customer and her husband of the price to snake the sewer line. The customer and her husband were provided our standard price and shown our straight forward price guide prior to beginning any work. The customer accepted the price that was given and signed the work authorization section of our invoice. I have also enclosed a copy of our straight forward pricing guide. A snaking of the sewer is listed on the guide as #2 single line 3-4". While our technician was at the customers home he snaked from outside into the basement. Due to the amount of root obstruction in the line the technician was unable to tell when he would hit the cleanout in the basement. In effort to be sure there was no damage he asked the customer to stand in the basement and listen for when the cable had reached the clean out so that he could turn the machine off. While cabling the line the technician did pull out  a lot of roots. The technician discussed options for a permanent repair and provided prices to the customer and her husband. The customers had declined any further repairs. We warranty and guarantee our work. Therefore had the customer called us we would have happily returned to thier home. In effort to resolve this situation if the customer would provide us a copy of the other companies invoice we will be more than happy to refund them the cost of the visit with the other company.  Thanks  Christina

thawed. our technician went to the customers home to work on thawing the pipes. The customer and the technician discussed pricing prior to the technician beginning any work on the frozen pipes. The technician did provide the customer a copy of our straight forward pricing guide which outlines the price for our technician to thaw pipes. Every customer is shown the straight forward price guide prior to our technicians beginning any work. I have enclosed a copy of our straight forward price guide and have circled the cost to thaw pipes. Every customer is also asked to sign the work authorization portion of the invoice prior to the start of any work in their home. I have enclosed a copy of this invoice and have circled this area which shows the customer did approve for our technician to proceed with the work requested. At the time of service the customer did stop our technician  after having the thaw machine hooked up for 1 hour and 45 minutes stating that it would be too expensive to continue with the work. The invoice I have enclosed does show an amount of $99 which was waived for the customer. This is the cost of the travel charge to any customer who secures services on nights and weekends. The customer was charged $612.50 plus tax of $53.59 for a total amount of 666.09. 
On the days following the work we provided the customer did call the office numerous times as she was upset about the cost of the work. Mr. [redacted] spoke with the customer personally at this time the customer requested a refund of $50.00. As it is noted on invoice Mr. [redacted] agreed to take $50.00 off of the price of the bill. At the time of this agreement the customers credit card had not yet been charged, an adjustment was made to the customers bill and her credit card was charged in the amount of $616.09. At the time of the discussion with Mr. [redacted] the customer stated that this satisfied her complaints and she was happy with the resolution. Sincerely  [redacted]

Thank you again for the additional information regarding complaint ID # [redacted]. We have reviewed the consumers response. I do understand that the consumer feels a normal service charge should be no more that $800.00. However Musso Plumbing and Heating performed extensive work to the broken lines in the customer boiler system in order to be able to restore heat to the customers home. As the consumer states in thier response pipes must be thawed before restoring heat to the boiler system to avoid further damage. 
In the inital visit on 1/12/2015 the customer was charged only the travel fee of 85.91 as the technician need to return the next day. Our technicians returned the next day 1/13/2015 per the customers request to thaw and repair broken pipes in the boiler system. At this time the customer was given a detailed account as to what work the technicians would complete as well as the cost to do the work. The customer signed the invoice giving the technicians approval to ove foward with the proposed work.  The technicians spent an excessive amount of time in order to make the repairs.  The technicians repaired 6 leaks in the baseboard system and also thawed frozen lines as well as replacing an air eliminator in the boiler and purging and testing the system. The original bill for the work being completed was $3622.33 which upon completion of the work  the customer stated they would only pay $3372.33 for which amount the customer provided a check. An invoice was written by the technician to reflect the amount the customer would be paying for services on this day.   

On 1/14/2015 the customer called Musso Plumbing and Heating and stated that there were additional issues that were not resolved. At this time 2 technicians and Mr.Musso went to the residence and found that lines in the furthest side of the house in the back bedroom were also frozen. The cost of the additional work equals $1500.00 for which the customer was not charged as Mr. Musso waived the cost of the additional work as the customer stated they were unable to spend anymore money that she had already spent so much.Mr. Musso Offered to discount the work to $500.00 to be more affordable to the customer . An invoice was written for $500.00 and was further discounted to $250.00, the customer stated they would not pay .  In order to keep the customer happy Mr. Musso did not collect payment for this work completed. The customer was advised to not tamper with the baseboard system if a problem arises in the future.  As the Custoemr noted in thier response they refused to pay for some of the work and did not pay for it. At this time Musso Plumbing and Heating has lost a considerable amount of revenue by not being paid in full for the work completed at this residence. At this time Mr. Musso is considering contacting the courts in order to recover the unpaid charges ecrued on this job. Sincerely [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Musso in fact did explain problem and options with prices and financing which this took over 2 hours.  The attempt to remove/drain water took approximate 15 minutes and not 2 hours as claimed in response.   Also, Musso does not reply to my complaint as to another plumber arrived shortly after Musso left and this plumber was able to drain water without problem.  Musso claimed tried but couldn't drain (my opinion is he did not really try-just wanted me sign contract).  I wpuld like response explaining why he could not remove water but another plumber did!  My next step is the attornney general.   Also, please remind Musso there is complaint previous to mine that is very similar, coincidence, I doubt.

I am writing in response to complaint ID # [redacted]. I have reviewed the consumers complaint in regards to service at his home on 11/8/2014. I have further reveiwed our phone calls for this time frame and have reveiwed the information given to Mr. [redacted] in regards to our service. It was clearly...

explained to Mr. [redacted] during his first phone call that it is $99 for the technician to come to his home. At which time the technician would take a look at his boiler and review with him what the best way to repair the boiler would be as well as the cost from our straight forward price guide to make the repairs. Mr. [redacted] was informed at this time that the technician would not begin any work without his approval to do so. At this time I was thanked for the information and told he would call back. Mr. [redacted] did call back later in the day and spoke to a representative from our answering service, he informed the representative that he had called earlier in the day and we were the cheapest so he would like us t come out to look at his boiler. 
 At the time of the technicians visit , the technician did activate the auto fill manual lever and filled the system. The technician did recommend replacing the current boiler, Mr. [redacted] did have us apply for financing to do the replacement work unfortunately he was not approved.   I have forwarded our recorded phone calls with Mr. [redacted]as a reference.  Sincerely, [redacted] Office Manager

residence at [redacted] in Depew on 1/12/2015 as the customer stated they were having heatng issues. Our technician was informed by the customer that there were leaks in 2 places in the home in thehot water baseboard system. The customer was charged a service call of 85.91 for this day as the customer did not have us complete any work at that time. Musso Plumbing and Heating received a call on 1/13/2015 from the customer requesting that we return on this day to repair the leaks. 2 Technicains were sent to the residence on 1/13/15 at which time it was found that numerous pipes in with in the baseboard system were frozen causing the pipes to crack. The customer was informed of the prices to complete the work prior to work beginning and signed approving work to be completed. The technicians repaired 6 leaks in the baseboard system and also thawed frozen lines as well as replacing an air eliminator in the boiler and purging and testing the system. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The first repair job Musso completed failed (completed 11/14). The reason the line backed-up again (11/26) was that the trap replaced by Musso (11/14) did not have the correct pitch. Due to the way Musso installed the trap, the middle of the sewer line was "bellying" and causing water to pool and drain slowly because the trap was laid lower than the middle of the line. After reviewing the situation, Musso stated that they needed to replace the middle of the line in order to get the proper pitch. At no time was it mentioned that the pitch would be an issue. Note the sewer line had been in the ground for over 50 years. After replacing the middle of the line, Musso can back again and stated they had to replace the rest of the line! Musso then informed me after tearing up my entire backyard - a 6 foot wide, by 10 foot deep, by 100 foot long hole - that they could not make the pitch to the sewer. Musso then stated that it would be another $20K to complete the job.  Hearing this, I knew I was being scammed. I called the town and village, who both told me that there should be no issue and that I should stop working with Musso. I then called Erie County, who also informed me that there should be no issue. I then called three other contractors, all three of which reviewed the job site AND COULD NOT BELIEVE THAT THIS HAD HAPPENED.With all said and done, Musso missed pitch by 9". This means they ran the sewer line almost a foot underneath the connection to the county!!!  This is why the meeting was called. Mr. Musso was standoffish. Questions about why Musso did not restart the job from the house (where you are supposed to start) in order to gain enough run to properly lay the pipe were not answered. Mr. Musso failed to answer questions and provide any resolve besides pledging another, "quote."
When Mr. Musso called with his quote - $17,200 - to fix the problem, I was floored. Hearing this I suspended work and told him I would need a few days to A) call the bank and get financing and B) speak with others. Musso then had the audacity to send workers to my house - unauthorized - and then begin working again! This only added to the mess and expense!  After research, I found four contractors who all stated that Musso was incorrect. Each stated that the pipe could be run correctly without the excessive system proposed. In fact, each contractor stated that even if that was the case, that this aggressive system was needed, it would not cost more than $5,500; a third of what Musso was attempting to extort from me. Given this, I made the decision to kick Musso off the job and file this complaint.As an FYI, the new contractor was able to lay the pipe and hit the proper grade. contracts, my initial contact letter to Musso, the State Attorney General
complaint letter, Musso’s  response to
the Attorney General, and the Attorney General’s response.   As you will see the amount of my requested
refund from Musso is small.  The issue
with me is the company forcing me into an additional contract to cover their cost.    Thank you for your help.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Musso has
made no attempt to resolve their mistake. I would like to start by saying that
I believed the purpose of a contract was to legally bind two parties to the
work to be performed and the payment due for that work.Musso contract “1” specifically
stated what work that was to be performed and the cost of that work. Musso was
to replace the sewer outside trap and vent and they were responsible for all
labor and material needed to be performed that task.  They then discovered, after tearing up
my front lawn, the vent was not where they had guessed it to be.   Musso found the outside vent,
after they brought the correct locating equipment, under my driveway well over 12
feet from
where they guessed it to be.  The
company now determines it will cost them more so they present me with an
additional contract to cover the cost to replace the outside vent, the work to
be performed in the original contract. However, as I told the employees
numerous times, I disagreed with signing the new contract, Contract “2”,
and was signing it under duress.  ( I
had tried to add the wording on contract  “2”
that this contract was signed under duress, but the employee took the
contract  from me and I was told I am not
allowed to add anything to the contract other then my signature.)  Their response to my objection to the new contract
was that if I did not sign contact ‘’2” they would discontinue all work, which
very little was performed, and they offer me none of my money back on the fully
paid contract “1”Musso stated
that I signed the additional contract and they are correct.  However, if I did not sign it they
would have walked away with my money and the outside vent would not be
replaced. As I told the company the contract was signed under duress. Regards  [redacted]

We found the sewer to be full of sewage and roots that a camera couldn't get through to locate the trap and vent. Once we opened the sewer by snaking we were...

able to locate the trap and the vent which took and offset from the original location. The location of the offset was under the driveway. We then had to do additional work to be able to replace the trap and vent which is why we presented the customer with contract 3897 for the removal and dumping fee including trucking, removal of dirt, and laying down the stone where we had to dig up the driveway. The customer signed the new contract that he was presented with and we proceeded to complete the job. Also note from the first contract it specifically states "Musso will not be responsible for final landscaping or any concrete."
