I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me I would like to point out that there was a single account number that had not been provided before *** 25th On *** 25th, a summary of all account numbers and unemployment rates was provided States accept paper checks and paper filings with "Applied For" in place of an ID if one is not available at the time of filing If reports had been filed, by the due date, a mere letter matching up the reports to the id number would have been sufficient to waive penalties and interest for failure to file.I appreciate the prompt response to this complaint With copies of payments made to the state agencies, I am better able to respond to the notices received.Thank you,*** ***`** *** *** ***

After carefully reviewing this situation, our findings are as below:
*** initially spoke to Cynthia N***, CC Rep on 3/19, indicating she did not understand how Insperity could retroactively collect missed premiums for coverage back to her date of hire, when she did not actually enroll until
March 13, During the conversation *** was accurately advised her benefits eligibility date of March 2, was the same as her date of hire, as the **ient company elected a day waiting period
A couple of hours later *** called back and spoke to **ay Ladd, SrCC Rep**ay accurately explained to her the enrollment process, and also sent her an email attaching a copy of her online enrollment confirmation (see attached email)The enrollment confirmation, **early indicates her effective date of coverage to be March 2, and outlines under the Terms of Participation, acknowledgement that she agreed to pay any required contributions, and authorized those to be deducted from her compensation
A few minutes later *** called back still upset about the deduction, and while speaking with Cynthia N*** again, *** disconnected the call(per recorded calls)
*** called back within a few minutes for a final time and asked to speak to a SupervisorShannon O'***, CC Supervisor, assisted her and informed her that she would follow up with the ** to see if there was anything further Insperity or the **ient could do, and provided her direct phone number

When Coverage Begins:
If you enroll in the Insperity Group Health Plan (Plan) during your 30-day (or any longer period as required by a state insurance law that applies to your coverage) initial eligibility enrollment period, you generally will become covered under the Plan as of your Insperity coverage effective date or your eligibility date (the date you first became eligible for Insperity coverage)
• If no waiting period applies: If you have no waiting period and you enroll during the first days (or any longer period as required by a state insurance law that applies to your coverage) after becoming an Insperity employee, you will be covered beginning the first day of your employment as an Insperity employee
• If a waiting period applies: Your 30-day (or any longer period as required by a state insurance law that applies to your coverage) initial eligibility enrollment period begins the day after the waiting period endsThe day after the waiting period ends will also be an enrolled employee's Insperity coverage effective date
Example: If a waiting period that applies to your situation ends on August 31, your Insperity coverage effective date is September and your initial eligibility enrollment period is September through September If you enroll at any time during your initial eligibility enrollment period, your medical coverage will begin as of your Insperity coverage effective date (September in this example)
If you also enroll your eligible dependents during your initial enrollment period, their coverage usually begins at the same time as yours
After enrolling, any associated employee contributions through payroll deduction will begin on your coverage effective dateGroup health plan coverage for any eligible dependents you enroll generally begins on the same date your employee coverage begins
It is unfortunate Ms*** either did not read or understand this information prior to her enrollingBecause she is still within her day initial enrollment period, she can elect to terminate her coverage and receive a full refundIn order to do so, she would need to access the online enrollment system prior to midnight CST on April 1, 2015, and terminate her coverage

This
is in regards to complaint # 10326794.
 
After
reviewing our call records, we were able to find resolution to Mrs. [redacted]
complaint.  [redacted] has indicated that the retraction of
payment letter was sent in error, and...

they have paid for the services through
February 28th, 2014 (the day that Mr. [redacted] employer terminated
services with [redacted]).  Effective March 1st, the new carrier
would take over responsibility and coverage of the medical claims that were
incurred.
 
We
have spoken to Mrs. [redacted] to apologize both on behalf of [redacted] and
[redacted].  She is relieved that this has been resolved. 
Additionally, Mrs. [redacted] has requested a copy of the letter indicating that
this was an error, and we have placed that request to [redacted]. 
She also has the direct number to our Director over the Contact Center, and will
reach out to her directly if she needs any further assistance.

When
the client left the [redacted] and moved to Insperity Payroll Services [redacted] 1, 2014
there was a need for them to register in the states where they were paying
employees.  This is required for state income tax as well as state
unemployment tax.  The requirement for the company to...

register in all the
states was communicated at the time of setup so that Insperity would be able to
pay taxes and file returns timely.  This Insperity relationship is
different than when the client processed under the [redacted] where taxes were paid
and filed using Insperity’s tax ID’s.
Insperity
was sent ID numbers on [redacted] 25th and the e-mail was missed due to
the volume of filings that had to be completed for all clients by the [redacted] 30,
2014 deadline.  The oversight was not identified until the client started
receiving notices from the states [redacted] 20, 2014.  Insperity updated the
system and filed all returns [redacted] 3-10, 2014 and paid the taxes.  A spreadsheet
was supplied to the client with a breakdown of taxes and fees that Insperity
took responsibility for based on the individual filing requirements of each tax
jurisdiction.  Many of the state income tax jurisdictions required
payments to be made the 15th of each month which up until receipt of
tax ID’s in [redacted] could not have been made timely.  All returns have been
filed and taxes remitted.  The state tax agencies are very slow in sending
out penalty notifications and Insperity would not have the methodology for each
state in question to calculate the penalties in advance.  Penalties and
interest have been paid for tax jurisdictions where Insperity was clearly at
fault.  Insperity will continue to pay penalties and interest for future
notices pertaining to this matter as well.  Insperity will provide copies
of all tax returns filed, which are also available to be printed out of the
system by the client and supply a complete accounting of all dollars paid
out.
