I am rejecting this response because:
Whomever wrote this response states that *** *** is a Senior Project Manager with Infinity MarkWe understood *** *** to be the owner of this companyOn Tuesday September 30th, we had received an email from *** *** acknowledging our concern about giving a deposit to start, but he responded, "I can assure
you that if we don't deliver you will get your refund." I have email proofTo suggest that we are looking to lower our budget costs on this project is absurdI never want to deal with this company again
With the exception of one time to do a walk through of the system, we have been been told, our modem was hit by a lightning strike, I'm ill and have to go get tests at the hospital, My mom is ill and has been admitted into hospital*** is ill, we had an electrical surge and blew up my computer, Oh, I'm ill again and when we expressed frustration, we get told oh, maybe you should work with another developer, but I'm so close and want to show you what I have completedNo refund is offeredSo one last try to do a walk through, now someone died in KansasI have documented emails to support these allegationsWhat's worse is that we receive an email saying that he will have someone contact us and then no oneWhat I find strange is after we send him a notice of default, because they missed their deadline, *** says "***" is responding to the Revdex.com ComplaintWhy didn't "***" Contact us to put us at ease and get another developer to walk us through the system
Also what I find even stranger is that I contacted Austin Electric Utilities today and they have had no reports of over last days of power surges enough to blow up computers in all of Austin and the surrounding areaI also contact the NOAA in New Braunfels TX and funny no lightning strikes to take out ModemsYou would think a development company whose livelihoods depend on up-time would use power surge equipment
I demand a refund

Our Senior Project Manager, [redacted], has been in constant contact with this client throughout the month since we have been working on it, and despite the fact that there have been a few delays in our last two deliverables every single time [redacted] has indicated to [redacted] that he wanted us to...

continue to move forward.  [redacted] last offered a refund on October 29, and he offered on two previous occasions to extend a refund because [redacted]'s boss, seemed very sketchy and seemed unreasonably agitated based on the progress that had been completed to that date.  You can see his last offer below from an exchange on Skype - but every single time [redacted] indicated that he wanted to move forward and did not want a refund.  We have put in substantial amount of resources on this project, and we even delivered the code and database to their server before they made their 2nd payment as they were supposed to do as per the project plan.  We believe they are trying to take advantage of us in order to lower their budget costs.  There is no reason for them to expect a refund at this point as we have continued to work on the project well beyond the 2nd payment being due.  If they want to move forward that is fine; and we will even waive the 2nd payment that is past due, but we WILL NOT extend any refund at this late date after all of the work we have put into this project.

I was reviewing  the deliverables with [redacted] this morning and please don't be offended with my comments, but other than the map and the front page being cleaned up, we really haven't seen how our media(test package) looks, or how the backend functionality works?
[10/29/2014 7:01:35 PM] [redacted]: Not offended - so let's be fair - you are referring to the fact that your initial version of the tour was not responsive - something that had nothing to do with our work.  Other than that you can see the tour within a sample profile (even though it ultimately needs to be moved to the top of the page - as is reflected in one of the todo tasks in BaseCamp).  In terms of the back end functionality I did show you some of that during our first walk through.  That is essentially the same although there has been quite a few changes.  What we're working on now with the parent company profile relationship and the ad platform all tied together with the ecommerce packages should all be ready to go by either Friday or Monday - I've put some expected eta's on some of these items in Base Camp.  As I mentioned, the additional resource would really help us get back on track.  While I feel very comfortable with where we're at - all things considered given that there were some complexities that I didn't anticipate - I can appreciate the fact that you're concerned in light of your past relationship.  I renew my offer to allow you to move forward with a different developer if you guys are too uncomfortable.  I suggest that the fact that we have not even thought about asking for any modification to the budget despite the fact that there have been some unforeseen complexities should demonstrate our commitment to the success of this project regardless of the overall cost to our company and hope that this will offset some of your concerns.
