Thank you for reaching out to me inreference to case number [redacted] , a matter in which Mrs [redacted] and I,Casey J [redacted] , have a misunderstandingAttached to this letter will be myaccount of the incident that occurred on June 13th, Also attached will bepictures of the deck in which Mrs [redacted] is referring*I also have a video ofme presenting how badly the wood was rotted if you would like that as well On June, 13th, 2016, myemployee and I serviced Mrs [redacted] home, cleaning her windows and guttersMidway through the service, I walked up the steps of Mrs [redacted] ’ deck to clean awindow and her sliding glass doorAs I walked towards the window, I heard aloud crack under my footWhen I looked down, I noticed that the board on whichI had stepped was rottedI told my employee, who heard the noise, to becareful if he is to walk on the deckI then proceeded to clean the window andsliding door that the deck leads toWhen I finished cleaning the windows, Iproceeded to leave the deck looking for the rotted board when I stepped throughan adjacent rotted board with my right foot, spraining my ankle, and leaving ahole in the deck The pictures I have provided illustratejust how badly the boards were rottedMrs [redacted] should never have allowed meto walk on that deckThe deck is two stories high and if I had fallen through,I likely would have broken my legsNow let’s talk legalities Premises liability is a legal theory statingthat property owners are liable for accidents and injuries that occur on theirpropertyThis uniform standard requires the exercise of reasonable care forthe safety of a visitorMrs [redacted] failed to maintain the safety of herpremises, which resulted in my injury Mrs [redacted] is legally liable forboth damages to her home, as well as the injury I sustained while working onher propertyNow to be honest, the sprain wasn’t that bad, but I did see adoctor to make sure it was only a sprainI was advised to contact her and talkwith her home owner’s insurer to file a claim, but I didn’tCrazy as itsounds, I didn’t want her rates to go up or even worse, her policy to becancelled In response to Mrs [redacted] ’complaint that her “gutters are still overflowing”, it is the middle of Octoberand most of the leaves have fallenMrs [redacted] ’ rain gutters were notinstalled adequately to withstand the amount of rainfall and abundance of leafdebris that fall into themWhen she first complained about water overflowingfrom her gutters, the culprit was a handful of leaves lying on top of aninsufficient downspout inletHer downspout inlets are only 2’’X3’’ when theyshould really be 3’’X4’’The leaves falling from the tall line of mature treesin her back yard are too large for her inlets and cannot pass throughIt onlytakes a handful of leaves to block an entire stretch of gutters The truth of the matter is that I amnot guilty of negligence on any countHomeowners are expected to keep theirproperty safe for all visitors, whether they be mail couriers, contractors, andmost importantly, childrenAs I stated in my response on Angie’s List, I amthankful it was me and not a child I am unwilling to issue a refund forthe gutter cleaningThe gutters were cleaned properly, and I made sure thatwater was flowing efficiently before I finishedI am also unwilling to payMrs [redacted] to repair her deck, which was clearly unsafe to walk on prior toservicing her home I thank the Revdex.com for addressing thematter at hand and giving me the opportunity to present my responseCasey J [redacted] -Owner
