When *** and *** *** came in to buy a membership, the 10GYM employee they worked with was Gustavo*** asked him about the crowdedness of the club and he responded our rush hour starts at 4:til 9:00pmI spoke with Mrs*** both
times she called and was sympathetic and understanding on her first phone call, as a Mother of two sons myself, I understood her concerns about Jonathon getting home at a reasonable hourOn our second conversation, I was still sympathetic but not willing to cancel the membership with no feeJonathon has only visited our club one time at 8:pm, and that is not an indication of every nightFurthermore, I recommended he rotate in on the pieces of equipment he wants to use as do all the other membersMrs*** did not like that answer because she stated he is only 17, however, we have young people and older as well rotate on the equipment all day long everyday as needed to complete a workoutBelow please find his check in times: 1/26/XXXX XX:XX

Thank you, *** *** Corporate Vice President

***, We show you spoke with our office on 2-20-18. Our staff communicated to you that we are happy to process a medical cancelation for you and a prorated refund. All that is needed to proceed (as was communicated to you over the phone) is for your doctor to fill out our medical
cancelation form, or we would accept a letter or note from your doctor stating you cannot use your membership due to medical reasons. If you do not want to apply for a medical cancelation, you can do the buyout of $plus tax. That fee would be deducted from your prorated refund since you paid up front for a year of membership. Please let us know which way you would like to proceed and we will expedite your cancelation. Thank you. 10GYM Management

Initial Business Response /* (1000, 5, 2015/06/25) */
10GYM offers only two memberships, the Basic $a month No Contract which may be cancelled at any time with days written notice and the more popular month Preferred which includes all available amenities including unlimited free group
fitness classes, unlimited free tanning, use of all existing and future 10GYM locations and our Bring Guest for Free every day privilege
10GYM sometimes focuses advertising on the Basic Membership, sometimes on the Preferred and sometimes on both in our radio, television and website adsBasic and Preferred distinctions are always included in the advertising
If a guest enrolls online or at the fitness center, they see both 10GYM Memberships, the amenities, the terms and the payment information for each membershipThe guest then chooses the membership that best suits their fitness needs
Ms*** chose the Preferred Membership and was given a copy of her membership agreement at the time of enrollmentThe Preferred Membership clearly states it is a month agreement in bold letters at the top, includes payment information for months and explains the renewal policy at the end of original agreement termMs*** was also emailed a confirmation of her month Preferred Membership and a second copy of the membership agreement
All members have business days to review their copies of the membership agreementsIf after review they may switch memberships or cancelMs*** chose to keep her Preferred Membership
Ms*** first contacted ABC Financial, the billing company, on 6/5/to cancel her membershipAt this time she had a past due balance of $All membership accounts must be current before cancellationPer Ms*** agreement, she would be required to pay the past due balance and the early termination fee of $As a courtesy, 10GYM will cancel Ms*** membership immediately once her account is current (by paying $88.32) and 10GYM will waive the $fee
For payment arrangements Ms*** may contact the 10GYM corporate office at XXX-XXX-XXXX extension and ask for Sholly

I paid the enrollment fee of $and paied monthsI went to the gym maybe times all in the first monthI paid more months tha t I did not go and then quit payingI was never told I would have to give days written notice to cancel a contract that I was told I did not haveI feel that I was misled by the person that signed me up for the gym and the public and are being lied to when we hear the advertisements on the radio that say NO CONTRACTS, which they are saying I have to give days written permission to get out of plus pay I will blast this on my social media and to everyone I come in contact withI have paid them $to use their gym times and they want to scam me out of $more? Can you say advertising?
Final Business Response /* (4000, 9, 2015/07/10) */
10GYM has absolutely NEVER EVER advertised as a NO CONTRACT gym or clubWe have never ever said 10GYM No Contracts10GYM does advertise two membership types, a Basic $A MONTH NO CONTRACT membership and a Preferred month membership with an early termination option
Our radio and television advertising sometimes promotes our Basic Membership, sometimes we promote the Preferred Membership and sometimes we run advertising for both memberships simultaneously
Ms*** claims she paid an enrollment fee of $but in fact her enrollment fee was only $Ms*** was enrolled by the Midwest City 10GYM Manager *** *** Ms*** has been in management with 10GYM for over - years and uses the same Basic and Preferred Membership presentation with each and every guest
As a courtesy, 10GYM will cancel Ms*** membership effective immediately with nothing owed due to her apparent confusion over the membership she chose and the enrollment fee she paidAny further correspondence concerning Ms*** membership should be directed to the Oklahoma Deptof Consumer Credit which governs the fitness industry in our state

Still changing their story and now calling ME a liar. Very insulting people and I am glad to put this affair behind me. Prospective new customers should be aware of their false advertising and shoddy business practices. There is NO $10.00 per month no contract deal.See their website and you will see the $49.99 plus tax annual fee that is charged in the third month to EVERY customer. Also be aware that unless you allow them to either "run" a credit card OR auto withdrawal from your bank account there will be additional fees charged if one chooses to pay in cash at their local gym.......this is absoulutely outrageous!! I wonder how long it will be before this clip joint goes bankrupt AGAIN and resurfaces AGAIN under a new name!

[redacted] purchased the Preferred membership (as most people do) which includes unlimited guest privileges, unlimited tanning, and unlimited group fitness classes.  She used the membership many times in 2015, 2016 and 2017.  The first record we have of her attempting to cancel was on...

12-6-17.  To cancel any membership you must give a 30 day notice and all payments that come due during the 30 day notice are required.  The November dues ($21.71) are still past due and a late fee of $22.50 is now assessed.  The December dues ($21.71) and the annual rate fee ($54.18) fall within the 30 day notice period.  So technically, for [redacted] to cancel she should be paying a total of $120.10 in past dues, fees and current dues.  This procedure is the same for English speaking as well as any other language.  She is not being "extorted and exploited for not speaking English". Nevertheless, 10GYM does not want [redacted] to leave on a bad note.  Therefore, we are willing to waive the 30 day notice (which would include the $21.71 dues and the $54.18 rate fee) a savings to her of $75.89.  Furthermore, we are willing to waive the $22.50 late fee for a total savings to her of $98.39.  She will need to pay the past due November dues of $21.71 to catch up the account to current.  Once we receive the payment we will cancel out the account as she is requesting.   Thank you...........10GYM MANAGEMENT

[redacted] is on the Preferred membership that is a minimum 12 month commitment.  As stated already in this complaint, in order to terminate the Preferred membership prior to the minimum 12 months there is a buyout of $79.00.  We will process the prorated refund less the buyout and send [redacted] a check for the remainder.  This is the same whether you pay monthly or pay in full at time of purchase.  Thank you......10GYM Managment

WE mailed a letter on October 1, 2015 and it came back in return mail, then was remailed yesterday with the corrected address from the post office.

Complaint: [redacted]
I am rejecting this response because:I’m not wanting to cancel the membership for medical reasons because I am able to go to the gym but no longer want the membership. I only had the membership for 4 months, I still have 8 months left and want my full refund back because had I paid month to month like others I wouldn’t even be in this position and there wouldn’t be an issue.
Sincerely,
[redacted]
