Condition removal was pushed a month as Infiniti homes was trying to charge us for a tub that they forgot to install that was stated in the MLS listing and shown in the layout drawings that were to be includedAt the time of condition removal Infiniti provided a new possession date of their choosing of April which they have continually missed sinceNon-seasonal deficiencies inside and outside of the home are still not corrected as of June 17, In the purchase contract that Infiniti signed they did not specify delayed possession or concerns around seasonality items, and come May are irrelevant anyhow as seasonality is no longer a concern, especially given Infiniti had already performed concrete work at their other property(s) as of May 4, We clearly indicated to Infiiti that all items in the purchase contract needed to be completed well prior to the last two possessions being missed, and offered to take possession of the home if they had completed all the inside deficiencies, as long as they provided us with a guaranteed final completion date with a substantial hold back, which they refusedAs of June 18, Infiniti has still not provided us with a completion date for our home, and their are still outstanding deficiencies not completed inside and outside of the homePlease let me know and I can provide you with documentation regarding the above (emails & pictures) regards, [redacted] Final Business Response / [redacted] (1000, 30, 2015/08/18) */ ***Document Attached [redacted] This home was purchase as a Spec HomeIn response to the deficiency items [redacted] mentioned: The grading is a seasonal item, therefore it may not be addressed until next year (spring or summer)Once the grading is complete, than the fence will be completed The front door trim has been replaced The front door is not listed as damaged (scapped) but the Site Sup has confirmed is good The front railing being scapped/loose and the man door having a mark on it, was also not listed as damaged and are new items [redacted] is mentioningIf this is the case, again it will be taken care of The fireplace trim is now installed correctly The front entry is finished in hardwood, not tile, therefore this item is complete and will remain 'as is' The kitchen countertop is either finished in granite or quartzQuartz was installed instead of granite, as the quartz option worked best with the selected interiors of this SPEC home and will remain 'as is' The green tape has been addressed and removed Also, I have attached a copy of the Pre-Occupancy Report detailing items that have been addressed Our required response is for [redacted] to advise on how he would like to proceed if he wants possession of this home or if he would like his deposit back (as we have already discussed/offered to him) Final Consumer Response / [redacted] (2000, 32, 2015/08/19) */ (The consumer indicated he/she ACCEPTED the response from the business.) After, the client asked to have all seasonal work done prior to possession, except we can't start concrete work until the end of May. Also, we didn't start anything because [redacted] pushed the condition removal for a month.

Non-seasonal deficiencies inside and outside of the home are still not corrected as of June 17, 2015. In the purchase contract that Infiniti signed they did not specify delayed possession or concerns around seasonality items, and come May are irrelevant anyhow as seasonality is no longer a concern, especially given Infiniti had already performed concrete work at their other property(s) as of May 4, 2015. This home was purchase as a Spec Home. In response to the deficiency items [redacted] mentioned:
