not have been on in a vehicle with a transmission that badly in need of repair unless the check engine light had been disabledBoth myself and my girlfriend who was with me when I purchased the vehicle and drove it home, can attest that the check engine light was not on when I purchased the carIt is a very easy thing to disable the check engine light, and my mechanic told me that the check engine light will only come back on after the car has been driven a certain number of miles and the computer detects the damage to the vehicle.The seller’s deception in disabling the check engine light precludes any “as is” sale of the vehicle, and constitutes fraud and misrepresentation.Thirdly, I contacted the owner of this business, and was assured that the seller would pay for transmission repairThe seller then texted and put in writing that he would pay the cost of the transmission repairIn addition, the seller verbally agreed to pay the cost of the transmission repair when he spoke to my mechanicSo we went ahead and had the mechanic perform the repairsThe seller asked the mechanic to email him a copy of the smog certificate after the repairs were made before the seller would payWhen my mechanic did so, seller then texted me the same rambling, disjointed message that he has cut and pasted his the above responseHe refused to honor his written and verbal agreement to pay the cost of the repairsI have text messages and a sworn letter from my mechanic testifying to this fact.Fourthly, the seller failed to provide a pink slipI am a very naïve and trusting personI believed the seller when he told me that he would take care of the pink slipHe said the vehicle needed to pass a smog check first before he would provide the pink slipWhen I went to the DMV, after I could finally afford to pay the taxes and fees after a $2,transmission repair, they told me that I needed the pink slip, and that the seller did not take care of the matter on his end as he agreed to do both verbally and in writingThe clerk at the DMV said the seller should never have sold me a car without giving me the pink slip immediatelyShe also said that in her opinion it was further evidence that the seller was a fraudster.At the time of this writing, the seller still has not provided me a pink slip, even though I paid him $3,to purchase the vehicleI cannot register the car in my name until I get the pink slip, nor can I sell the vehicleThis has been a nightmare!Regarding the seller’s claim that I did not bring the truck to him to inspect, I was advised by my attorney not to let the seller inspect the car without a certified mechanic present, and so I asked the seller to come to inspect the vehicle with an independent, 3rdparty mechanic present, since the seller had verbally disparaged my mechanic when I first told him about the issue with the vehicle.The seller refused to go to an independent mechanic suggested by the auto clubI then asked the seller who his mechanic was, and agreed to take the vehicle to his mechanic provided that he was a certified mechanicThe seller refused to tell me who his mechanic was or the address of his mechanic, and he did not agree to this reasonable requestAgain, all of this is evidenced in the text message exchanges with the seller.Regarding the seller’s claim that I agreed to meet him at [redacted] to let him inspect the vehicle, I agreed to meet at [redacted] if he was going to refund my money in exchange for the vehicle, which was all I was asking for in the first place after his fraud became evidentThis is also evidenced in the text messages I have from the seller on my phone.Regarding the seller’s ridiculous argument asking for a failed smog report, my mechanic’s statement attests that the check engine light was onMy mechanic told me that the vehicle automatically fails the smog check if the check engine light is visually seen by the smog check technicianThe seller, who is every bit a used car salesman, should know this because it is a state law designed to protect the consumer.Regarding the seller’s claim that I insisted on taking the vehicle that night, I did ask to take the vehicle that night, but this was only after the seller’s repeated assurance that the vehicle would “pass the smog check, no problem.” When I told him that the vehicle would not pass because the check engine light was on and because it needed a $2,transmission repair, he falsely said that the transmission had nothing to do with passing a smog checkThis is false, because, as stated above, a vehicle cannot pass a smog check if the check engine light is onThe seller refused to believe me even as I told him repeatedly to check the state law on this pointThis is also evidenced by the text message exchange on my phone.Finally, regarding the seller’s pathetic claim that I was “mean” to him and that he “truly does have a heart,” yes I got pretty heated after he cheated me and my family out of a substantial amount of money, and refused to simply agree to refund my money in exchange for the vehicle and part ways amicablyI am not a wealthy person, and in fact am a single dad who has had to take government assistance to make ends meetWhen I purchased this vehicle, I bought what I thought was the best car that I could afford, and I spent everything I had on it.I did not budget for $2,to repair the transmission, nor for the additional couple of weeks I would need to pay for a rental carThe seller’s fraud has set me and my family substantially back in our financesAll of my savings is wiped out because of this crookSo forgive me if I wasn’t gushing with gratitude toward the sellerIf I had my way, the seller would never sell another vehicle because his conduct has been unethical, his words have been duplicitous, and the fraud that he perpetrated on me and my family has been borderline criminal

I apologize that we couldn't reach a settlement we offer to pay a third of the repairs but customer declined We have went ahead an paid the customer registration for the upcoming year as a jester of good faith

To whom it may concern this has been resolved.  We first offered the customer to provide him with a different truck however we did not find anything to accommodate him so on 8/27/2017 we refunded the customer his money back and he informed me he was going to update the Revdex.com to resolve this...

issue

This customer did purchase a vehicle from one of my sales associates customer test drove the vehicle and loved it however it was late in the evening when the customer came to view the vehicle so sales associate informed him he still needed to smog the car because we he 1st took it the vehicle...

monitors weren't set.  The customer insisted on taking the vehicle now and coming back on Monday for the smog. Customer then informed my sale associate that the check engine light came.Hi ,After consulting with my attorney , I am advised that because truck was sold to [redacted] AS- IS and  he signed and agreed and we have that in writing along with responsibility of transfer fees and SMOG   ; I CANNOT be held responsible  . It was clearly communicated at the time of sale.  The smog was done today and [redacted] was credited by me for  cost of smog at time of sale which he AGREED to . Furthermore , [redacted] was suppose to get back to me the day after the sale with smog info. I waited but It wasn't until I reached out to You "SUMMER" 3 days later that following Tuesday ,I was the 1st to initiate contact and even then you indicated to me all was well with truck , you even sent me a smiley face ?? . Out of the blues later that day you wanted a REFUND . Because u claim the truck now had issues with transmission.I advised you that the sale was final AS-IS but I'd be happy to look at it and see what the issue is.  You REUSED TO BRING THE truck back so I can take a look . We that later agreed to meet at TRIPLE A for me to look at car and make a decision how to move forward . You then CANCELLED ON ME and never brought the truck. My attorney also advised me you should  have given me sufficient time to remedy situation (30days). Truck was test driven by both parties and ran EXCELLENT . My certified mechanic confirmed that the transmission IS NOT a part of the smog/ emission process which I adamantly tried explaining to you . So I am not responsible for transmission .My attorney also advised me that if you claim otherwise then you need to provide documented evidence that the truck failed smog test PRIOR to any repair which I'm 100% sure does not exist because it was never done . Please send me the fail smog report that shows the vehicle DID NOT pass smog check . If your mechanic said it would not pass then his responsibility under california law is to fail it and the produce a failed report prior to any repair. .I can go on further in detail but for now this is sufficient to let you know my position . I'm not trying to be mean as [redacted] was to me. And all that is also documented .Those are a few of the recommendations by my attorney and he is convinced my case is 100% safe . However because I do have a heart and truly apologize for the inconvenience and I know we all have expenses I am willing "as a "courtesy only" NOT BECAUSE I AM RESPONSIBLE. But. "AS A COURTESY ONLY "OFFER SOME HELP IN THIS UNFORTUNATE SITUATION.Possibly help out with 1/3 of the cost of this unfortunate incident . Please reply if you accept in writing so we can all move forward. Thank you .
