I am rejecting this response because:
Thank you for returning my call the other day about reopening this complaint so I can update it. I finally managed in late August to hire someone else to come out and install the pool that I had hired Innovative Outdoor Solutions to install. The first task we had was to undo the damage that Don from IOS had done and be thankful that he had not installed the pool as there might have been dangerous ramificationsI have attached the photos of the day job IOS never completed in May to the backyard Patio that he charged me an extra dollars for . Subsequently although he never showed up himself he would send one of his workers to dump dirt on my driveway which he claimed he would use in the pool area. The pictures attached show what condition IOS left in my back yard rendering it useless for the summer as it would have been dangerous to let my year old son play back there and to make matters worse , I had to deal with having dirt all over my driveway as the pictures attached in the email show. I had to pay the new contractor dollars to rip up the (can’t even call it a) patio IOS left me and to remove it and all the dirt in my drivewayThen when the new contractor checked the septic tank that Don recommended I put the patio over (as Don said he does this all the time) it turned out the tank was empty and we will never know if the patio with all that weight on it would have prevented the tank from collapsing. The next step was to determine if Don had delivered all the pool parts necessary that I had already paid for. I knew he hadn’t delivered the Liner or the Cell for the Salt Generator as he was trying to use these things to mediate what he should have paid me back. I actually texted him to ask if he would bring me my liner and cell which I had already paid for in exchange he could take the wheelbarrow he left hereI asked him to do it by Friday so as not to hold up my new contractor, but alas he did what he has always done since he was hired he said he would and then he didn’t and I received a text from him late Friday stating that he would do it on Saturday. Since my experience with IOS has been that they never seem to do what they say they will , I had the new contractor order the parts necessary so he could complete the pool installation. It is incredible the lack of professionalism and just outright contempt Don has demonstrated in my experience with him. He has sabotaged every reasonable effort to do the job he was hired to do or to just get me back to the point where he didn’t cost me money as he wants to settle for a portion of what he owes and take no responsibility for the situation he created and prolonged at every opportunity. Not only did we not have a pool this summer but basically we did not have the use of our yard, nor could we use the driveway to shoot baskets as we have done in previous years. He withheld items I had paid for when he delivered the pool and then tried to use those items as a bargaining chip to get me to accept his offer, not that I believe I would ever see any check from himThis con man at least in my experience has taken my money and not performed the service in a timely fashion as I’m sure he will argue he was going to get to it eventually or resolved to return the money I paid him for the install he did not complete or compensate me for the mess he created. To whom it may concern,I was contacted by ** * *** *** back in late to do a pool installation.They decided to use my services; we discussed payment and permitsThey decided to purchase the pool from us in October and asked us to hold the pool until spring for installation
I collected the first deposit in October We spoke in April to start permit paperwork and we got approved When we came to start excavation, and scraped the surface of the ground, we rubbed the top of a septic tankThe septic tank was not on the survey and *** said he had no knowledge Once I saw the septic tank was capped we brought up the idea of building up the ground and installing a concrete padAfter a concrete pad was laid down, we were going to bring in dirt and stone dust to top it off and compact it to have some level cushion and hard, solid level surface for the pool to sit onWe discussed with the town and they said that a concrete pad to follow the same existing setbacks that the pool requiresSo, we went a little extra to play it safe*** and his wife agreedWe collected the second deposit (the cost of the material and labor for the concrete) and the contract was signed on /27/17. This was an additional $on top of the original balance of $8,799.00.*** subsequently went down to the town to draw and add the concrete pad onto survey and draw the pool in the middleThis is what the engineer at the building department informed us to doHe was re-approved May 4th and called to inform meI was in a bad service area so I texted him and said will return your call shortlyHe said he had received the permit and was “ready wherever you are”My exact response in text was “awesome apparently this weather isn’t call me in the am and we will figure it out “his response was yeah looks like a lot of rain.”The to weeks of rain at the beginning of the pool season set our company schedule back about one month and *** was informed of this when trying to schedule his job to beginThe rain continued while scheduling the majority of this project.We cannot install pools in cool weather due to liners not stretching properly and the ground being hard and wetNor can we install a structure to hold water on unstable ground.May 15th came and we finally had some good weather and a chance to do the concrete padThe guys and I went at am to start the jobI had set up a guy that I knew had a lot of experience with concrete stay to make sure the job was done correctlyUnfortunately, he didn’t last here long for one of this reason: the concrete did not come out as planned and expected*** was not happy and contacted me to figure out a game planI told him I would figure it out and make sure it was done properlyHe sent me pictures in a textI even sent him a text response end of May stating that the past weeks were unbearable due to a bunch more rain so I was doing the best to get back thereAs the rain continued, I was trying to figure out a day for his concrete, still was playing catch up on jobs that weren’t installs, and attempting to get some work done while everyone’s grounds were drying outRan into a few personal issues in the meantime when *** had contacted me in the process of me getting him a date to get back there but also had some liners explode due to temperatures dropping drastic at night Long story short, this has been a pool season of difficultiesWith all that being said I had every intention of getting his job done and was actively in the process of planning itIt has been a wet horrible summer for outdoor contractors all over down here not just myselfThis is not how I like my outcomes to be with customers nor do I take my business reputation lightlyThe last thing I wanted for was it to come to this and have a family upset and disappointed with meBut I also did try to reason with him and either put a nice layer of fresh concrete over what is existing or break it up and re do itHe did not want me to follow through with having the pallets of concrete brought there on my expense to make rightI went and tried to start the job again on July 14th and we once again had thunderstormsI dropped off the pool liner, filter, pump, maintenance kit, and salt systemI did hold onto the liner to keep it stored at room temperature until installationMy intent was to give him peace of mind by having the majority of his paid materials in his possession and I would return to complete the job. He once again couldn’t wait for me to fit him in and wanted to cancel the job. On July 21st, we spoke on the phone for almost minutes and he was set in stone on wanting a refundI said I will “look at the numbers and get you some money back but you have 100% of the material there.” The approximate value of the materials at his house was $I checked the numbers and planned to get him a refund on TuesdayHe said I could come to the house between 9-am and we agreedHe asked about the refund cost and said I didn’t have the paperwork on hand at the moment and will go over that with him in personHe did not want me coming to the houseHe said it was better we agreed on the phoneSo, I contacted you (consumer affairs) to mediate the situationI am willing to give *** *** a refund of $considering he already has his pool and all the building materialsHe has paid a total amount of $thus farThe remaining estimated cost of the job was never paid to my company from *** ***I have text message conversations saved between the two of us to validate these amountsI did not collect any additional money for excavation, or for the labor to bring materials there, the concrete, my time and any additional cost of laborI am not trying to collect any money from *** *** from here on outI am only attempting to resolve this disputeGiving him even the $is a huge hit to a small business-like mine, but I do not mindI just want him to be satisfied and to take down the negative reviews about my businessIt would be greatly appreciated I have been willing to work with him and am attempting to address this with you professionallyMy business is my life and means the world to me so I am trying to do my best this season and end all jobs on good terms If you take a look at the contract it states he gave a deposit of first plus sales tax which brought it to $3,the value of the salt system is $1,plus the $3,which 1st deposit should have been more to pay for salt system in fullBut total of those goods are $,4,plus sales tax Second deposit for concrete, labor, materials was 2016.33 Willing to give a refund of $2,000.00 At this point I had dropped off truckloads of dirt, sand, and all materials for rest of the job and even excavated the hole to code which excavation was $plus all my labor cost which I am not trying to get back or argue about just want *** *** happy
