Better price then what I was quoted anywhere else. They truly have the expertise.

I contacted and met ***, Director of New Product Development and paid for the Formal Patent Search, which I was told will be done through a Patent Attorney. The result that I received had a DESCLAIMER at the end:
"No legal or statutory compliance advice has been sought. The report and opine is based on the technical feasibility and practical applications. Only a technical comparison of features with the searched prior art are discussed. The prior art has been performed on third party databases including ***, ***, ***, ***, *** and *** patents and the authenticity, accuracy, and validity of information of the results dependent on the accuracy of information listed in these databases. The search does not include results filed before 1976 in *** as they are not available in digital form. Furthermore, the performed search does not include results corresponding to patent application filed in ***, *** and others patent office's but have not been published; these patent applicants are not in public domain."

Because of the very high price I have been charged for the Search ($975 + tax) I sought going ahead with another company and use the Search I have had paid already. Because of the DISCLAIMER the Patent Attorney could not use the existing search. I asked *** to provide me with a search result without any DISCLAIMER, one that is done by an Attorney and he told me that that is not possible. Then I asked for a refund and I was refused again.
I paid the new company five times less for a proper Search done through a Patent Attorney.

First of all I had been *** to pay a very big amount for a service that they advertise they do it for free.
Second, I could not benefit from the service that I paid for because it was not properly done (by an Attorney), had no legal power as it should.

Desired Outcome

I seek a refund for the money paid for a service that I could not use, it was improperly done. I seek a refund for the money paid for a service hugely overpriced.

I understand the client is not satisfied with our service. However, a considerable amount of research effort was put forth in creating the 119 page report.

The results were created by an international search agency that specializes in research for Patent Attorneys when preparing patent applications. The search results are still a valuable asset to any attorney preparing an application for the client. And would presumably be used by any attorney preparing an application.

Innovative would be willing to refund 50% of the cost of the search to the client.

I could not use the document when I needed it because of the reasons provided in complaint.
I did ask for changes so I could use it and I was refused at that time.
As a mater of fact the created search document had/has no value for me.

Although, I am willing to have paid a maximum of $200 to Innovative Licensing & Promotion for their work even it is no value for me.

(that is what I had to pay an attorney to create a similar document again, with proper legal value)

We understand the client did not accept our proposal. Are we clear in understanding the client is willing to accept a refund of the full amount less $200? We are not clear on what counter proposal the client has suggested.

My apologize for misunderstanding.

I am expecting a full refund.

Reasons:
1. I could not use the search file because of the disclaimer.
2. Mr. had refused to change it when I asked.
3. I had to pay an attorney to do a proper search file, after I been refused by Mr. to do the change.

AS a matter of fact, the service received had no value for me and I am expecting a full refund.

If the client is unhappy with our services we will supply a full refund. We forward a release form to the client and once signed will forward the funds to him via e transfer.

On March 1, 2018 I met with *** (Director of New Product Development, Innovative Licensing & Promotion Inc.) to further discuss a patent idea I have. At this point he was very positive, repeatedly stating how "big" and "life changing" this idea is. We discussed all aspects of my idea and *** outlined the process he would lead, including my participation, to bring my idea to a protected and profitable outcome. Their expected compensation; a small (4-6) percentage of future profits earned from my idea, and for me to pay the initial bill of $975 + HST = $1101.75 (Invoice #*** 01/03/2018) for a Formal Patent Search of Classification. *** explained this search would involve 50 hours of work and would take about a week. If negative (no existing patent) their engineer would work with me to produce drawings and their lawyers would carefully write the patent application for submission within 6-8 weeks. A successful patent would engage their marketing team to license my patent and thus earn profits for us both.
*** He repeatedly stated how life-changing and profitable this process would be. ***
Approximately a week later *** (Director of Patent Development) contacted me with negative patent search results and informed me of cost outline options ($9,735 or $14,309) to proceed. I told him I was taking the "percentage of profits" option, to which he replied that they do not offer that option. Then he informed me of issues with my idea that had to be addressed, and suggested I speak with ***.
*** e-mailed a cost outline early that afternoon but couldn't be reached till he called that evening. He spent this call trying to convince me to pay upfront and fully own my very profitable patent idea, to talk to family or friends and get a partner in order to get the money. He didn't want me upset later on when their 5% became a much larger number than the cost upfront. This was Thurs. eve and *** was unavailable to me till he called Mon. aft and asked if I had the money. I told him I still wanted the 4-6% deal. He asked if I had engineer drawings ready and said the percentage would have to be much higher without them but he was unable to cost project how much as he now felt there was problems with my idea and an engineer's fee would add to this. He urged me to come up with drawings and the money.
***'s next and last call was 2 days later on March 14. He tried hard to convince me to pick one of his cost outline options. It took several tries for me to get through to *** that I have no ability to come up with that kind of money, and would not have initiated (and paid for) the Patent Search without the offered 4-6% of future profits deal. *** then came up with more 'design problems' and said he couldn't come up with a percentage amount till these were solved and proper drawings submitted.
In view of ***'s changing facts, I felt he was (unsuccessfully) trying to bait me to an angry reaction so he had reason to terminate the conversation/contact and deflect his *** sales tactics. Clearly, I'm not being dealt with fairly, so I have not tried contact again.
I have not received contact from *** or his associates since.

Desired Outcome

I would like a complete apology and full refund from Innovative Licensing & Promotion Inc. and *** for this *** behavior.

Mr *** did contact me on April 25. ***. After several sales pitches by Mr *** failed, I agreed to sign a "2 paragraphs of plain language" release stating the matter was fully resolved and indicate this in writing to the Revdex.com upon receipt of the refund. On April 30 I emailed my concerns with the release sent me and before receiving a response from *** I was alerted by the Revdex.com stating Mr *** had "worked out an arrangement to his satisfaction".
Not true.
We exchanged several more emails that day, wherein I stated my continuing agreement to sign the release we had discussed, not the one he sent me.
May 7 I sent Mr *** a simple, signed release.
May 8 I emailed that I was still waiting for said refund, that the ten days time allotted for my Revdex.com response was nearly up.
I have not received a response from Mr *** since April 30.
I find Mr ***'s statements to the Revdex.com misleading and untrue.
All this is supported by email.

We wish to refund the client the full amount of the service. However to do so we require reasonable written assurance that this issue is finalized and no further actions will be taken against our company. The client is refusing to sign a brief release form. The client sent us a form of his own that does not address the key issues of release in reference to intellectual property matters.

I want this matter resolved. I will be satisfied when I get my refund.
I have waited weeks for cooperation wording a mutually agreed release, and been forced to get help deciphering Mr ***'s document.
