Hello, Ms [redacted] : I am forwarding additional information regarding this complaintIn MrDe [redacted] 's letter of 8-3-15, he states that he inspected the "crack" in the concrete stepIf he indeed came to my home, he did not make his presence knownHe never called to say that he was coming overHe never rang or knocked on my door to say that he was thereI would like to know if he has any proof (such a photo of the chip in the step) that he was indeed at the house and looked at the damageThe concrete sidewalk and porch are brand new, just installed in September As you can see from MrD [redacted] 's proposal, he doesn't go into much detailThe rubberizing around the flashing is something that I would have expected to be done to complete the job Whether or not he charged me for the flashing is irrelevantAs you will see in the pictures I have attached, he did not complete the installation to the finished endAs stated in my original letter with the timeline, his own workman said that he was returning to rubberize or caulk the chimneyDuring my first calls with MrD [redacted] , he never states that the job was completeIn fact, he states that he will return to complete the job when he returns to work on my daughter's houseIt is during the third call that he says that the rubberizing is not necessaryAnd in the fourth call, that he is done-the job completed.I have included several photos of the places where there are very large gaps that should be caulking or have some type of sealingAs it is now, the areas are open to the elements and insectsHe started the job, he took the money for the jobNow he should complete the job Thank you

IN RE: Claim No***To Whom It May Concern:I am in receipt of the Complaint dated October 26, 2017, and the following is my response:Please find attached the original work order dated May 9, A down payment of $was received on May 12, Once we started the project we worked
every day until we had the top wall 3/of the way doneBlake was the person that approved and signed the work orderThe owner (not Blake) came to the job at this point, and stated this is not what he wanted, even though Blake originally approved the work orderSo now the owner said he wants it to look more “rustic” and that the job was done too “nice”He wanted to change the mortarI asked the owner who was going to pay for the mortar color change (grinding out the old mortar), and the owner said “let me know how much it would be, and I will pay”I ordered the mortar for the color changeI GROUND OUT ALL OF THE MORTAR BECAUSE THEY WANTED TO CHANGE THE COLOR AND DO IT MORE RUSTICThen I went to the job to give the Owner and Blake (two) test samples of the mortar joint toolingWe did the samplesNeither Blake nor the Owner showed upI tried calling several timesBlake returned my call finally and asked how much it would be to point both gable endsTHIS WAS NOT INCLUDED IN THE ORIGINAL WORK ORDERTHE MAIN WALL WAS THE ONLY THING INCLUDEDI told Blake it was extra to complete both gable endsTHE OWNER THOUGHT THIS WAS INCLUDED IN THE PRICE of the original work order BUT IT WAS NOTThe problem was with the middle-man, Blake, and that he misunderstood.I did return the calls that Blake made, and tried to call both Blake and the Owner on several occasionsI am going to pursue a “breach of contract” matter with my attorneyWe did exactlywhat was on the contractOnce they said the work was “too nice” and they wanted it a different way, we wanted to change it (for a price, of course) and then they wanted additional work done for free (again, NOT on contract).My attorney does not feel that I need to show them an itemized list of material and labor expenses for the work we didA contract is a contractWe were going to finish the work according to the work order, but they said STOP and CHANGE to a different materialWe were going to do that, but again, it involved MORE labor and material.Blake and the Owner want an explanation of the improperly completed workAgain, we did the work according to the work order dated May 9, They did not like they way the work order stated, they said it was too NICE and to make it RUSTIC nowBlake said it was nice and good until the owner saw it and wanted to make it more rusticThe owner said that was fine to pay an additional cost to it the way he wanted.My attorney said I do not owe a refundWe were there, working according to the contractWe actually DID MORE WORK THAN WE ORIGINALLY CONTRACTED FOR BECAUSE WE GROUND OUT ALL OF THE MORTAR COLOR THAT WAS ON THE ORIGINAL WORK ORDER TO MAKE IT LOOK MORE RUSTIC FOR THEM BECAUSE THEY WANTED TO CHANGE IT.We are ready to pursue legal action alsoThere was a breach of contract and we did more work than what was on the original work order.Thank you for your timeIf you have any questions, please call me.Tony D***

In Re: ID #*** Dear Ms***:I am in receipt of your letter dated August 18, I am acknowledging the customer concernsOur company has decided to repair the flashing at no additional chargeThis service was actually done for Ms*** at no charge in the first placeWe will repair flashing at Ms***’s convenience (sometime after Labor Day).I am in no way responsible for the gouge in the concrete stepWe did not do this gouge and are not repairing it.If you have any questions or need further information, please feel free to contact me.Very truly yours,Tony D***

Dear Mrs. [redacted]:I am in response to your letter dated July 29, 2015. At this time, I would like to address the issue of the “damaged concrete” that you stated happened while we were completing your project. I would like to point out to you, that at the time when I was quoting your project, you...

stated to me that you were very unhappy with the concrete contractor that did your sidewalk. My employees did not damage your concrete sidewalk. I did inspect the crack in the concrete after your accusation, and the specific crack has been there as there was dirt and mold in the crack. I do not feel my company is responsible for fixing a problem that had occurred prior to our work being performed.In reference to the issue about the rubberizing the chimney cap, this procedure was not on the original work order, so therefore, we are not going to include this for free at this time. We already flashed your chimney for NO CHARGE. This would have been a $600.00 charge, but we chose to do this for free. We do not feel that, due to your negative attitude, that we should complete more work for free.I have enclosed the original work order. You paid for everything on the work order. You told me you were happy with the job at that time. Now you want more work for free, and you are saying we cracked your concrete that was already cracked. I would like for you to tell me what you would like done that is not on the original work order? There is nothing that is left to do on the original work order as everything is complete.
