Revdex.com:I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID ***I understand that because I have decided to not pursue arbitration that Revdex.com must close my complaintI have decided to pursue legally or via other avenues. Regards,

Complaint: [redacted]
I am rejecting this response because:  WE HAVE NOT BEEN "LEANING" on this switch!  After the first replacement was done we were told to be VERY CAREFUL and make sure to stop the cover as closing and opening. We have been EXTREMELY careful and STILL the brackets buckled. The fact that it has broken three times in 7-weeeks shows how unreliable this cover is. I do not want to go thru winter with this horrible product. This cover problem has been a nightmare and just want this uninstalled so we can move on and finally ENJOY our spa as we HAVENT due to this cover.  We have only been able to use HALF the time. We now will stay away from any thing electric at this point and keep to the manual type as this would be at least reliable.
Regards,

Tell us why here...We understand and apologize for the frustration that this situation has caused.  We have kept in constant contact with Mr. [redacted] throughout this ordeal.  We have been in constant contact with the manufacturer of the auto cover, [redacted], as well.  The previous...

models of the auto cover did not require a fail safe switch.  During the spring of 2016, [redacted] changed all their pool cover motors to a one-size fits all style motor.  The [redacted]’s auto cover is the 4th one that we have installed with this system.  We have a total of 7 now with this system.  The [redacted]’s were the first to have an issue with this upgraded cover motor.  We were out the first time to replace the motor mounts and adjust ropes per [redacted]s request.  The second time it failed, [redacted] authorized a complete replacement which included the entire cover, ropes, motor, and motor bracket mounts.  All of the parts were covered by the manufacturer.  All the labor has been taken care of by Aqua Spas.  After this replacement and in the following week, I received two more phone calls from other customers with this new auto cover system who spoke of their motor mounts being bent.  I knew at this time we were probably not dealing with a part failure, but an engineering issue.  I immediately started working with [redacted] to resolve these issues due to seeing an issue with 3 out of the 7 we have installed.Mr. [redacted]’s is the only cover that has failed multiple times.  I have not shared any of this with the customer, but the manufacturer thinks the reason is due to the customer “leaning on the switch”.  This means not letting up off the open/close button quickly enough when the cover is at a stopping point.  By doing this with the upgraded motor, it is putting unnecessary stress on the motor mounts.  We have instructed the customer to be very mindful of this and they state in an email that they have been.  Yet we have done testing on an eighth install and the mounts only seem to fail during “leaning on the switch”.  However, with that being said, Aqua Spas does NOT feel that this is acceptable for a solution.   Aqua Spas as the dealer of their product are not placing blame on the customer.   Unfortunately I believe it took a subsequent failure and our isolated testing to get the manufacturer to understand our position.  [redacted] is now fully compliant with the revisions we have requesting and their engineers are nearing the final solution.  This solution involves adding additional mounting brackets along with a software update.  Adding the additional mounting brackets will add the much needed strength to the foundation of the entire assembly.  The software revision will give this system limits on the opening and closing of the cover which will eliminate the possibility of a customer “leaning on a switch”.  Doing these steps will make the auto cover even more dependable through the years, as we haven’t had any issues with their previous models.

We would like to set up an arbitration meeting.  We have rectified this issue on other auto covers since this complaint has been filed.  The other customers have been 100% satisfied with the upgraded mounting.

Revdex.com:
I have reviewed the response made by the business, and find that this resolution is satisfactory to me.
The business was fair with me I have no issues anymore

To whom it may concern,After speaking with [redacted] and working with unincorporated [redacted] County and their zoning and permit departments, we could not come up with a solution for the customer to have a spa.  Unincorporated [redacted] County was not willing to work with us or the customer. We have...

refunded [redacted].
