Initial Business Response /* (1000, 13, 2015/08/05) */
Hello, I would like to respond to this claim by first say that there was never a time schedule included in the contract and Mrs [redacted] was constantly changing her mind about major details of the swimming pool which prevented me from even...

drafting a contract. I have all of her text messages if it would help with this issue. We experienced unusual amounts of rain prior to us starting her pool which upset them and caused her husband to yell at Mrs [redacted]. He was also mad that we had to wait for the utility locate which is a state law. I l have been in business for over 20 years and have never met anyone as impatient and indecisive as the [redacted]'s. I drove to their home 5 separate times (which is a 140 mile round trip ) to meet Mr [redacted] and he stood me up every time. Once I had a signed contract we were there the next day and formed the entire pool. At that point we had to wait for one call and that upset them. When the locate was done the escavator scheduled for the following day and that wasn't good enough so they fired me. I then contacted my lawyer and he advised me to bringing the remaining money to him and he would pay they if [redacted] signed a release. She signed it and received the remaining money that her and I agreed on. If you need the text messages or anything else let me know. Thanks [redacted].

Do we feel that it was right for this contractor to charge us 3400$ for material that cost less than $500.oo and less than 1 full days labor for 2 guys - for $3400.00 ? Not so sure that is far or even reasonable so no, we do not accept him offering nothing. We now know this gentlemen isn't knew to this type of practice.
I have worked at as and estimator for a top 200 subcontracting firm in the nation. Any professional trade personals top service charge from the best company's in the surrounding states, tradesmen, charge less than 100hr for truck and man, less than 50hr for helper. That is the highest professional trades who pay all common industry benefits. Our current pool contractor we hired to replace Mr. [redacted] pays his #1 hand 17.00hr! His best labors get paid $12.00. I have worked my entire career in construction and I can get within $100.00 of what mr. [redacted] was out of pocket to do what he did for us.
We paid 1250$ to rent a pool for a week, because we had scheduled an event at our facility, we had allowed mr [redacted] 12weeeks from the date he told us he would start, just so we knew we gave him enough time. We were out 1250$ because of his incompetence and that is more than he was out of pocket. Mr. [redacted] makes a practice out of this type of businesss and we probably do not contact a 3rd party if he gave 1400.00 more back. But 3400.00 is blatantly cheating the general public and for that I hope he eventually learns that there is a right and wrong way to treat people, and eventually he learns to stop doing what he has done in the past and eventually learns that bad business eventually catches back up with him. We cant force him to do what is fare, but with social media we can do our part to make sure every person who we know, and I know in the construction industry will know exactly what he did to us, and how he tried to take advantage of us once he 'required' the first payment before he ever gets onsite and offers a large discount if paid in cash. He knows how to get common people and put them in a position like he told me wife himself - 'he kinda had all the leverage'. well what he doesn't apparently understand is he did have, but there are places like this, and social media, and IRS that might eventually change his attitude.

I was contacted by Mrs. [redacted] in February in regards to a pool bid. I submitted her a pool bid with a few revisions over the next few...

weeks, and went to her house and met with her a few different times for a least an hour or so each time. I advised her I could get her on the schedule around May 1st. As time went on, my schedule fell behind due to the excessive rain fall we've had in the area lately. When I advised Mrs. [redacted] that I would not be starting her pool on time, she became aggressive and upset and said that it was unacceptable. She became very demanding and rude. At this point we did NOT have a contract, there were only bids submitted. I do NOT do verbal contracts, all contracts must be signed by me and the paying party before any jobs are started. I talked about her and this situation to a few other contractors and they advised me that she is a VERY difficult customer and is never happy, she threatens the other contractors with lawsuits all the time, and they advised that I should not work for her. Word of mouth works both ways. After all the problems I had with her before the contract was signed, I decided to not be the contractor for her pool. I do have the right to refuse service to a costumer. I take pride in my work and strive to have happy customers because I get all my jobs from word of mouth, I don't have to advertise because of my good reputation. No payments were ever received from Mrs. [redacted], and the money she says she is out is not my doing, everything she spent can be used when the next contractor building her pool.
I do want to say that my responses to her emails were never threatening, unlike the emails from her and her daughter. In those emails they threatened that if I didn't do their job, they were going to contact the Revdex.com, post on social media, and/or take legal action.
