The only repair I made on the car was to have the AC compressor replaced. When the car left my lot on 17 April 2015, there were no warning lights on and no known issues. The car was sold as is with No Warranty expressed or implied. The car was not sold with any buy back plan as the customer proposes. There was some rain on the afternoon the customer came to look at the car. Weather is for sure beyond my control. At the time the weather didn't seem to bother the customer. Through a lengthy negotiation the customer was able to get the deal he wanted. He didn't seem rushed in the least. He stayed long enough on my lot to negotiate several hundred dollars off the asking price. I did not take a deposit or do a buyers order on the 16. So there was no rush on my part. There was a whole day of cooling off time. The car was to be paid for and collected on the 17. The customer sent his wife to pay for and collect the car. I’m unsure what difference it makes whether she signed her name or his on the Buyers Order and Buyers Order. I’m unsure exactly what pressure I exerted on the customer/his wife to complete the transaction. The customer dictated the speed of the complete transaction, I see that some maintenance fluids were purchased by the customer. These would seem routine and probably necessary considering the customer knew that the ac compressor being replaced was the only repair completed by me. During the initial few days of ownership were there issues that were evaluated by an auto technician? The customer had issue with the tires. Were they replaced? It appears the Altima made at least one successful trip (maybe more) to Tennessee. It must have been running well enough to feel confident of another trip. If it wasn’t running well enough was there any diagnostic completed by automotive techs during any point in the customers ownership of the car? Has there been an evaluation/diagnostic of the car since being towed? At the end of the day, sell used cars and the customer bought a used car, no down payment to hold it, wife showed up to pay the money and took the car with no further inspection or questions. The car was sold as is with No Warranty expressed or implied. The car was not sold with any buy back plan as the customer proposes. [redacted] ***

As for the buyers guide issue, I cannot comment on whether the dealership regularly displays this on their vehicles or not because I did not look at any other vehiclesHowever, it was not displayed on this particular car at the time I looked at itAs for the signature on the buyers guide in his attachment, the dealer pressured my wife into signing my name to speed up the transactionI was supposed to get the car after I got off work, but the dealer wanted to complete the sale. If you would like, you can refer to the signature on my driver's license that is in the attached pdf fileI always extend the curve of my D past both ends of the vertical line and the m ends in a straight line, it does not curve back the other directionThe other letters on the buyers guide attachment also are curvier than my signatureMy wife would also be available to testify this under oathThe sale was clearly rushed, and the salesman took advantage of the rainy weather while I was there by performing his sell from under the roof of his office, where he could tell me how good of a car this wasHe did, however, lower his asking price, which I thought was because I mentioned that the tires were worn and needed to be replaced and I didn’t like the color (I thought the car was gray in the picture, but it turned out to be a sandy looking color)
The dealer also said that he would buy me some new floor mats for the car, since it didn’t have anyHowever, he didn’t and when he was asked for them, he wouldn’t get them
I have also attached copies of the receipts to show that I had purchased quarts of oil on April on a trip to a doctor’s appointment in TNThis was the first time the car had been driven longer than miles, and the oil pressure light came on to show that it was low on oil (It checked fine before we left Owensboro)Even after adding a quart of oil, the oil pressure light would still come on at idleTherefore, I bought more oil and a filter for an oil change on April Although the oil pressure light did not come on again after the oil change, I saw something strange in the oil that was drained from the carAs you can see in the attached photo of the oil draining from the filter, there is an inconsistency in the oil, which I believe is metal shavings from internal engine parts and possibly oil additives to keep the oil pressure light from coming on
I have also attached a photo of a receipt showing where I had to buy automatic transmission fluid to replenish what had leaked outWhen I looked at the car, the salesman voluntarily said that the car didn't leak any fluids
I have also attached photos of both the driver side and passenger side rusted floor pansThey rusted to the point that they are about to fall throughAll of these issues, in addition to the power window that will not stay rolled up, where noticed within the first week of owning the car that “runs/drive/looks good.”
I have also attached a scanned receipt showing that I had to pay $to have the Altima towed home after it broke down on an Interstate about a month after the sale
After the car broke down on the interstate and stranded my wife for a hour and a half while she waited for me to come get her and take her the rest of the way to her doctor’s appointment, she and I want this car goneI feel like I was defrauded and I would like to have this matter resolved quicklyTherefore, I would like to propose that I return to the seller the “nice” car that he sold me and he refunds $3,dollars cashI now have approximately $5,dollars invested in this car (including selling price, taxes, and insurance that I am still paying for a car that I cannot drive, a $tow, diagnostics, and parts and fluids that I have bought for it)The seller can then junk the car to recover more money, sell it for parts, or he can have it refurbished

In the response from Mr. [redacted], he stated that there were no
known issues with the Altima when it left his lot. However, there were several
issues with this car when it left the lot. Unfortunately, I was not given a
good environment to inspect the car because it was raining the only time I saw
it, I had no way of  lifting the car to
look underneath it, and he did not want the car to leave his lot. Therefore, I
took his word when he told me “the car is clean underneath and it is not
leaking any fluids.”
I mentioned the worn tires because this was one reason why I
wouldn’t pay retail price for this car. Mr. [redacted] was wrong to say the Altima
drove well at highway speeds. The car actually had a bad vibration above 45mph.
I would later find that this vibration would become quite violent at interstate
speeds. The outer edges of the tread were worn past 50%, indicating that the
front end needed an alignment, along with new tires. However, the need for an
alignment could have been caused by something else, such as worn ball joints.
This, along with the color of the car, is why I thought he lowered his price.
In the photo he posted on craigslist, I thought the car looked gray. However,
the car was actually beige- and I told him I thought it was ugly. There wasn’t
a lot of negotiating the price on my part. I offered a price. Mr. [redacted] just
continued to talk about how good of a car this was and he would lower his
price. However, I didn’t really say anything because I hadn’t gotten a good
look at the car yet. I actually had to leave because my wife had to go to work
and I needed to be home to watch my children. But just as I walked away, Mr.
[redacted] said you have a deal. I was shocked, because I didn’t even know what the
deal was. When I agreed to his deal, I told him I would be back there after I
got of work the next day, hoping that I could get a better look at the car or
have my friend who works at [redacted] Tire to inspect the car. I also expected him
to give me contact information for the previous owner. This is why I was upset that
Mr. [redacted] had my wife sign my name on all of the paperwork to complete the transaction, which included the
Buyer’s Guide that I never saw.
Enclosed is a copy of the inspections done by the local
Nissan dealership. On May 5, I was given an appointment from Nissan to have the
floor pans inspected for the rust issue. As shown in the comments, “both left
and right side floor pans are rusted out.” To make the necessary repairs for
the floor pans, the lower section of the interior would have to be removed.
Then, the rusted section would have to be cut out and new metal would have to
be welded in its place. The customer service representative told me that this
would cost around $2,500. I doubt that anyone would dare argue that this rust
did not exist when the car was on the [redacted] Family Motors lot.
The seller made the comment in his previous response that he
saw that I had purchased maintenance fluids. All ten quarts of the oil I
purchased were poured into this car’s engine. The first five quart jug I bought
the second day I drove the car because on the way to Nashville
(which was about 130 miles away), the low oil pressure light was coming on. I
ended up adding about a quart and a half of oil to the engine that day (the oil
level was at the top of the fill mark when I left Owensboro, KY).
This Altima was burning through oil so fast that I put a milk crate in the
trunk of the car and filled the crate with engine oil, transmission fluid, and paper
towels so that I could check and add fluids whenever I drove the car. In this
car’s case, oil cannot be considered a maintenance fluid because you would have
to add a quart of oil before you would have to fill the tank with gasoline. The
second 5 quart jug was used for an oil change, hoping that the low oil pressure
was caused by dirty oil.
After the first trip to Nashville,
I knew that there were issues with the engine and it would not last much
longer, so I contacted Mr. [redacted] and told him that the car I just bought the
previous weekend was junk. Mr. [redacted] would only say that he did not know
anything was wrong with the car. Therefore, I asked for a second time for him
to get me contact information for the previous owner, like I previously
requested the day I looked at the car. Mr. [redacted] later sent me a text message
stating that he could not get the contact information for the previous owner. Mr.
[redacted] originally told me that the Altima was a local trade in. However, in an
earlier post to the Revdex.com, Mr. [redacted] stated that the car was
purchased from a main dealer here in Owensboro,
KY. I don’t understand why he couldn’t give
me this information when I asked for it; after all, isn’t it a state law that Kentucky
car dealers must give the previous owner’s contact information to buyers? This
information could have helped me avoid this buying disaster if the previous
owner were to tell me about how the car burned oil or that the floor pans were
rusted through. Another piece of useful information I may have acquired from
the previous owner is that, according to [redacted] Automotive, the head gasket
had been replaced.
I have enclosed a copy of the diagnostics from [redacted]
Automotive. It took me a while to get this estimate because the car had to be
towed to their service department.  When
they inspected the car, the check engine light was not on and it is still not
on today. However, a code scanner pulls the ECM code P0011. The diagnostic
shows the engine is in limp mode, meaning that the car will only idle. The
estimate to tear apart the engine for an inspection was $1,500. The estimate
for a used engine was $2,150 for the engine only. The estimate for a
remanufactured engine was $4,012.67. They did not give me a quote for labor,
which would make the total repair cost even higher.
As for confidence in the car, I knew it was only a matter of time before the engine would go. My wife was not supposed to take the Altima to Nashville the day it was towed. She was supposed to ride with her uncle. I told her if she had to go by herself, that she better take the Jeep that she normally drives. However, she thought that she would take the Altima because it got better gas mileage and that's why we bought it. However, the Altima never got anywhere near the 30mpg that Mr. [redacted] claimed it was capable of in his craigslist ad. It only got 21mpg on our first trip to Nashville, which was nearly all parkway and interstate miles.
A car dealership is a licensed business and should be accountable
for what they sell. The week before I purchased the Altima, I called a
dealership in Evansville to inquire
about a used 2005 Mitsubishi Outlander. I asked a few questions about it and it
seemed to offend the salesman. He told me “if there was anything wrong with the
car, it would not be on the lot.” This is the problem between [redacted] Family
Motors and me. The Altima that he sold me clearly had existing problems that
were not repaired before this car was advertised for sale.
I have spoken with some consumer protection lawyers and I
think this matter may have to be decided in court. However, I would not like to
pay his fee, nor would I want to have to miss work. Therefore, I am giving Mr.
[redacted] one last offer, hoping to end this nightmare of a transaction. I know that
the Altima he sold me would cost twice its value to repair. However, I would
like Mr. [redacted] to refund $1,500 to me that I can use as a down payment on
another car. This is my final offer and it must be accepted and paid by July 15, 2015. If Mr. [redacted] decides to
decline my offer, I will be seeking full reimbursement for all expenses in
court.

As for confidence in the car, I knew it was only a matter of time before the engine would goMy wife was not supposed to take the Altima to Nashville the day it was towedShe was supposed to ride with her uncleI told her if she had to go by herself, that she better take the Jeep that she normally drivesHowever, she thought that she would take the Altima because it got better gas mileage and that's why we bought itHowever, the Altima never got anywhere near the 30mpg that Mr[redacted] claimed it was capable of in his craigslist adIt only got 21mpg on our first trip to Nashville, which was nearly all parkway and interstate miles.A car dealership is a licensed business and should be accountable
for what they sellThe week before I purchased the Altima, I called a
dealership in Evansville to inquire
about a used Mitsubishi OutlanderI asked a few questions about it and it
seemed to offend the salesmanHe told me "if there was anything wrong with the
car, it would not be on the lot." This is the problem between [redacted] Family
Motors and meThe Altima that he sold me clearly had existing problems that
were not repaired before this car was advertised for sale
I have spoken with some consumer protection lawyers and I
think this matter may have to be decided in courtHowever, I would not like to
pay his fee, nor would I want to have to miss workTherefore, I am giving Mr
[redacted] one last offer, hoping to end this nightmare of a transactionI know that
the Altima he sold me would cost twice its value to repairHowever, I would
like Mr[redacted] to refund $1,to me that I can use as a down payment on
another carThis is my final offer and it must be accepted and paid by July 15, If Mr[redacted] decides to
decline my offer, I will be seeking full reimbursement for all expenses in
court
