Good morning,
"margin: 0px;">
Thank you for taking the time to speak with me and also to accept this email as my official rebuttal to **[redacted] slanderous accusation and unreasonable "desired outcome/settlement". This is an attempt to extort a resolution which is outrageously extreme. This is evident by [redacted]' haste to file official complaint with your office and the office of Virginia Attorney General without allowing us the opportunity to respond/resolve matter via proper channel ([redacted].com)
1. This is an [redacted].com purchase and must follow procedure on [redacted].com - [redacted] provides several channels for customer satisfaction matters and returns. None were utilized by complainant in this case. No opportunity was given us to resolve this matter
2. [redacted] brand name is used for cataloging reference. [redacted] ([redacted]) is a national brand ([redacted] ([redacted]) and [redacted] ([redacted]) are also part of the [redacted]) – the "generic" part as [redacted] stated is a well-respected reputable US company which is arguably equivalent to [redacted] and certainly no unknown house brand. If [redacted] has attempted to contact either manufacturer, the communication is here requested to be reviewed
3. [redacted] contacted us on 2/7/on [redacted].com message center with a brief message as follows:
"GreetingsI purchased this item from you July First issue is it is not brand advertised[redacted] is what I bought See attached picture for what I received (not [redacted])Other issue is less than six months and item has failed[redacted] comes with month warrantyPlease let me know what I need to do to get warranty replacement." THIS IS THE ONLY COMMUNICATION THERE HAS BEEN BETWEEN [redacted] AND OUR COMPANY!
4. [redacted] filed complaint with Revdex.com on 2/8/and also with Virginia Attorney General's Office stamped received on 2/11/accusing us of "FRAUDULANT" activity. This naturally is of great concern to us. This is slander without merit We ship thousands of orders every year and have not once had such case filed against us. We resolve customer care matters immediately. [redacted] bypassed all proper requirements of a warranty exchange and/or return which brings into question the validity and integrity of this complaint. Furthermore, we were NEVER notified that there was an issue with the brand that was received by complainant at time order was received prior to the message on 2/7/– The part was received and installed on the vehicle. If part was "FRAUDULANTLY SENT" as stated by [redacted] in this complaint, why was it installed and why were we not notified of his dis-satisfaction with the product received until months later in the form of an official complaint to Revdex.com and Virginia Attorney General's Office? [redacted] states there is a month warranty on [redacted] products in his message to us then states there is year/ 50,mile warranty in his official complaint – we offer a year warranty on catalytic converters against manufacturer defects no matter the brand or manufacturer – this is as a courtesy and is covered by us, NOT manufacturer. We have relations with [redacted] and [redacted] (also known as [redacted] and [redacted] Bomb) therefore we have the ability to absorb any loss if we feel the manufacturer's rejection of a warranty claim by our customer is "unfair" to the customer. I can provide the warranty terms and coverage of [redacted] and [redacted] upon your request for your reference
5. [redacted] claims on the official complaint filed with Virginia Attorney General's office: "Were the completed repairs different from what you had authorized?" to which he answered "YES" – this statement is – We do not and did not "complete repairs" as we do not offer repairs nor claim to offer such service. Please take note of this fact as it does not apply to our sales of auto parts – this is a made up answer aiming to add validity to this claim based on a non-truth representation of [redacted]' complaint to official offices of Revdex.com and Virginia Attorney General
6. A catalytic converter is a type of part that requires specific installer knowledge and proper pre and post diagnostic tests done by a certified car care professional (mechanic). Proper diagnostics must be conducted to reveal any pre-existing mechanical failures on the vehicle are recognized and repaired prior to installation of a new catalytic converter. If these repairs are not performed prior to installation by a certified professional, the new catalytic converter will fail soon after installation and is caused by mechanical failures which led to original part failing – we will need to see the certifications of the car care professional who installed this part along with the diagnostic results of tests performed and proof of repairs completed for proper function of the new catalytic converter which [redacted] received from us and installed on his vehicle. (The information is available in great length on the internet in regards to inherent issues with improper diagnosis and repairs performed causing new catalytic converter failure - we can also obtain detailed information from our suppliers)
7. Warranty coverage under no circumstances cover labor and/or shipping costs associated. [redacted] is requesting both as part of his desired resolution. This is NOT acceptable
8. [redacted]' intent here must be questioned. The manner in which this complaint has been rushed to official offices without notice nor ample opportunity for us to resolve must be considered This manner in which this consumer has chosen to obtain a replacement part for an item raises many questions which I hope Revdex.com and Virginia Attorney General's office will investigate
To conclude:
This claim is NOT indicative of how we conduct our business. This is attempt to force an issue and is of extreme proportion. The fact that there was no reasonable attempt made by complainant to inform us of his dis-satisfaction with product received, installation of said part even though it is claimed to have been "fraudulently sent", not allow ample time to respond and/or resolve, providing a picture which was taken at time of receipt yet without any notification to us nor [redacted].com only to be sent as proof of a claim filed in great haste to government offices, leaves us to question the true meaning and intent of such actions
We do not want any consumer (specifically one who has been a customer of ours) to feel as if they were not given a great customer experience or did not get a solid product. We appreciate [redacted]' business and would like to be of further service to him. Therefore, we would like to be amicable and forthcoming – with that in mind, [redacted]' desired settlement will be considered (plus more) under following condition:
After we have received the certifications of the car care professional who installed this part along with the diagnostic results of tests performed and proof of repairs completed for proper function of the new catalytic converter which [redacted] received from us and installed on his vehicle - Upon receipt of requested information and defective catalytic converter, this information and the defective part will be sent for testing and review. The results will be readily available upon completion for review and scrutiny. If it is deemed that the defect is caused due to manufacturer defect, we will honor [redacted]' request to send replacement [redacted] catalytic converter along with the requested $for labor and $shipping. Furthermore, we will ship the [redacted] unit to [redacted] at no cost to him AND we will include a $pre-paid [redacted] or [redacted] as a token of appreciation for his patronage
Thank you for taking the time to consider my rebuttal and please do not hesitate to contact me if I can be of assistance
Regards,
[redacted]

This refund has been issued as follows: [redacted] transaction id [redacted] on 11/23/16 and the complaintent has been notified via email both by [redacted] and ** Auto Parts - screen shot attached - this matter is in the state we continue to argue due to a hasty decision to press the matter to its maximum over a 1 week period - the funds were refunded the day thy were released by [redacted] - the customer seems to be under the impression that we are looking to bamboozle him out of $40 - we send close to a 1000 packages per month - the aggressive and unnecessary behavior of this customer is pu**ling yet we gladly are proactively perusing the end of this time consuming hateful behavior towards our company and good name.  Thank you for your patience and best of luck in future Internet orders - we sincerely apologize for the inconvenience

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed as Answered]
 Complaint: [redacted]
I am rejecting this response because:It is false and lacks basis in fact. The parts are not used, they simply do not work with my vehicle and were returned because my car could not even start. They were returned within a few days and refund was requested. The business refused to follow their own return policy and refused to refund me the money claiming the parts were good. [redacted] dealership installed OEM parts and my car ran just fine. With their parts the car would not start that is why the parts were returned and refund was requested. Again, they denied my request for a refund and tried to blame me claiming that the parts were used. Well how is a customer going to know if the parts work unless they are actually installed and tried??? Since the car would not even start with their parts installed the parts were removed and sent back for a refund. I would love to see documentation where they offered a refund but I "refused". There is no such documentation because had they send me a refund for their defective parts we would not be here in the first place therefore their argument is false. If they send me the parts I will promptly return them as they are defective and I do not need them. All I want is the refund. Thank you.
Regards,[redacted]

[redacted],

Enough delays! The information you ask for is irrelevant to our situation. Once again your information is incorrect. [redacted] DID NOT issue a recall for my car regarding the catalytic converter. [redacted] decided that the factory installed converters did not last long enough to meet [redacted] standards. Therefore as a courtesy [redacted] replaced without cost anyone who had their factory converter fail in the first 80,000 miles. My factory converter lasted 134,000 miles. The generic unit you substituted for the brand name [redacted] unit I paid for lasted 9,000 miles.

This is my last correspondence with you. No more excuses, no more delays, no more questions, no more clarifications. If I do not receive a brand new unused [redacted] p/n [redacted] by May31st, I will start a whole new wave of pressure to get you to do so. I will contact [redacted] about your bait and switch and I will supply them with all the information and correspondence that has taken place through the Virginia Attorney General’s office. My attorney has also brought to my attention that since our transaction took place across state lines there is likely Federal Trade Commission Mail and Wire Fraud authority.

Sincerely,

I am rejecting this response. Per the email they sent me on September 28th my refund would be sent shortly. I dont understand why if I was told the refund would be sent, why now are they stating something different. I will be happy to go to the place I sent the order back at, they should be able to provide confirmation the package was delivered. I did receive confirmation, but seem yo have misplaced the documentation. I still do not believe this is a legitimate answer to my complaint. I only became frustrated when they were not doing as they said they would.

The order # provided by this attempt to blemish our company's excellent standing in the [redacted] community and our Revdex.com standing is not an [redacted] order # - [redacted] does not keep the records for sales on their website available to either party involved in a transaction past 3 months - We use a third party...

software which allows us to keep our own records due to the high volume of business we conduct on our eCommerce venues - We have no record of a sale to a Mr [redacted] - our records indicate order # [redacted] dated 3/20/14 is to a different customer with different name and different email address - we do not recognize this customer and request action be taken to remove this erroneous claim from public record.  We sell thousands of ignition coils a year for much more than $17 at a 99.8% positive rating with 3955 positive feedback - We offer lifetime warranty and free shipping on all of our product sales - our policy is clearly stated on ALL sales under the "Policy" tab of the description portion of the listing as well as on our website at: http://[redacted] for public review.  We will gladly make public any and all communications our company may have had with a customer upon request.

As previously stated, provide us with written proof of delivery or a tracking # showing the item was returned and we will issue the refund less 20% re-stock fee and shipping charges paid as part of the free shipping promotion.  Thank you. Also, in response for your reason of rejection to our original reply in this matter, you were told it will be processed but they could not find your package because, again, NONE of the return procedure requirements were followed by the customer.  Once your conduct became belligerent which is an unacceptable aggressive treatment of our staff, at that point the matter was no longer eligible to receive attention.

Customer ordered on 10/26/16 - by 11/1/16 the [redacted] case was opened and escalated at which point [redacted] review takes complete control of the payment with-holding it from our account until resolved.  Also removed is our ability to process the refund as per customer request - on 11/13/16 Revdex.com...

complaint was registered and the following message sent to us: On Nov 13, 2016, at 11:15 AM, [redacted] <[redacted]> wrote: I have attached a copy of the Revdex.com complaint I filed. I will also send you the consumer protection complaint I am filing with the internet fraud division of the attorney general's office Best regards Which indicates more urgency in an attempt to bully and cause damage to our business integrity then the $30 refund requested.  For the record it is a $40 refund due.  All email communications is attached - not clear as to why this behavior is warranted nor where the fraudulent conduct is performed against this individual or in this transaction, as it clearly states in our return and refund policy, posted on the website and agreed to at time the purchase is completed by customer, refunds take 7-30 days to process.  Not 5 days from date of purchase.  Regardless we would like to offer this person a full refund and to keep the parts for so much time wasted on a matter simply resolved by display of the slightest bit of patience and human relation practices.  As we have an abundance of time to serve this type of demand and communication.  At this point however we are not able to perform this task as the case is under review which locks us out of the refund process.  Once the case has been closed and restriction lifted, we will gladly issue refund as promised - this individuals payment is not the type of business we consider good business and rather not have potion of it even though we will be out of pocket the funds and goods.  Thank you for your correspondence.  Wishing you a peaceful holiday season and all the best. ** Auto Parts

 Complaint: [redacted]
I am rejecting this response because:1. [redacted] is NOT a functional equivalent to [redacted]. It is a generic unit worth a fraction of the brand name [redacted] unit. (See Attached)2. I did contact Yogi Auto Parts through the website ([redacted].com) I purchased the unit from and before I escalated to Revdex.com and VA Attorney General. Yogi Auto Parts responded "Very Sorry past our 60 day return" I did try to resolve through less severe channels. By refusing to address their improper actions Yogi Auto Parts has chosen this forum to resolve this issue.3. In their response, Yogi Auto Parts has clearly admitted they shipped an item different than what I ordered. If someone sends you something less valuable than what you ordered it is called bait and switch. Bait and switch is fraud. 4. If Yogi Auto Parts had checked (like I did) they would know that the company that has purchased the generic brand [redacted] will no longer honor [redacted] warranties. However that should not be my problem because I ordered and paid for a [redacted] unit. 5. Even if [redacted] honored the warranty I have no proof I purchased an [redacted] unit because I purchased a [redacted] unit and Yogi Auto Parts fraudulently substituted the generic [redacted] brand.6. I have paperwork that says I purchased a [redacted] unit. I cannot get warranty service from [redacted] because I do not have a [redacted] unit.7. If Yogi Auto Parts offers a "5 year warranty on all catalytic converters against no matter the brand or manufacturer" why didn't they simply tell me that when I contacted them through [redacted].com. Again, Yogi Auto Parts has chosen this method of resolution.8. The failure with the generic [redacted] was a mechanical failure. By that I mean the secondary converter de-laminated and has a loud rattle at all speeds. The repair shop that diagnosed the problem is Foreign Exchange www.foreignx.com. This failure was not caused by the vehicle.9. Yogi Auto Parts is offering that after I buy a new unit and have it installed and then return the old unit to them they will send me (another) new unit??????10. Brand name catalytic converters do not fail within 6 months. Because Yogi Auto parts fraudulently substituted a generic unit for the name brand unit I purchased that is why I am asking them to pay for the shipping and installation costs.11. If Yogi Auto Parts will send a new ([redacted] only) unit and installation costs to the repair facility that I used to install the original unit. I will instruct them to send the generic unit back. That will be accedptablke soultion.

support for returns and warranty coverage, for this exact reason, people need to be and k ow they are being documented and a methodical procedure is taking place they tend to become a lot more courage and make up, change, manipulate and take advantage of a system intended to be of good service. I am relying to his most recent request about an update. The conversation has not been at all what this complaint says. I will let him know in the email that I am also sending for Revdex.com simultaneously. That is really surprising. He was so nice and passive and cooperative on the phone and his emails yet the complaint is a totally incorrect. We have 1 rule for the warranty. We need the original packing slip which has one of these guys initials. He does not have that and I was going to send him replacement anyways though he cannot provide the only document he needs.Regards,

 Complaint: [redacted]
I am rejecting this response because:
My name is also known as [redacted] and address is [redacted]., verona, nj 07044. Yogi auto parts is a total crook. They ship the order to the same address and their return policy was not state the same as current one. They changed their policy after my complaint because of afraid that [redacted] will give them punishment.
Buyers should be aware of their crooked conducts, they simply say they offer lifetime warranty and find a reason to refuse to honor it. Please see the funny part of their policy, "you have to buy six of their coils in order to have the warranty". Before that, even buy one will do, so what happened ? Your coils suddenly become worse(it'actually is junk)? Buy six is not mean install six, it's a total joke. I don't even dare to use their products again, it like a ticking bomb! How much money(they want you pay both ways of shipping, it was not mentioned on their previous " version" of policy, who know what's on their next version?)and time are we going to waste on this crook? I just hope nobody will fall victim anymore.

The order # provided by this attempt to blemish our company's excellent standing in the [redacted] community and our Revdex.com standing is not an [redacted] order # - [redacted] does not keep the records for sales on their website available to either party involved in a transaction past 3 months - We use a third party software which allows us to keep our own records due to the high volume of business we conduct on our eCommerce venues - We have no record of a sale to a Mr [redacted] - our records indicate order # [redacted] dated 3/20/14 is to a different customer with different name and different email address - we do not recognize this customer and request action be taken to remove this erroneous claim from public record.
This case is erroneous from the start with false buyer information to the slanderous portray of our business practice which simply is also fiction.  Below is our records of order # [redacted].  Please verify and provide your active [redacted] username in order to locate and display all communications.

Order

Received partial order, no human contact, have sent several emails as directed by answering machine, this is a scam outfit, do not buy from these people.

Review: July 2013 I ordered a catalytic converter from Yogi Auto Parts ([redacted].com order number: [redacted]). The item I ordered clearly stated [redacted] brand p/n [redacted]. [redacted] warranty is 5 years/50,000 miles. The item has recently failed. I cannot get warranty coverage on item because Yogi Auto parts fraudulently switched and sent a generic part not the [redacted] brand therefore [redacted] will not warranty someone else's part.Desired Settlement: I would like Yogi Auto Parts to ship what I ordered. Ship me a [redacted] p/n [redacted]. Furthermore it will cost me $192.00 to have the new unit installed plus $35.00 to have the failed unit shipped back. After I receive the correct part I will promptly return the failed generic unit that was fraudulently sent.

Response:

Good morning,

Thank you for taking the time to speak with me and also to accept this email as my official rebuttal to **. [redacted] slanderous accusation and unreasonable “desired outcome/settlement”. This is an attempt to extort a resolution which is outrageously extreme. This is evident by [redacted]’ haste to file official complaint with your office and the office of Virginia Attorney General without allowing us the opportunity to respond/resolve matter via proper channel ([redacted].com).

1. This is an [redacted].com purchase and must follow procedure on [redacted].com - [redacted] provides several channels for customer satisfaction matters and returns. None were utilized by complainant in this case. No opportunity was given us to resolve this matter.

2. [redacted] brand name is used for cataloging reference. [redacted] ([redacted]) is a national brand ([redacted] ([redacted]) and [redacted] ([redacted]) are also part of the [redacted]) – the “generic” part as [redacted] stated is a well-respected reputable US company which is arguably equivalent to [redacted] and certainly no unknown house brand. If [redacted] has attempted to contact either manufacturer, the communication is here requested to be reviewed.

3. [redacted] contacted us on 2/7/14 on [redacted].com message center with a brief message as follows:

“Greetings. I purchased this item from you July 2013. First issue is it is not brand advertised. [redacted] is what I bought See attached picture for what I received (not [redacted]). Other issue is less than six months and item has failed. [redacted] comes with 12 month warranty. Please let me know what I need to do to get warranty replacement.” THIS IS THE ONLY COMMUNICATION THERE HAS BEEN BETWEEN [redacted] AND OUR COMPANY!

4. [redacted] filed complaint with Revdex.com on 2/8/14 and also with Virginia Attorney General’s Office stamped received on 2/11/14 accusing us of “FRAUDULANT” activity. This naturally is of great concern to us. This is slander without merit. We ship thousands of orders every year and have not once had such case filed against us. We resolve customer care matters immediately. [redacted] bypassed all proper requirements of a warranty exchange and/or return which brings into question the validity and integrity of this complaint. Furthermore, we were NEVER notified that there was an issue with the brand that was received by complainant at time order was received prior to the message on 2/7/14 – The part was received and installed on the vehicle. If part was “FRAUDULANTLY SENT” as stated by [redacted] in this complaint, why was it installed and why were we not notified of his dis-satisfaction with the product received until 7 months later in the form of an official complaint to Revdex.com and Virginia Attorney General’s Office? [redacted] states there is a 12 month warranty on [redacted] products in his message to us then states there is 5 year/ 50,000 mile warranty in his official complaint – we offer a 5 year warranty on catalytic converters against manufacturer defects no matter the brand or manufacturer – this is as a courtesy and is covered by us, NOT manufacturer. We have relations with [redacted] and [redacted] (also known as [redacted] and [redacted] Bomb) therefore we have the ability to absorb any loss if we feel the manufacturer’s rejection of a warranty claim by our customer is “unfair” to the customer. I can provide the warranty terms and coverage of [redacted] and [redacted] upon your request for your reference.

5. [redacted] claims on the official complaint filed with Virginia Attorney General’s office: “Were the completed repairs different from what you had authorized?” to which he answered “YES” – this statement is FALSE – We do not and did not “complete repairs” as we do not offer repairs nor claim to offer such service. Please take note of this fact as it does not apply to our sales of auto parts – this is a made up answer aiming to add validity to this claim based on a non-truth representation of [redacted]’ complaint to official offices of Revdex.com and Virginia Attorney General.

(The information is available in great length on the internet in regards to inherent issues with improper diagnosis and repairs performed causing new catalytic converter failure - we can also obtain detailed information from our suppliers).

7. Warranty coverage under no circumstances cover labor and/or shipping costs associated. [redacted] is requesting both as part of his desired resolution. This is NOT acceptable.

8. [redacted]’ intent here must be questioned. The manner in which this complaint has been rushed to official offices without notice nor ample opportunity for us to resolve must be considered. This manner in which this consumer has chosen to obtain a replacement part for an item raises many questions which I hope Revdex.com and Virginia Attorney General’s office will investigate.

To conclude:

This claim is NOT indicative of how we conduct our business. This is attempt to force an issue and is of extreme proportion. The fact that there was no reasonable attempt made by complainant to inform us of his dis-satisfaction with product received, installation of said part even though it is claimed to have been “fraudulently sent”, not allow ample time to respond and/or resolve, providing a picture which was taken at time of receipt yet without any notification to us nor [redacted].com only to be sent as proof of a claim filed in great haste to government offices, leaves us to question the true meaning and intent of such actions.

We do not want any consumer (specifically one who has been a customer of ours) to feel as if they were not given a great customer experience or did not get a solid product. We appreciate [redacted]’ business and would like to be of further service to him. Therefore, we would like to be amicable and forthcoming – with that in mind, [redacted]’ desired settlement will be considered (plus more) under following condition:

After we have received the certifications of the car care professional who installed this part along with the diagnostic results of tests performed and proof of repairs completed for proper function of the new catalytic converter which [redacted] received from us and installed on his vehicle - Upon receipt of requested information and defective catalytic converter, this information and the defective part will be sent for testing and review. The results will be readily available upon completion for review and scrutiny. If it is deemed that the defect is caused due to manufacturer defect, we will honor [redacted]’ request to send replacement [redacted] catalytic converter along with the requested $192 for labor and $35 shipping. Furthermore, we will ship the [redacted] unit to [redacted] at no cost to him AND we will include a $100 pre-paid [redacted] or [redacted] as a token of appreciation for his patronage.

Thank you for taking the time to consider my rebuttal and please do not hesitate to contact me if I can be of assistance.

Regards,

Yogi Auto Parts
