We are resolving this complaint through the Attorney Generals office. We sell used vehicles without warraties and offer an optional warranty. I offered to help rrpairing vehicle via my mechanic and buyer declined or ignored my offer. The vehicle was sold in "as is" condition and I have a statement...

from their mechanic confirming that that specific model in cars the transmission is known to fail "randomly." We are not responsible for repairs after the sale of a vehicle and this is the first complaint we've had in the 4 years I've been in this business. The buyer agreed the vehicle purchase did not have a warranty neither expressed or implied.l and further declined the optional 6 month warranty. At this point we will base our decision based on what the attorney generals office decides. I sold the car in good faith and like the client states they had a pofessional mechanic pre-inspect it. They left a refundable holding deposit eith the contingency that I fix the issues noted by mechanic and if they were satisfied eith repairs. Their mechanic did a second inspection and they were satisfied with the repairs and proceeded to close the deal. I have copies of all our communication that I've submitted to the Attorney Generals office that show the client is being contradictory on some of her own statements.

Your claim that the transmission was flushed by us before selling is inaccurate. The vehicle never showed signs of having a bad transmission and that is not how we do business. I have a list of cars I decline selling because they don't meet our standards and also a list of the cars I've sent to be sold at public auctions simply because a potential issue was present and we rather not deal with issues like this. The vehicle was test driven by my manager, my technician, my wife and myself before being put on display as is standard pocedure. Furthermore your professional mechanic did a inspection prior to closing the deal, which we encourage because we have nothing to hide. Ultimately the car was sold in "as is" condition and we were in a mutual agreement that the 10 year old vehicle did not come with a warranty at $5500, we offer an additional warranty for $500 on any vehicle which was not purchased at the time of sale. It is unfortunate but we do not feel we are responsible for the repairs as we went above and beyond to avoid any potential issue but they are used cars and things like this can come up anytime, that is the risk involved in buying a used car. In other situations I've come across the buyers were reasonable and we were able to resolve the issue, some have since become repeat customers. We offered to help through our mechanic but if that is not sufficient then we'll go by the book, no warranty neither expressed or implied is what our contract states.

Dealer told me the 3 estimates I received for repair were "unreasonable". He never did offer to fix the car,only that he might 'help out' but then said the cost was too high and he would only use HIS mechanic. I do not want to use his mechanic because he lied about the rack and pinion being bad, which it has been confirmed that it is. They did the cheapest fix possible which I'm sure they will do again. They also flushed the transmission right before we bought it, according to the auto shop, who said, "this is brand new, fresh transmission fluid that hasn't had any miles on it". Seeing as no other fluids were changed even though they needed it, we firmly believe the transmission was slipping before purchase and was covered up with a flush. My 18 year old daughter purchased the car and when the issue of the warranty came up, she was told, "nobody buys these, I've only sold 2 of them ever".  She was led to believe this is not common practice and was unnecessary, which is very interesting. As far as the statements regarding the mechanic who came to look at the car, he is very saddened that he has been misinterpreted and is in the process of speaking to the Attorney General to clarify his statements. When he found out the dealer flushed the transmission just before purchase, he was also 100% certain the dealer knew of the issues before they sold it. No one who has seen the car believes it was "coincidental" that the transmission went bad just days after purchase. I have begged and pleaded with them to do the right thing and take the car back but they have refused, claiming they had already spent the money. I even offered to take half now and half after they repair and sell the car to resolve the issue of capital, but my offer was ignored. I do not have the funds to repair the car as I gave this dealer everything I had to purchase it on "good faith" that it really was in great working condition. I continue to ask that they take the car back and return my money asap.
