Response:

I am writing this letter in response to the above referenced complaint

from [redacted] came into our store and wanted

to trade in a 2008 Infiniti Coupe for what I believed was a another Infiniti

Coupe. After spending a substantial time

with one of our salesman I met [redacted] and suggested a lease and after

explaining the benefits of a leased vehicle he agreed to come back the next day

with the funds necessary to complete the transaction we negotiated the night

before in order to lease the 2014 Infiniti Coupe. During the negotiations with me and confirmed

by [redacted] in his complaint, [redacted] decided to add extras to his

car which would be paid for by increasing the monthly payment. He added Remote Start, Upgraded Alarm

system,Tinted Windows,Infiniti Prepaid Maintenance, and PolyShield exterior and

Interior protectorant. At all times **

[redacted] knew that these items would increase his monthly payment. The day [redacted] picked up his car, but

prior to the actual delivery of the car, he called his salesman and told him

that his girlfriend didn’t want a coupe but rather a sporty SUV. He was told that the price for the SUV would

be much higher than the coupe and he subsequently picked up his coupe, telling

us he would rather have a coupe and she would get over it. Up to this time we never met his girlfriend

and she is not on the lease. [redacted] signed all papers including his lease at our office the day after he

signed his buyers order. Within two

weeks he approached us cordially and said his girlfriend was really mad and he

wanted to trade out of the leased coupe.

I told him it would be very expensive since the car was already

registered and therefore not a new car and would be valued as a used vehicle. I provided him numbers to change but they

were too high for him to manage. Hence

he then filed this spurious claim in order to get out of his lease.

THE TRUTH OF

THE MATTER IS THAT [redacted] SIGNED LEGALLY BINDING DOCUMENTS WITHOUT

DURESS AND THEREFORE IS LIABLE FOR THE DEBT INCURRED. TO SUBSEQUENTLY COMPLAIN ABOUT THE DOCUMENTS

IS UNFAIR AND PATENTLY FALSE.

As a result

of the facts of the case and the legal ramifications of [redacted]’s

signatures this matter should be closed in our favor.

Review: I am writing to make a formal complaint against the [redacted] of Infinity of Massapequa. My wife and I went shopping in August for a car for my wife. Our search led us to the Infiniti of Massapequa dealership located at [redacted]. We were met in the parking lot of the pre-owned division of the dealership by [redacted] while viewing the selections of cars available. She introduced herself and eventually became our sales representative. On first visit we did not agree on a car. I liked for her the Infiniti G37X of which they had a number to select from but her preference was the FX35 SUV of which there were few, none of which had the color and features she wanted. Before we left my wife explained to [redacted] what she was looking for, we were told she was expecting new arrivals the following week and she would let us know if any matches our preference. The following days she e-mailed us to let us know they did not receive any that matches my wife’s preference but she had receive a 2013 Infiniti G37x with all the options we were looking for and thought she’d forward it to me as she knew I liked that car. We went back to the dealership on the following weekend to view the car. It was beautiful and just as she described it. I really liked the car, my wife liked it too but was still undecided and so [redacted] suggested if we wanted to, we could make a $100.00 refundable deposit on the car to hold it temporarily while we decide on it. We thought it was a good idea and subsequently agreed a price of $34,495.00 at which point she completed a purchase order and we made the $100.00 deposit and signed the contract. Everything appears to be going well up to this point and so we were taken to the [redacted]’s office where we were introduced to [redacted] whom we worked with to complete the financial part of the deal. After the introduction we had a little friendly chat talking about cars at which point we explained to him that my wife was not sure she wanted the car I liked and selected and we have yet to decide but we would like to see what our monthly payment would like prior to the purchase. The conversation continues for a further few minutes as he tried to convince my wife but we told him we will think about it and then decide. We then move on to discuss the loan terms and options. He first ask what’s our down payment, we told him between five and ten thousand dollars and that we were looking to keep the payment to just under five hundred dollars a month. He suggested we start with five thousand and then proceed to do the calculations and terms on his computer. Once he gave us the terms and figures we thought it was too high compared to the rough estimates we worked out with [redacted] previously so we asked what made the difference and at what rate he was calculating to which he replied it was just a rough estimate at 4% as we have not decided. I told him at that time that we both have excellent credit and would not accept such high rates and he said with good credit we could get somewhere between 2 and 3% and that should bring the payment within the range we are looking for. I even suggested to my wife that we put down some more money to which he replied in his professional experience he would not do that as it is like taking money from one pocket and putting it in another and it is better to just save the money as it does not make much difference. We then left his office and told him we would contact him to complete the transaction once we decide. My wife and I went home and discuss the car for an extended period of time. In the end I was able to convince her that the G37x was a better deal than the FX35 simply Because it was a fairly new car in a 2013 with only 1700 Miles as oppose to a 2009/2010 FX35 with over 30,000 Miles and so we agreed to go ahead. Once we made our minds up I called [redacted] and let him know we are ready to proceed and to let us know what our interest rate and monthly payment would be for the 72 months term. We chose 72 months as it would give us the lowest monthly payment even though we planned to pay it off in a much shorter period as previously explained to him which he told us have no prepayment penalty. The first rate he quoted us was 3%, I told him no as we knew we could qualify for a better rate. He asked me to hold for him to check other banks and he came back with a rate of 2.89% again I told him we could do better. He again asked me to hold while he continues to check and then came back with a rate of 2.69%. I then ask him what the monthly payment is and he said $502.00, at this point I asked him couldn’t we get an even even 2.50% and he said to hold on to let him see what he can do. He came back on the line shortly and said that 2.50% is just an extra $200.00 and that he would absorbed it as it was no big deal and it would make our monthly payment an even $497.00 per month. My wife and I both agreed to this at which point he said he will go ahead and complete the paperwork and we can schedule with [redacted] a date for picking up the car. Please note throughout the entire negotiation we never discuss buying down any interest rate as we both have excellent credit nor did we have any intentions of doing so as we could have easily pay down more money as we first intended to. As soon as I conclude my conversation with [redacted] we contacted our sales rep [redacted] to schedule a pickup date. Every date we chose for the pickup that was convenient for my wife based on her work schedule [redacted] said she would not be available and would arrange for someone else to deliver the car for her. My wife thought it was odd and said to me something is not right and why she can’t be available. I never thought anything of it as she was so nice to us throughout the sale. My wife even told me not to pick up the car unless she is available but I ignored her and went to pick it up on Saturday August the [redacted]. I met with [redacted] and was taken to his office. As I sat down I ask him for the buyers order to see the final figures. Here he present me with the original buyers order that was put together by [redacted] and said nothing has change except the added fees for registration and plates for an additional $344.50 and the total to be deposited written at the bottom of the page $5,344.50 in ink. I gave him the checks as he started giving me the papers to sign. I went ahead as he so skillfully folded the papers just to show the monthly payment while disguising all other information and signed them not thinking anything of it. I now know I have made a big mistake in trusting him. I should have open all the papers and read them to make sure everything was as we discussed and agreed over the phone. I was a little eager to get out and get home with the car for my wife and let it get the better of me. Two weeks later I received my first bill and notice that the loan balance was off and went back to the papers and discovered what [redacted] had done. I discovered that he had changed the sale price of the car from $34,495.00 to $35,836.03 a difference of $1,341.03, funds that I did not receive. In addition he lied to me about the interest rates, even though he pretend to be negotiating a good rate for me and in the end told me the final rate is 2.50% the actual rate the bank gave me as on the loan application is 1.88%. Once I found this out I reluctantly brought it to my wife’s attention and brace for her wrath, and did she let me have it. I just had to take it as she was right and I’m 100% sure if she had gone there it would not have happen. I’m a trusting person and I really trusted him. The company appears to pride itself as a family own business and I thought we would have been treated as such. Shortly after the discovery and my scolding I called the dealership to speak with [redacted] for an explanation. I spoke with [redacted] who check for his availability and then came back to find out who it was and what was my call about. I told her who I was and that I had just purchase a car and had questions about the loan, she asked me to hold and then came back to tell me [redacted] will call me back shortly. He never return my call, I made several attempts to reach him over the following week and he would not take my call and keep telling [redacted] he will call me back but he never did. I eventually asked to speak with his [redacted] and was put through to [redacted] whom I explained to what had happen. He was very courteous and receptive to me and told he would go straight to his office and ensure that he return my call. In less than five minutes [redacted] called me back. He apologized for just getting back to me explaining he was very busy and had to go upstairs to pull my file then ask how he can help. I asked him why he had changed the selling price of the car without me knowing and add it to the loan. His explanation was that it was to buy down the interest rate. I told him this was not true as I had no such discussion with him or any problem qualifying for the loan. I also brought to his attention that he told me my final interest rate was 2.5% yet the bank gave me an interest rate of 1.88%. When I asked him where the extra money from the loan is and why he had done this his response was “something had to give”. I became very upset and told him he was a liar and a thief as we had no such discussion or agreement and could see no other interpretation for his conduct and so he hung up the phone on me. I don’t know if this is a common practice condoned by the dealership’s management. However, my research has not returned any such complaint. It appears to me from my experience that he just took advantage of an unsuspecting customer and I’m sure he will be doing it again as he sounded so confident as he knew he already have my signature and took the car off the lot. We did not receive an owner’s manual with the car and so I called the personal assistance assigned to me to find out how I could obtain one. She contacted the dealership and advised me that they would take care of it. Shortly after I received a call from a gentleman by the name of [redacted] (not [redacted]) who told me that he is leaving one at the front desk and I could pick it up any time. The following day I called to ensure it was available before going in to pick it up but [redacted] told me there was none available. I was really disappointed and begin to voice my displeasure to her about my experience with the [redacted] and she told me I should speak with [redacted] who is [redacted] of the pre-owned division. She also advised me to speak with my sales rep about getting an owner’s manual and then put me through to [redacted]. I spoke with [redacted] at length about my encounter with [redacted]. I also told him I was going to file a complaint with their corporate office and if I get no response I’ll file with the Revdex.com as well. Understandably he said he could not say much on the matter but he would speak with [redacted] to find out what happened and get back to me or have [redacted] contact me the following week to see if we could work something out. I contacted [redacted] after regarding the owners’ manual, she said she was sure one was left in the car after it was prepped for delivery and that they did not have one for the 2013 Infinity G37X but she had one for the 2010 model and that they were the same. I went to pick up the owner’s manual on Labor Day from her. I brought to her attention the experience I had with [redacted] and let her know I spoke with [redacted] who said he would get back to or have her contact me later that week. It has been three weeks now and no one has gotten back to me. I was unable to locate a corporate office to where I could relay my experience and so I turned to the Revdex.com. I know I was a little careless in signing the documents without carefully reviewing them but I don’t think this is justification for this loans officer to do what he did. I hope this behavior is not business as usual by this company. If I get no response I intend to share my experience with anyone who will listen including sharing it on popular social networking sites to let unsuspecting people be aware of this man’s behavior. Thank you.Desired Settlement: Refund

Response:

In response to the above referenced complaint from [redacted] of [redacted]. Although he has succeeded in writing a three page tome, as if that will make it truthful, he has neglected to honesty portray the facts of the matter. [redacted] and [redacted] did come in to the pre-owned car department over many occasions beginning in July. They are intelligent, well educated customers in the medical profession. The negotiations with [redacted] went on for weeks until we could establish a payment that they were comfortable agreeing to. That payment was $497 for 72 months. Our negotiations were a give and take situation culminating in our providing [redacted] with a much lower interest rate than previously offered. This was the result of our having to buy-down the banks rate and impacting what should have been charged. This was all done to insure his must-have $497 payment and the buy-down is an additional expense. This is considered quid pro quo negotiations, not under-handedness.

With regard to [redacted] signing documents that were folded over and therefore unable to discern the finances, that is both ridiculous and morally upsetting. First of all, this intelligent man negotiated strongly for over two weeks and then claims months later that he let his guard down and signed unknown documents. That does not sound like something [redacted] would have done. I personally reviewed every financial term on the contract and the bill of sale until [redacted] was satisfied. In fact, there was a blemish on the car and [redacted] refused to continue signing the paperwork until he could ascertain that the blemish was removed. Only after we verified the total cleanliness of the vehicle did [redacted] reconvene and finish signing the paperwork.

I have reviewed all of our documents and not one of them has a fold or crease in it, nor did it ever. This dealership does pride itself on honesty and integrity as [redacted] had stated. The mere mention of me or anybody at this dealership trying to mislead a consumer is taken as a personal affront.

I believe [redacted] was unhappy with the choice of vehicle/finance options that [redacted] had negotiated. Unfortunately, the negotiations had culminated prior to [redacted] signing all of the paperwork and obtaining the vehicle. There were several weeks in between negotiations and I'm sure [redacted] would agree that the time for renegotiation of the transaction has already passed. Filing a complaint with the Revdex.com because [redacted] didn't like my explanation after he had taken delivery of the vehicle, seems spiteful rather than helpful. Had [redacted] brought any concerns to my attention during our negotiations, they would have been dealt with. That did not happen.

Unfortunately, we are unable to honor [redacted]'s request for a refund. We are more than willing to provide [redacted] with an owner's manual for the car if it still needed. Please let me know if you have any further questions or need any supporting signed documents from this transaction. Thank you.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Everything I stated is true and is how it happened. The

research I did was on the dealership and not [redacted]. I see he is quick

to take shelter under the company’s good name after what he knowingly did. I

admitted before that I made a mistake of trusting him. He saw an opening and

took advantage. We had no problem with the dealership and think what he did was

solely his decision. Maybe foolish of me to think he is going to admit to it

but I’m sure if it continues it will be exposed eventually.

Nothing in [redacted] response is truthful and he knows it

for a fact. The only negotiation I had with him took less than 10 Minutes on

the phone to work out a good interest rate and payment plan in which he told me

my final interest rate is 2.50% and a monthly payment of $497.00 as outlined

previously. The delay as stated before was my wife deciding on the car and because

of our schedules finding a convenient time to pick it up. It had nothing to do

with negotiations and give and take as he claimed, I have e-mail communications

with [redacted] to prove that. The only give and take was he taking my $1,341.03

plus my $100.00 down payment. A simple

math would show that the difference between $502.00 and $497.00 over the 72

months is $360.00. There was nothing to be gained by buying down 0.39% point

for $1,441.03.

I contacted RBS Citizens, the bank that issues the loan for some

verification. I was told the rate (1.88%) I got is the rate I qualified for.

They said the rate is not a negotiated rate and there was no additional payment

made to get that rate, I was even told we could not buy down that rate even if

we wanted to, plus we had no reason to as we both have excellent credit.

As to his claim about being unhappy with the car! That is pure

nonsense. This is the car I wanted my wife to get, I chose the car and I love

the car. He knew that too and was actually trying to convince my wife while we

were at his office on our second visit to the dealership to view the car. [redacted] knew that too and that was the reason she forward the information to me. Just

so you know too, my wife now loves the car.

We still need an Owner’s Manual for the 2013 Infiniti G37X

Sedan. It can be mailed to the address on file.

Thank you.

Sincerely,

Business

Response:

Unfortunately, I remember the events leading up to [redacted]'s purchasing his car far differently. By calling Citizens, this would only result in them giving him information they were not privy to during the course of the financing. They would only be able to look at the final deal which [redacted] approved and signed. The clerks at Citizens wouldn't know we had to buy down the rate to get the rate at 1.88%. They would only know what was contracted and signed by [redacted]. Even if [redacted] was agreeable to a rate of 2.5% on the amount financed, which is what he initially stated, this would have increased his monthly payment higher than he had wanted.

The truth of the matter is that [redacted] signed legally binding documents without duress after a lengthy negotiation. We have been reaching to [redacted] to try and come to a resolution of this matter but have not been able to contact him. I welcome [redacted]'s phone call to this end. The owners' manual is expected this week and will be sent.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[redacted] knows the facts of the events leading up to

the purchase as well as the actual transaction that took place. He knows I am

telling the truth. Trying to make it look like I was just trying to get a low

payment with him claiming to recall the events differently is just a way to

justify what he did. The only truth from him so far is what he said about me

signing the documents. Sure I signed those documents willingly and legally,

under no duress If I must make it clear again. I made a mistake trusting him, this

I’m sure is not a crime. His repeated claims of a lengthy negotiation is pure

nonsense, I already explain the delays which can be verified by the Sales rep.

[redacted] with e-mail communications to back it up. We were looking for a good

deal and nothing more. We should not have to pay more than the agreed selling

price of the car. The extra money he charged us and put on the loan is far more

than it would cost to buy down the interest rate from 2.89% to 2.50% the rate

we agreed to even by his calculation. Yet our subsequent qualified rate was

1.88%.

Why is it though that the management of the Infiniti of

Massapequa has no interest in my complaint? Why is it he is the only one responding

as if he is going to admit to what he did based all his response to me from the

day I first talked to him about it.

I receive no Voice Mail from him or his office nor did I see

any missed calls. They have more than one contact for me on their file and I

can be easily reached.

My contacts are: ###-###-#### or ###-###-#### and [redacted]

Sincerely,

Review: I dropped off my car for service at Infiniti Of Massapequa in New York. I asked that my roof rattling noise get taken care of, the usb get fixed, the seat warmer wasn't working so wanted this fixed, to figure out what was causing a burning smell on my G37. They gave me my car back, the USB is still not working, the seat warmer works on and off and the rattling noise on my roof is still there. I was given a loaner car at night when the service department was closing. The front desk reception gave me papers to sign before they even decided which car to bring up for me which I found weird and I then asked if I can do a walk around, the girl said "You'll be fine its a new car", I never had a problem with a loaner car before so I didn't think anything of it. When I got outside it was dark and the car was BEYOND dirty from the snow storms we recently encountered which would've been hard to tell if anything was wrong with the car anyway. I asked if they don't clean the cars and they said "With the weather they do not operate the machines in the cold as much", and gave me a complimentary car wash card for a next visit. I just got in my car and left. I went to visit some family that day and parked the car in my driveway and left for business to Chicago for the week. I had the keys on me so no one else could have driven the car. I have all of my travel papers if needed. I came back and returned the car that night as requested by my Service dealer, [redacted]. When I arrived the service guy outside walked around the car and said "Great, you are good to go". I went inside he told the front desk reception girl I am good and she signed me out, I paid my $52 dollar for my oil change, got my receipt which shows date and time and left. The next day the [redacted] or rep named [redacted] called me to ask if I noticed a scratch on the bumper near the bottom and I said no, when I checked out yesterday everything was fine and the car is out of my responsibility. Whatever happened after it was driven into his lot is not my concern. He then said he was sitting on his desk and noticed it from the window. I believe this is completely unfair to accuse someone of damage they didn't do. He also said it clearly looks like someone tried to cover up the damage with paint. If this is that noticeable I need to know why his service reps aren't trained up enough to notice this at time of drop off. I also picked up the car at night and was not allowed to do a walk around so it is possible this damage was before or after my possession. He was very unpleasant and not understanding at all. I would never recommend anyone to this Infiniti dealer. This is like me waking up the next day accusing Infiniti of Massapequa of a scratch on my back bumper that I didn't notice when I picked the car up...which IN FACT there is a scratch on my back bumper so should they take full responsibility of this like they are making me take full responsibility of something I did not do? He then hung up and never returned my calls. I called over 10 times and the [redacted] kept saying he was in and out of the office and he would return my message and call and to this day has NOT. INSTEAD he had a man named [redacted] from their body shop keep contacting me pressuring me to just do an insurance claim for something I did not do. [redacted] then said it looks like a minor scratch (different than what [redacted] said) and it may be less than 1000. I told him I need to speak to [redacted] to make a complaint because this is unfair. He then calls me back today and saying after taking apart the car he notices already over 3000 in parts and more for damages. THIS IS INSANE! There is so much damage that was unnoticeable, none of this makes any sense! He even tried to say he will lower the cost so I don't go through insurance under $1000 so "everyone walks away happy", why would he then call me back the next day with even higher charges? Because they want to pinpoint a damage I didn't do and use me for an insurance claim to make money off of someone who can't afford this. This is very unfair, and this will need legal action for all of the false claims, pressure and service I received. Bottom line I dropped off a car perfectly fine that was ok and checked out and then after the fact is being accused of damage that I did not commit, damage that to me sounds like I could have been in an accident and to check carfax or insurance I NEVER had any collisions or claims against me or my vehicle.Desired Settlement: Stop contacting me and falsely accusing me of something I never did. Stop having your body shop repair guys call and pressure me into making a insurance claim involving bribery. I have all of my calls and paperwork recorded and referenced and work at a law firm that is ready to take legal action immediately.

Response:

In response to complaint #[redacted], we agree with the complainant that there are very fewinstances of problems with loaner vehicles while operating our business forover 25 years. However, the vehicle inquestion was a brand new 2015 Infiniti Q50 with 762 miles on it when [redacted]Hassan took possession of it. Thevehicle was returned to Infiniti of Massapequa with 1514 miles after one weekof use on February ** at 7:45PM. Thevehicle was driven 752 miles while in the complainants’ possession. The [redacted] reviewed the vehicle onFebruary [redacted] and noticed damage that was repaired haphazardly. The [redacted] notified the complainantimmediately of his findings. It appearsthis vehicle had been damaged while in the complainants’ possession and thenrepaired quickly using substandard methods. Spray paint was applied to mask the damage to the fender andbumper. There is also evidence of“hammer marks” on the fender to straighten out dents. There is no possible way this vehicle wouldhave been put into loaner service in this condition. The vehicle was in perfect condition withonly 762 miles on it. Afterconversations with the complainant, we believe the vehicle may have been usedwithout her knowledge and subsequently repaired in this substandardfashion. Since the vehicle was under herresponsibility and in the parameters of her rental agreement, we’ve tried tospeak with the complainant about coming to an arrangement for repair but laterfound further damage and suggested the insurance company be notified. We are extremely concerned that this vehiclemay have been involved in an accident while in the complainants’ responsibilitywhich is why we have requested our insurance company conduct an investigationto rectify this situation as soon as possible.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because I have not been in any accidents nor have I caused any damage to their vehicle. Such huge damages that are not noticeable upon inspection and drop off of a vehicle is no longer the responsibility of the customer. The harassment and false claims is overbearing and needs legal action after this point.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Review: Upon me looking for an infiniti car for a few weeks I came across Infiniti of Massapequa I spoke with (young) [redacted] at which time I told him specifically what I was looking for that was an infiniti 11-12 with less than 40,000 miles and the maximum total for taxes, tags, title and whatever else was 25,000$. He then called me back with a 2011 infiniti with over 40,000 miles I agreed, I told him to email me the total which was 25,148.92$. I immediately told him no way, I cant afford anything past 25,000$ no if ands or butts about it! [redacted] then called me back with another total of 24,936.45$ at which time I accepted the offer! He told me I must send 100$ deposit to hold and take the car of the market and my deposit would be refunded as soon as they received the check! I overnight the check we agreed I would receive the car two days before thanksgiving. On 11/**/14 [redacted] arrived with the car, I reinstated when will I receive my 100$, because I told you not 1$ over 25,000$ he reassured me I would receive it once the check cleared! Fast forward to 12/**/14 I called and asked when I would receive my refund, it was then that [redacted] told me I needed to pay an additional 400.00$ for taxes, until I pay I will not receive my tags I explained to him the agreement we had and the fact that the reason I called over 100 miles away was because that was what I could afford and no a penny over! Now they are telling me I wont receive my tags until I pay all my taxes, I asked them to lower the price so that my taxes would pay off, because ultimately the reason why we made the transaction was because it was 25,000$ maximum, and that was the deal. Please Help if I would have known it would be over the 25,000$ I looked at and test drove an infiniti at my local dealer, but could only afford 25,000$ maxDesired Settlement: I would like to receive my tags and title along with my 100.00$ deposit. We agreed on a price and now they are changing the prices! [redacted] and I have several text messages were he tells me my boss is going to charge you 25,000$ and he will eat the other charges!

We'd like to thank you for bringing this to our attention and we apologize for the misunderstanding in regards to the tax rates and registration fees. Your paperwork is currently being processed by the Pennsylvania Department of Motor Vehicles. There is a difference between registration fees and tax rates needed to properly register the vehicle in Philadelphia and the amount we collected from you when we delivered the vehicle to you. After review of your file, we will be satisfying this difference on your behalf. We will also be forwarding a check in the amount of $100 in full reimbursement of your deposit on the vehicle. As soon as your tags are received from DMV, we will forward them along with the check to you in Philadelphia. Thank you and have a wonderful holiday season.

Review: in a stunning turn of events, i'll be reporting your dealership to the infiniti consumer affairs dept & the Revdex.com regarding fraud. first, I was told by you([redacted]) on sat July [redacted] that the dealership would be picking up my 2 remaining payments($355 each) & not rolling them into my lease. when I saw pres in the finance dept on July [redacted] he showed me 2 different prices, 1 including the 2 payments of $355 or one w/o the 2 payments & that I would have to pick them up when the bill came in. I was then instructed by no less than 3 people that this was because you needed to include them in to give me such a great price on the car. second, I was told by 4 people in the dealership that as of july [redacted], all lease prices would be increasing by $30-$40/month, not just in infiniti, but all dealerships. imagine my surprise when I saw an ad for infinite of [redacted] on July [redacted] for the exact same car(q50), for the exact same price($349) w/only $2,000 down(!st payment & all fees that you charged me). then I saw the exact same car yet again in infiniti of [redacted] on July [redacted], again for $349/month but ony $1,000 down(1st month & some fees). lo & behold today's paper(July [redacted]) has an ad from infinite of [redacted] for exact same deal mentioned on July [redacted]! since then, I also saw the same ad again on 7/** for $349 so it looks like there were NO PRICE INCREASES in the leases which contradicts the main reason I bought from you, based on what I was told by you & others there. infiniti of [redacted] clearly demonstrates why car salespeople have their deserved reputation as liars & scammers. thanks you, as this experience has been an eye-opener for me!!!Desired Settlement: I want my 2 reamaining lease payments, which I already paid for, returned to me since I was never supposed to pay them in the first palce, as per my conversation w/my saleswoman on july [redacted]. I also want my satellite radio paid for for the length of my lease for all the lies i've had to endure(like keeping me there for over an hour while lo jack was supposed to be installing the lo jack chip, but alas, they never did)

Response:

Thank you for the opportunity in allowing us to address the

statements being made in complaint #[redacted].

In reference to the 2 remaining payments due on the consumer’s previous

lease. The consumer was explained at

length, as she admits, by several people in the dealership that the payments

were being made on her previous lease in the amount of $710. These payments were either going to be

credited off of her down payment, where the consumer would need to forward that

money to Infiniti Financial Services (IFS) or made by the dealership on her

behalf. (Sometimes, consumers request to

make the payments on their own so they have a copy of the check and a receipt

showing their previous lease contract was fulfilled.) After much deliberation, the consumer

requested we make those payments as “that was part of the deal”. We are attaching copies of the original

buyers order, signed by the consumer, which clearly states “We pay 2 payments

of $355 each to IFS”. Also attached is

the copy of the check sent to IFS in the amount of $710 to satisfy the

remaining 2 payments on her previous lease.

Therefore, we are unable to refund that money to the consumer, because

it needed to go to IFS as per the signed buyer’s order.

Regarding the second point of the increase in lease pricing

effective July *, the prices did increase which would not be reflected in

advertising the vehicle. Every month,

every dealer is given guidelines by Infiniti allowing the dealers to advertise

a certain price point for a vehicle. In

the case of the Q50, that price is $349.

However, different down payments would be used in order to allow the

offer to remain at $349. This is

definitely the case. In fact, the

residual on the consumer’s lease was 63%, whereas the residual on July [redacted]

was reduced to 55%. This is the same

vehicle, different residual amounts which would have raised the consumer’s

payment. In addition, Infiniti lowered

their customer owner loyalty from $1500 to $1000 on July [redacted]. Again, this would either have raised the

payment or required the consumer to pay an additional $500 upfront. We’ve also attached a copy of an email

received on July [redacted] from Infiniti Corporate outlying the increase

which would be effective after the weekend when the consumer purchased the

vehicle. The memorandum states that an

increase could be expected between $25 - $90 / month. This increase was immediately impacted

because the residuals decreased, not just for Infiniti, but for other

manufacturers as well. The dealership

personnel acted honestly and truthfully in their communications with the

consumer, at all times trying to help the consumer receive the best offer.

In reference to the unfortunate experience the consumer had

with the lack of install of the Lojack system, we agree 100%. This misunderstanding between the Lojack

vendor and our facility was unacceptable.

We apologize profusely and will agree to pay for the satellite radio for

the consumer’s 39 month lease. In order

to accomplish that task, we would need the radio ID from the satellite

radio. This code is displayed by turning

the dial to channel zero (“0”). Once we

receive this code from the consumer, we will contact the satellite provider and

arrange payment. We believe this to be a

reasonable request and will complete this commitment upon receipt of the radio

ID.

We would like to thank the consumer for being our customer. We understand there are many choices out

there and when things don’t go smoothly, the experience becomes tarnished. We are hopeful this relationship will become

strengthened over the term of the lease.

The consumer has leased several vehicles from our dealership and has

been a customer for many years which is extremely appreciated. If there are any further questions, please do

not hesitate to contact us in the future.

Thank you for receiving our response.
